I have been furnished a photocopy of a Notice of Failure to File Certification and
Request to Conduct a Hearing Pursuant to Rule 5.6(e), which appears to have been
scheduled for hearing on April 29, 2009, and also a copy of a letter from Sean M.
Shultz, counsel for Bernadine Wiley, requesting the filing of an Inventory of this estate
by July 6, 2009. I am writing today to determine whether or not Ms. Nieves has
complied with these requests or ff she has been removed as personal representative. I
would appreciate a copy of any Inventory filed by Ms. Nieves in order to determine if
there are sufficient assets to pay my client's claim. Please include an invoice for
photocopies and same will be paid immediately upon receipt.
