AND NOW TO WIT, this COMPLAINT day of June, 2009, comes the Plaintiff, Besam Entrance Solutions, by and though it attorneys, GRIFFITH, STRICKLER, LERMAN, SOLYMOS & CALKINS, and Charles B. Calkins, Esquire, and files this Complaint and avers the following: 1. The Plaintiff, Besam Entrance Solutions, is a duly registered North Carolina company with a principal business address at 1900 Airport Road, Monroe, NC 28110. 2. The Defendant, Barrett Contracting, Inc., is a duly registered Pennsylvania corporation, whose business address is 429 South Eighteenth Street, Camp Hill, PA 17011. 3. Defendant retained the services of Plaintiff to furnish and install doors at the Hampton Inn located in West Haven, Connecticut, and the Hilton Garden Inn located in Dover, Delaware. 4. Plaintiff furnished and installed automatic doors as requested by the Defendant. 5. The prices charged for the furnishing and installation of automatic doors was fair and reasonable and the market prices were the same at the time the products and services were rendered to the Defendant and further, to what the Defendant agreed to pay. 6. Defendant agreed to pay Plaintiff $22,793.00 for the furnishing and installation of the automatic doors. 7. As of November 19, 2008, $9,250.00 remained due and owing to Plaintiff. A true and correct copy of a statement dated November 19, 2008 is attached hereto, marked Exhibit "A", and incorporated herein by reference. 8. The amount of $9,250.00 was then, and remains now, due and owing to the Plaintiff. 9. Plaintiff has demanded payment of the $9,250.00 from the Defendant, but Defendant has refused and continues to refuse to pay the same or any part thereof. WHEREFORE, Plaintiff, Besam Entrance Solutions, demands judgment against the Defendant, Barrett Contracting, Inc. in the amount of $9,250.00, together with interest plus costs of suit.
