("Plaintiff'), is a corporation with a place of business at 726 Exchange Street #900, Buffalo, New York 14210. 2. Defendant, JAYSON HAMMOND, a/k/a JAYSON E. HAMMOND, a/k/a JAYSON ERIC HAMMOND, a/k/a JASON HAMMOND, a/k/a JASON E. HAMMOND, a/k/a JASON ERIC HAMMOND ("Defendant"), is an adult individual receiving mail at 5 Silver Springs Road, Mechanicsburg, Cumberland County, Pennsylvania 17050. 3. As Jayson Hammond Excavating a/k/a Jason Hammond Excavating is an unregistered fictitious name, Plaintiff brings this action pursuant to PA.R.C.P. 2128(d). COUNT I - REPLEVIN 4. Plaintiff is the holder of an Equipment Financing Agreement (hereinafter "Agreement"), duly executed and delivered by Defendant to Plaintiff, on or about January 8, 2007. A true and correct copy of the Contract is attached hereto, marked as Exhibit "1" and made a part hereof. 5. Pursuant to said Agreement, Plaintiff provided financing to Defendant for the purchase of a 1987 CAT 953 Crawler Loader, S/N 20Z01194 ("Collateral"), as evidenced by Exhibit "1," attached hereto. 6. Defendant took possession of the Collateral, as evidenced by the Delivery and Acceptance Certificate executed by Defendant, a true and correct copy of which is attached hereto, marked Exhibit "2," and made a part hereof. 7. Per the terms of the Agreement, Defendant was to make thirty-six (36) consecutive monthly payments of $1,295.00. 8. The total amount due to Plaintiff under the parties' Agreement, including fees and interest, was $46,795.00. July 09, 2009 Page 4 9. Defendant is in default of the terms of the Agreement by failing to make the required monthly payments. 10. Plaintiff holds a security interest, in said Collateral, and as such, is entitled to immediate possession of the Collateral, and any proceeds from the collateral, including insurance proceeds, by virtue of Defendant's default. A true and correct copy of the filed, UCC-1 Financing Statement, which evidences Plaintiff's perfected security interest in the Collateral is attached hereto, marked as Exhibit "3," and made a part hereof. 11. As of June 25, 2009, an unpaid balance, including fees and interest, in the amount of $30,502.10 remains due and owing to Plaintiff from Defendant. 12. Plaintiff avers that the Agreement provides that Defendant shall pay repossession expenses and attorneys' fees upon Defendant's default. 13. Plaintiff avers that as of June 25, 2009 such repossession expenses and attorneys' fees are in an unliquidated amount. 14. Plaintiff has performed all conditions precedent as holder of all right, title, and interest in the Collateral, but Defendant wrongfully remains in possession of the Collateral at the address, as set forth herein in paragraph 2 above. 15. By virtue of Defendant's default, Plaintiff has an immediate right to possession of the Collateral covered by the Agreement. July 09, 2009 Page 5 WHEREFORE, Plaintiff, First Niagara Leasing, Inc., respectfully requests that this Honorable Court enter Judgment, on Count I of the Complaint, in Replevin against the Defendant, as follows: a. For possession of the Collateral, more particularly identified as a 21987 CAT 953 Crawler Loader, S/N 20ZO1194, b. Reasonable repossession expenses, attorneys' fees and court costs for retaking possession; and, c. For such other relief that the Court deems just and proper. COUNT II - BREACH OF CONTRACT FOR IN PERSONAM DAMAGES 16. Plaintiff incorporates herein by reference thereto each of the preceding paragraphs of this Complaint in their entirety as if the same were more fully set forth herein. IT In the alternative to Count 1, Plaintiff pleads an action for Breach of Contract as a result of the Defendant's default under the Agreement in the amount of $30,502.10, plus continuing interest at the rate of six percent (6%) per annum on the balance due from June 25, 2009 and costs. 18. Under the terms of the Agreement, Plaintiff is entitled to recover repossession expenses and attorneys' fees incurred as a result of Defendant's default. 19. Plaintiff avers that such repossession expenses and attorneys' fees are in an unliquidated amount to date and said fees continue to accrue.
