PETITION FOR INSTRI~TION OF SERVICE
1. The Petitioner, Kimberly Sue Ocker, is an adult individual residing at 730 Mountain
Road, Newville, Pennsylvania 17241.
2. The Respondent, William Herbert Ocker, is an adult individual with a residence
located at 730 Mountain Road, Newville, Pennsylvania 17241, but who is currently hospitalized.
3. Kimberly Sue Ocker is the wife ofthe Respondent William Herbert Ocker, theparties
having been married on May 3, 1986.
4. The names and addresses ofthe next ofkin ofthe Respondent William Herbert Ocker
are as follows:
a. Kimberly Sue Ocker, wife
730 Mountain Road
Newville, PA 17241
b. Zachary Ocker, son
730 Mountain Road
Newville, PA 17241
5• William H. Ocker was injured in a truck accident on June 22, 2009. As a result of
injuries sustained in that crash, William H. Ocker is in a coma and his ability to receive and evaluate
information effectively and communicate decisions in any way is severely impaired.
6• A hearing on the matter of Kimberly S. Ocker's Petition for Guardianship of William
H. Ocker shall beheld before the Honorable Kevin A. Hess, in Courtroom No. 4 of the Cumberland
County Courthouse in Carlisle, Cumberland County, Pennsylvania, on Friday, September 11, 2009,
at 11:00 a.m.
7• William H. Ocker must receive at least twenty (20) days notice of the hearing to be
held on the matter of Kimberly S. Ocker's Petition for Guardianship of William H. Ocker.
8. Pursuant to Pa. O.C. Rule 5.2, "Whenever notice is to be given a person who is not
sui juris...if there is no...guazdian or trustee, notice shall be given in such manner as the court by
general rule or special order shall direct."
9• Kimberly S. Ocker acknowledges that William H. Ocker is in a coma and severely
impaired, and requests that the Court direct a method of service or instruction of how to serve
William H. Ocker with due notice of the hearing.
10. Kimberly S. Ocker specifically requests direction from the Court as to whether
William H. Ocker must be served via Sheriff s service or whether the required notice may be made
upon Kimberly Ocker, his wife and next of kin, and whether it can be made by a competent adult or
the Sheriff:
11. There has been no previous guazdian appointed for William H. Ocker.
WHEREFORE, the Petitioner Kimber]y S. Ocker requests that the Court direct a method of
service or instruction of how to serve William H. Ocker with notice of the hearing on the matter of
Kimberly S. Ocker's Petition for Guazdianship of William H. Ocker.
