"55 3 MUNICIPAL LIEN MUNICIPAL LIEN MUNICIPAL LIEN FOR SERVICES AND SEWER RATES AND NOW, comes Monroe Township Municipal Authority, of 1220 Boiling Springs Road, Mechanicsburg, Pennsylvania, by and through its Solicitor, Jennifer B. Hipp, Esquire and files the following municipal claim against Ammon L. Hochstetler and Billie Jane Hochstetler, husband and wife, adult individuals, owning property located at 311 Old Stone House Road South, Boiling Springs, Monroe Township, Cumberland County, Pennsylvania, 17007, their last known mailing address being: 311 Old Stone House Road South, Boiling Springs, Monroe Township, Cumberland County, Pennsylvania 17007. Ammon Hochstetler and Billie Jane Hochstetler are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN tract of land situate in the Village of Churchtown, Monroe Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point in the center of the public road leading from the Village of Churchtown to the Lisburn Road, at corner of lands now or formerly of Jennie E. Strickler; thence eastwardly along said other lands now or formerly of Jennie E. Strickler, a distance of 181 feet 3 inches to an iron pin in line of lands now or formerly of George Souder; thence along lands now or formerly of George Souder, North 4 3/4 degrees West, 61 feet to a point (iron pin) in line of lands now or formerly of Emma Engle; thence along lands now or formerly of Emma Engle, South 81 degrees East 208.1 feet to a point in the center of the said public road; thence along the center of said public road, South 19 degrees East 33.75 feet to a point; thence still along the center of said public road, South 24 degrees, West 39.65 feet to a point, the place of BEGINNING. CONTAINING approximately .0299 acre. BEING KNOWN AND NUMBERED as 311 Old Stone House Road South, Boiling Springs, Pennsylvania. BEING THE SAME PREMISES which Glenn Eliot Dalmas and Virginia Anne Blue, husband and wife, by their deed dated November 30, 1999, and recorded December 2, 1999, in the Cumberland County Recorder of Deeds Office in Deed Book 212, Page 466, granted and conveyed unto Ammon L. Hochstetler and Billie Jane Hochstetler, husband and wife, owners. Tax Parcel No. 22-28-2401-038 Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from April 1, 2008 through and including June 30, 2009. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02-04, same being known as a Resolution of the Board of Monroe Township Municipal Authority imposing user charges to be collected from the owner of each improved property served or to be served by this Authority's sewer systems; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the -2- statements forwarded by Monroe Township Municipal Authority to Ammon L. Hochstetler and Billie Jane Hochstetler for sewerage due to be treated from April 1, 2008 through June 30, 2009, which services total is in the amount of $1,027.15, which sum was duly assessed against Ammon L. Hochstetler and Billie Jane Hochstetler, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10%) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above-described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). Boiling Springs, PA 17007 Dear Mr. Hochstetler: I am contacting you on behalf of Monroe Township relative to your sewer account #1023. This account is delinquent. As of the last billing notice, same being dated May 15, 2009, the delinquency is in the amount of $1,027.15. The purpose of this letter is to request that this account be brought current. If the account is not brought current within thirty (30) days of receipt of this letter, a Municipal Lien will be placed against real estate owned by you, same being known and numbered as 311 Old Stone House Road S., Boiling Springs, PA. This will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed. Attorney's fees will be charged at the current rate. Attorney's fees will be imposed and/or assessed if this amount remains delinquent after thirty (30) days from the mailing of this notice. The imposition of assessment of attorney's fees may be avoided by you making payment in full of the delinquency within thirty (30) days of receipt of this letter as set forth herein.
