THIS AGREEMENT made the 17~' day of May, 2004, by and between M. Jeffrey Strickland,
single man, hereinafter referred to as Contractor, and Strickland Brothers Construction LLC, a
Pennsylvania limited liability company, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a custom built home on that certain lot of ground situate
at Lot 28 Prickly Pear Drive, Carlisle, North Middleton Township, Cumberland County,
Pennsylvania, known as more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

Matthew G. Strickland, Member of Strickland Brothers Construction LLC, Owner, known to me or
satisfactorily proven to be the person whose name is subscribed to the within instrument, and who
acknowledged that he executed the same with the authority to bind the limited liability company and
for the purposes therein contained.

Strickland, known to me to be the person whose name is subscribed, and who acknowledges himself
to be a general partner of Strickland Brothers Construction, a Pennsylvania general partnership and
that he as such general partner, being authorized to do so, executed the foregoing statement for the
purpose therein contained and with the intent and authority to bind Strickland Brothers Construction,
a Pennsylvania general partnership.

ALL THAT CERTAIN unimproved tract of hind situate in North Middleton Township,
Cumberland County, Pennsylvania, being more fully bounded and described according to a Final
Subdivision Plan for Phase I of Hillcrest Farms West, prepared by R.J. Fisher& Associates, Inc.
being recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 86, Page 57, as follows:
BEGINNING at a point along the southern side ora 50.00 foot wide right-of-way known as
Prickly Pear Drive, along the dividing line between Lots Nos. 27 and 28 of the hereinafter
mentioned subdivision plan; thence continuing along same, North 76 degrees 02 minutes 45
seconds West, a distance of 229.76 feet to a point; thence continuing along the dividing line
between Lots Nos. 28 and 29 of the hereinafter mentioned subdivision plan, South 11 degrees 15
minutes 12 seconds West, a distance of218,47 feet to a point on the southern side of Prickly Pear
Drive; thence along same by a curve to the left, having a radius of 235.00 feet, an arc length of
337.85 feet on a chord bearing of North 59 degrees 07 minutes 01 second East, and a chord
length of 309.50 feet to a point, the place of BEGINNING.
CONTAINING 0.86 acres and being Lot No. 42 of the Final Subdivision Plan for Phase I of
Hillcrest Farms West, prepared by R. J. Fisher & Associates, Inc., being recorded in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 86, Page 57.
