Patterson, the Court finds that Walter Patterson is incapable of receiving and evaluating
information effectively or making and communicating decisions regarding his financial
affairs, and, specifically, regarding his application and appeal of Medical Assistance
benefits. Moreover, the Court finds that Walter Patterson is in need of a qualified Court
Authorized Representative to pursue Medical Assistance benefits on his behalf, and, in
accordance with the Pennsylvania Code, such Representative shall:
(a) be as acceptable to the Department of Public Welfare as a
court-appointed guardian; and
(b) have the same legal authority as acourt-appointed guardian to
act in respect to public assistance matters and will have to abide by
the regulations related to acourt-appointed guardian.
Accordingly, Shaun O'Toole, Esquire is appointed as Court-Authorized
Representative for Walter Patterson and, as such, to act for him with regard to his appeal
and application for MA benefits, with such actions to encompass and authorize obtaining
and submitting the necessary financial information to secure Walter Patterson's eligibility
for MA benefits, and to take any such other actions, including a medical assistance spend

down, necessary to qualify him for such benefits.
The aforementioned judicial determinations have taken into consideration the
matters required by statute.
