STIPULATION AGAINST LIENS
WHEREAS, James F. Peiffer and Debra K. Peiffer, husband and wife, of
Pennsylvania, is about to execute contemporaneously herewith, a contract with Kent R. Donaldson
of Dauphin County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as
follows:
ALL THAT CERTAIN tract of Mountain land with the improvements thereon in
the Township of Monroe, County of Cumberland and Commonwealth of Pennsylvania, bounded and
described in accordance with survey by Michael C. D.'Angelo, P.S. dated November 21, 1985, as
follows, to wit:
BEGINNING at a pin on the property line of lands formerly of Brenda J. Graham
Shettel et al, now of Roselma E. Smith, which said pin is North 20° 17'04" West 200.1 feet along
said property line from a point on the northern line of Caboose Lane; thence along said lands now
or formerly of Roselma E. Smith North 20° 17'04" West 405.71 feet to a stone pile; thence by lands
now or formerly of Russell R. Gutshall, North 66° 01'23" East 338.50 feet to a stone pile; thence
by lands now or formerly of Harry Sheaffer Criswell et al, South 25° 15' 55" East 413.37 feet to a
pin; thence along lands formerly of Edgar A. Dilks and Belle E. Dilks, his wife, South 67° 18'29"
West 373.86 feet to a pin at the point and place of BEGINNING.
BEING Tract # 2 Residual containing 3.34 acres shown on Plan of Estate of Verna
L. Gensler recorded in Right-of-Way Plan Book 8, Page 45 in the Recorder of Deeds Office in and
for Cumberland County, Pennsylvania.
TOGETHER with all the right, title and interest of the GRANTOR herein in and to
a thirty (30) foot wide right-of-way in favor of the GRANTOR, her heirs and assigns, along Tract
No. 1 and Tract No. 2 of other lands formerly owned by Grantor, a distance of two hundred thirty-
four and three hundredths (234.03) feet extending Northwardly from Caboose Lane, as set forth in
a Deed from Roselma E. Smith, also known as Roselma Earlene Smith unto Susan Mac Donald,
married woman, dated January 10, 2008 and recorded in the Office of the Recorder of Deeds in and
for Cumberland County, Pennsylvania in Instrument No.: 200801402.
UNDER AND SUBJECT to a fifteen foot right-of-way in favor of the said C. Lynn
Shenk and Evelyn W. Shenk, his wife, their heirs and assigns, as set forth in Deed from David H.
Smith and Esther L. Smith, his wife, dated April 18, 1967 and recorded in the Recorder's Office
aforesaid in Deed Book "N", Volume 22, Page 859.
BEING THE SAME premises which Roselma E. Smith, a single woman, by her
deed dated July 8, 2008 and recorded July 8, 2008 in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania in Instrument No.: 200823141, granted and conveyed unto James
F. Peiffer and Debra K. Peiffer, husband and wife.
NOW, the ?\ -day of August, 2009, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said James F.
Peiffer and Debra K. Peiffer, husband and wife to the said Kent R. Donaldson to commence work
on the said building, or purchase materials for the same in consideration of the making of the said
contract with Kent R. Donaldson and the further consideration of One Dollar, to Kent R. Donaldson
paid by James F. Peiffer and Debra K. Peiffer, husband and wife it is agreed that no lien shall be filed
against the building by the contractor, or any sub-contractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
