Dear Mrs. Bucher: We received your request for information on property you have for resale in Rose Hills. We tried telephoning you a couple of times but could not find you home. First, we are sorry to learn Mr. Bucher has passed away. We contacted Rose Hills and we understand his cremated remains have not yet been placed in Grave 2, Lot 6610. We also checked to see what graves were still in Mr. Bucher's name and not occupied. The only grave that will be available to sell is Grave 1, Lot 6610. You mentioned in your letter Grave 2, Lot 6311 is for Mr & Mrs Torres. To expedite your ability to close this estate ... We can purchase this grave from the estate for $500.00 less the title fee of $75.00. This will NET you $425.00 for this grave. No other deductions for selling will be made. For decedents dying on or after July 1, 1994, if a surviving spouse exercised or intends to exercise a right of withdrawal within 9 months of the decedent's death, check the appropriate block and attach a copy of the document in which the surviving spouse exercises such withdrawal right. ; [] Unlimited right of withdrawal [] Limited right of withdrawal III. Explanation of Compromise Offer: Taxable residue before spouse's exercise of limited right of withdrawal equals $17,081. Spouse exercised right of withdrawal within nine months of date of death of $10,000 (copy of check attached). This leaves a life estate principal of $7,08 I. Given small amount of principal (even adding nontaxable life insurance proceeds of $9,750) maximum anticipated income per year is less than $600. Surviving spouse's other income is only $9,780.00 and her age and cost of living and medical care (estimated at $12,206.00) will likely result in a total consumption of the principal in less than three years. Therefore, it is suggested that all entire principal balance is taxable at the spousal rate. IV. Summary of Compromise Offer: 1. Amount of Future Interest: 2.
