AND NOW, this M day of August, 2009, this matter having been called for a
hearing, the Court finds, upon clear and convincing evidence, that Wilbur R. Hubley is an
incapacitated person in that he suffers from a mental impairment that prevents him from
receiving and evaluating information effectively and prevents him from formulating and
communicating decisions to such a significant extent that he is unable to manage his
financial affairs or meet essential requirements for his physical health and safety on a
daily basis.
The Court orders that the existing Power of Attorney be revoked and that
Cumberland County Aging & Community Services, in and for Cumberland County,
Pennsylvania, be appointed as Permanent Plenary Guardians of the Person and Estate of
Wilbur R. Hubley.
Cumberland County Aging & Community Services is authorized to obtain
payment for its services pursuant to the Guardianship Fee Schedule that was attached to
the Petition filed in this matter; and
Cumberland County Aging & Community Services is also authorized to obtain
payment of a Guardian fee subject to a maximum. of 10% of Wilbur R. Hubley's gross
monthly income or $100.00 per month, whichever is less, at such time that Wilbur R.
Hubley no longer has sufficient assets to pay for Guardianship services and would qualify
for Medical Assistance.
Wilbur R. Hubley may petition the Court in the future for reconsideration if his
condition should improve.
