Smith Plumbing, Heating & Cooling, Inc. (Plaintiff), files this Mechanics' Lien claim against Insite Development, LLC, Defendant and Owner (Defendant), and against the building and real estate hereinafter more particularly described, for payment of a debt due Plaintiff for plumbing work and materials regarding the erection and construction of a four story Comfort Suites motel on the within described real estate owned by Defendant, and makes the following statement of claim pursuant to the Mechanics' Lien Law, 49 P.S. §1501, et seq.: FIRST Plaintiff herein is Rodney B. Smith Plumbing, Heating & Cooling, Inc., a WILLIAM C. CRAMER ATTORNEY AT LAW CNAMBERSBURG. PA 17201 (717) 264-3711 Pennsylvania corporation in good standing, having an address and principal place of business situate at 940 Hollywell Avenue, Chambersburg, Franklin County, Pennsylvania 17201. SECOND Plaintiff files this claim as a contractor under the relevant provisions of the Mechanics' Lien Law of the Commonwealth of Pennsylvania, as provided in 49 P.S. § 1501, et seq. THIRD The name and address of the Defendant/Owner of the property subject to this claim is Insite Development, LLC, having a principal place of business and address at 2055 Technology Parkway, Mechanicsburg, Cumberland County, Pennsylvania 17050. Defendant so advised Plaintiff of this address, in writing, in correspondence directed to Plaintiff on Exhibit A, attached hereto, and incorporated herein. FOURTH The real estate and the new construction erected thereupon to which this claim WILLIAM C. CRAMER ATTORNEY AT LAW CHAMBERSBURG, PA 17201 (717) 264-3711 applies has a commonly known address of 2055 Technology Parkway, Mechanicsburg, Cumberland County, Pennsylvania 17050, and consists of a newly constructed four story "Comfort Suites" motel erected upon that property. Defendant's website description, address, and a photograph of the property subject to this claim is attached hereto, labeled Exhibit B-1, and incorporated herein. A detailed description of the subject real estate is set forth in the deeds of conveyance to Defendant, true and correct copies of which are attached hereto, labeled Exhibit B-2 and Exhibit B-3, and incorporated herein by reference thereto. FIFTH Work on the Comfort Suites motel constructed on the real estate subject to this claim is believed to have commenced on or about April 28, 2008. SIXTH Plaintiff completed work on the property subject to this claim on or about June 16, 2009. SEVENTH Plaintiff and Defendant entered into a written agreement, the essence of which is that Plaintiff would, as contractor, perform all of the plumbing work, including supplying certain specifically described plumbing fixtures, pipes, etc., for the construction of a new four-story Comfort Suites motel situate upon the real estate owned by Defendant and more particularly described in the attached Exhibits B-1 through B-3. In reference to this agreement, Plaintiff further avers the following: A. The initial proposal submitted by Plaintiff to Defendant with respect to this project is dated 3/26/08, and a true and correct copy of same is labeled Exhibit C, attached hereto, and incorporated herein. B. A true and correct copy of an AIA contract executed by and between WILLIAM C. CRAMER ATTORNEY AT L.AW CHAMBERSBURG. PA 17201 Plaintiff and Defendant on 3/26/08 regarding this construction project is labeled Exhibit D, attached hereto, and incorporated herein. The AIA contract price ($487,595.00) is slightly more than Plaintiff's initial proposal ($486,000.00) because of certain additions (717) 264-3711 I selected by Defendant and added to the AIA contract (these additions are options set forth in the proposal, Exhibit C). C. True and correct copies of eleven change orders requested by Defendant and work performed in accordance thereto by Plaintiff are attached hereto, labeled Exhibit E-1 through E-11, and incorporated herein. Collectively, Exhibits C, D, and E-1 through E-11 comprise the agreement by and between Plaintiff and Defendant regarding the plumbing work for construction of the Comfort Suites motel on the Defendant's property. EIGHTH Plaintiff has performed all of the work required of Plaintiff pursuant to all of the contract documents, including the additional work requested and approved in the change orders (Exhibits E-1 to E-11), and Defendant has accepted, without reservation, all the work performed by Plaintiff. NINTH Defendant has partially paid Plaintiff for all work performed and materials supplied, but Plaintiff is now owed the balance of Two Hundred Thousand Three Hundred Fifty-five and 64/100 ($200,355.64) Dollars as of July 31, 2009, with interest accruing thereafter as per the contract terms and/or the law. A true and correct copy of Plaintiffs statement to Defendant regarding this debt, and the account history, is WILLIAM C. CRAMER 11 labeled Exhibit F, attached hereto, and incorporated herein. ATTORNEY AT LAW CHAMBERSBURG. PA T7201 (717) 264-3711 TENTH Plaintiff has made demand upon Defendant to pay the balance due and owing Plaintiff, but Defendant has refused, and continues to refuse, to pay the sums due and owing to Plaintiff. ELEVENTH All of the work and materials provided by Plaintiff to Defendant constitutes, in all respects, the plumbing work regarding the original erection and construction of a four story Comfort Suites motel (see, Exhibit B-1) on the aforesaid property owned by Defendant, all according to the attached contract documents by and between the parties. WHEREFORE, it is respectfully requested that the Court enter a mechanics' lien among the records of Cumberland County to evidence Plaintiff's said claim and lien against the said real estate.
