HomeMy WebLinkAbout07-30-09 (2)From: 717 B43 9039 07/13!2009 15:21 #136 P.002/004 IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA ORPHANS' COURT DIVISION [N RE: Estate of Annette Landen Deceased, Late of ~ No. 21-08-0839 Lower Allen Township ~ '~'' , Cumberland County, PA ~ c~ n `Q t '~~ r-- FAMILY SETTLEMENT AGREEMENT 4 c`~rc': c~~c~7 ~ n~ 1l THIS AGREEMENT, made as of this / ~ ~~ d J ~ ~ ~ rv ay of , ~ w _ 2009, by and among Ted Trout-Landen, as Executor and Hal M L ' te _ - ' - , . anden an d T e d T r out- Landen, as beneficiaries; and WHEREAS, Annette Landen, late of Lower Allen Township, Cumberland County, Pennsylvania, died June 26, 2008, testate, leaving a Last Will and Testament dated January ] 1, 1990, which was duly probated in the Office of the Register of Wills in and for Cumberland County, Pennsylvania, on August 14, 2008, and appears ofrecord to File No. 21-08-0839; and WHEREAS, Letters Testamentary were issued thereon on August 14, 2008, to Ted Trout-Landen; and WHEREAS, a Pennsylvania Inheritance Tax Return was Sled with the Register of Wills Office, as Agent for the Commonwealth of Pennsylvania, on behalf of the Estate of Annette Landen; and WHEREAS, the Pennsylvania inheritance tax due on said estate has been paid in full and clearance has been received; and WHEREAS, all known outstanding debts and obligations of the Decedent have been paid in full; and WHEREAS, the parties hereto, aze the remaining parties in interest in the Estate of Annette Landen, desire that distribution of the balance of the assets of the Decedent be f~nmvp ~,;_ ~~ .~ c ~, ?~..~ _=~ ~' r^~ ,l _; ~:~ From: 777 843 9039 07/13/2009 15:22 #138 P.003/004 made without the necessity of further proceedings by the Orphans' Court or a formal accounting, NOW, THEREFORE, in consideration of the payment and distribution of their share of the Estate available for distribution as set forth in the Will attached hereto, the undersigned beneficiaries under the Last Will and Testament of Annette Lander, late of Lower Allen Township, Cumberland County, Pennsylvania, deceased, do hereby acknowledge that they have received of and from Ted Trout-Lander, Executor of the Estate of Annette Lander, deceased, [Heir share of the Estate. The same being in full satisfaction of their share of the Estate as provided in the Last Will and Testament of said Decedent. The undersigned do hereby by these presents, remise, release, quit-claim and forever discharge the said Ted Trout-Lander, Executor, his heirs and assigns, of and from the payment of any other or further sum in satisfaction and payment of their share of the Estate of the said Decedent, and of and from all actions, suits, claims, duties and demands whatsoever arising therefrom. The undersigned further agree to indemnify the said Ted Trout-Lander, Executor, and to hold him harmless from any claims or demands presented against the Estate of the said Decedent subsequent to the execution of this Release, including, but not limited to, any federal, state or local income taxes, transfer inheritance, ___ estate or death taxes, together with any interest or penalties thereon and together with any costs, expenses and counsel fees associated therewith, if any, In consideration of the distribution of their share of the Estate to them, the undersigned agree that they shall be firnily bound unto Ted Trout-Lander, Executor, of the Estate of Annette Lander and/or to CGA Law Firm, Attorneys for the Estate of Annette Lander, in their proportionate share of the amount of any claims or demands presented against the Estate as set forth above, up to but not exceeding the amount of ~wnn,nn2 From:717 843 9039 07/13/2D09 15:22 #138 P.004/004 their share of said Estate, which agreement shall be deemed to be in the nature of a refunding agreement or bond.
