HOFFMAN'S CUSTOM CONTRACTING, INC Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA 69-558(o MAD This instrument is executed this 28th day of July, 2009, by Hoffman's Custom Contracting, Inc., a Pennsylvania corporation ("Contractor") in favor of Samuel C. Brenize and Carlene M. Brenize, husband and wife ("Owners"). Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for the erection of improvements situate in West Pennsboro Township, Cumberland County, Pennsylvania, being known as 330 Wagners Lane, Newville, PA 17241, more fully described as follows: ALL THAT CERTAIN tract of land situate in West Pennsboro Township, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at an iron pin set in Township Road 434 (Green Hill Road) at corners common with lands now or formerly of Melvin Z. Leid and Ada H. Leid; thence along and in said Township Road 434, North 03 degrees 14 minutes 41 seconds East a distance of 377.95 feet to an iron pin in same; thence along same, North 00 degrees 19 minutes 02 seconds West a distance of 123.04 feet to an iron pin; thence in same on an arc chord bearing North 21 degrees 09 minutes 13 seconds West on a radius of 300.00 feet a chord length of 153.84 feet to an iron pin; thence in same, North 30 degrees 01 minutes 48 seconds West a distance of 375.73 feet to an iron pin at the intersection of Township Road 435 (Wagners Lane) and Township Road 434; thence along said Township Road 435, North 59 degrees 19 minutes 13 seconds East a distance of 593.19 feet to an iron pin in same; thence North 59 degrees 33 minutes 21 seconds East a distance of 279.87 feet to an iron pin in same; thence along Lot No. 2 of the hereinafter referenced Subdivision Plan, South 37 degrees 28 minutes 16 seconds East a distance of 993.64 feet to an iron pin at corners common with Lot No. 4 of the hereinafter referenced Subdivision Plan; thence along said Lot No. 4, South 49 degrees 06 minutes 55 seconds West a distance of 714.94 feet to an iron pin; thence along same, South 25 degrees 37 minutes 15 seconds West a distance of 274.37 feet to an iron pin; thence along lands now or formerly of Melvin Z. Leid and Ada H. Leid, South 80 degrees 06 minutes 19 seconds West a distance of 495.58 feet to an iron pin set in Township Road 434, being the place of BEGINNING. BEING all of Lot No. 1 of the Final Subdivision Plan for Sally Wagner, dated October 5, 2006, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 94, Page 11. 1 BEING THE SAME PREMISES which Sally A. Wagner, widow, by Deed dated February 27, 2009, and recorded March 5, 2009, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, at Instrument No. 200906393, granted and conveyed unto Samuel C. Brenize and Carlene M. Brenize, husband and wife. Now, July 28, 2009, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building or land referenced herein by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
