ATAR, Owners MUNICIPAL LIEN MUNICIPAL LIEN FOR SERVICES AND SEWER RATES AND NOW, comes Monroe Township Municipal Authority, of 1220 Boiling Springs Road, Mechanicsburg, Pennsylvania, by and through its Solicitor, Jennifer B. Hipp, Esquire and files the following municipal claim against MEHDI T. ATAR and JODI L. ATAR, husband and wife, adult individuals, owning property located at 1359 Swope Drive, Boiling Springs, Monroe Township, Cumberland County, Pennsylvania, 17007, their last known mailing address being: 2260 Waggoners Gap Road, Carlisle, Monroe Township, Cumberland County, Pennsylvania 17013. MEHDI T. ATAR and JODI L. ATAR are the owners of all that certain lot of ground, including any improvements thereon, being more-fully described as follows: ALL THAT CERTAIN lot of ground situated in Monroe Township, Cumberland County, Pennsylvania, and being Lot No. 34 on the Plan of Lots of Section "A" of White Rock Acres dated October 9, 1968, and recorded in the office of the Recorder of Deeds in Cumberland County on October 30, 1968, in Plan Book 20, at Page 40, and more fully described as follows: BEGINNING at a point on the southern line of Swope Drive (40 feet wide) at the dividing line between Lots Nos. 33 and 34 on said plan; thence by the western line of Lot No. 33, South 16 degrees 50 minutes East 249.65 feet to a point; e ' thence by other lands now or formerly of Penn Products Corporation, South 69 degrees 15 minutes West 134.35 feet to a point; thence by the same, North 41 degrees 02 minutes West 236.08 feet to a point on the southern line of Swope Drive; thence by the southern line of Swope Drive the following three courses and distances: (1) North 48 degrees 58 minutes East 100.74 feet; (2) By a curve to the right having a radius of 25 feet the arc distance of 10.56 feet, the chord length of 10.48 feet and the chord bearing of North 61 degrees 04 minutes East to a point; (3) North 73 degrees 10 minutes East a distance of 128.68 feet to the place of Beginning. UNDER AND SUBJECT to the building lines, covenants, restrictions, and reservations as recorded with said Plan of Lots. EXCEPTING AND RESERVING unto Penn Products Corporation, its successors and assigns, all minerals, clays and sand beneath the surface of the ground. BEING THE SAME PREMISES which William J. August, married man, by his deed dated May 31, 2001, and recorded June 4, 2001, in the Cumberland County Recorder of Deeds Office in Deed Book 246, Page 56, granted and conveyed unto Mehdi T. Atar and Jodi L. Atar, his wife, owners. Tax Parcel No. 22-33-0041-033 Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from April 1, 2008 through and including June 30, 2009. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02-04, same being known as a Resolution of the Board of Monroe Township Municipal Authority imposing user charges to be collected from the owner of each improved property served or to be served by this Authority's -2- sewer systems; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to Mehdi T. Atar and Jodi L. Atar for sewerage due to be treated from April 1, 2008 through June 30, 2009, which services total is in the amount of $1,182.50, which sum was duly assessed against Mehdi T. Atar and Jodi L. Atar, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10%) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above- described real property and premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). Atar 2260 Waggoners Gap Road Carlisle, PA 17013 Dear Mr. Atar: I am contacting you on behalf of Monroe Township relative to your sewer account #422. This account is delinquent. As of the last billing notice, same being dated May 15, 2009, the delinquency is in the amount of $1,182.50. The purpose of this letter is to request that this account be brought current. If the account is not brought current within thirty (30) days of receipt of this letter, a Municipal Lien will be placed against real estate owned by you, same being known and numbered as 1359 Swope Drive, Boiling Springs, PA. This will result in filing fees, service costs, and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed. Attorney's fees will be charged at the current rate. Attorney's fees will be imposed and/or assessed if this amount remains delinquent after thirty (30) days from the mailing of this notice. The imposition of assessment of attorney's fees may be avoided by you making payment in full of the delinquency within thirty (30) days of receipt of this letter as set forth herein.
