1. Plaintiffs are R. Scott George and Catherine J. George, adult individuals who
currently reside at 316 Indian Creed Drive, Mechanicsburg, Cumberland County, Pennsylvania
17050.
2. Defendant is Christina L. Nieves, an adult individual who is currently incarcerated at
York County Prison, 3400 Concord Road, York, York County, 17402.
3. Defendant is Angel L. Nieves, Jr., an adult individual who is currently incarcerated at
SCI Graterford, P.O. Box 244, Graterford, Pennsylvania 19426-0246.
4. Plaintiffs seek sole legal custody and primary physical custody of the following
children:

The children are presently in the custody of Plaintiffs who reside at 316 Indian Creek Drive,
Mechanicsburg, Cumberland County, Pennsylvania 17050 and has been since July 14, 2008.
5. During the past five years, the children have resided with the following persons and at

6. The mother of the subject minor child is Christina L. Nieves, who is currently
incarcerated at York County Prison, 3400 Concord Road, York, York County, Pennsylvania 17042.
She is married to Defendant Angel R. Nieves, Jr.
7. The father of the subject minor child is Angel R. Nieves, Jr., who is currently
incarcerated at SCI Graterford, P.O. Box 244, Graterford, Pennsylvania 19426-0246. He is married
to Defendant Christina L. Nieves.
8. Plaintiffs are the maternal aunt and uncle to the subject minor children. They reside at
316 Indian Creek Drive, Mechanicsburg, Cumberland County, Pennsylvania 17050. The Plaintiffs
reside with the following individuals:
Joseph Babner - Catherine's son (15 years old)
Sarah Babner - Catherine's son (15 years old)
Chelsea George - R. Scott's daughter (16 years old)
Joshua George - R. Scott's son (10 years old)
Benjamin George - R. Scott's son (7 years old)
9. The relationship of Defendant Angel R. Nieves, Jr. to the subject minor children is
that of Father. He has not had any type of contact with the children since his incarceration in
November 2006. He is incarcerated.
10. The relationship of Defendant Christina L. Nieves to the subject minor children is that
of Mother. She has not had any significant contact with the children since her incarceration in July
2008, although, Plaintiff Catherine J. George did transport the subject minor children to visit with
her while she was in prison. Ms. Nieves is scheduled to be released from prison on Thursday,
August 20, 2009.
11. Plaintiffs have not participated as a party or witness. or in another capacity, in other
litigation concerning the custody of the subject minor children in this or another court.
Plaintiffs have no information of a custody proceeding concerning the subject minor
children pending in a court of this Commonwealth.
Plaintiffs do not know of a person not a party to the proceedings that have physical
custody of the subject minor children or claims to have custody or visitation rights with respect to the
subject minor children.
12. The best interest and permanent welfare of the subject minor children will be served
by granting the relief requested because:
A. Since July 14, 2008, the two subject minor children have resided with the Petitioners,
as both their parents were incarcerated. The Respondents have been incarcerated on numerous other
occasions during the lives of these children for driving under the influence (both), parole violations
(Mr. Nieves), drug and alcohol charges (both), assault (Mr. Nieves), and Protection From Abuse
violations (Mr. Nieves). Whenever both parents are incarcerated, the minor children reside with the
Petitioners. Ms. Nieves has been diagnosed with several mental health disorders, among them, bi-
polar disorder and borderline personality disorder. She will not take her prescribed medications and
refuses to participate in counseling sessions when she is not incarcerated. When the subject minor
children are in Ms. Nieves care and custody, they miss school (over forty days in one year), do not
receive appropriate health and/or medical care, and are subjected to persons of ill character and
morals. Petitioner Catherine J. George learned that Respondent Christina L. Nieves is scheduled to
be released from the York County Prison on or about Thursday, August 20, 2009. Around the time
Petitioner Catherine J. George learned of Ms. Nieves release from prison, she intercepted a letter
from Ms. Nieves, which indicated that Ms. Nieves was planning to relocate herself and the children
to Virginia so she could start a "new" life with a federal prison inmate, Anthony Sutherly. This
individual, Respondent Catherine J. George learned, has been incarcerated for credit card fraud,
credit card theft, violation of Protection From Abuse against his wife, and assault. Petitioners are
fearful that when Ms. Nieves leaves prison, she will immediately travel to their home and remove the
subject minor children from their care and custody and relocate with them to Virginia.
B. Plaintiffs have provided a nurturing, loving and stable home environment for
the children and should not be removed from Plaintiffs' care.
C. And other reasons which may fully appear at conference.
13. Each parent whose parental rights to the children, which have not been terminated,
and the persons who have physical custody of the children, have been named as parties to this action.
There are no other persons who are known to have a claim or right to custody or visitation in this
matter.
WHEREFORE, Plaintiffs, R. Scott George and Catherine J. George, request this Honorable
Court grant them sole legal custody and primary physical custody of the children, Blair M. Nieves,
and Alexander S. Nieves, subject to periods of supervised visitation with Defendant Christina L.
Nieves.

PETITION FOR EMERGENCY RELIEF
AND NOW, come the Plaintiffs, R. Scott George and Catherine J. George, by and through
their attorney, Cara A. Boyanowski, Esquire, and aver as follows:
1. Petitioners are R. Scott George and Catherine J. George, husband and wife, the
Plaintiffs in the above captioned custody action are adult individuals who currently reside at 316
Indian Creek Drive, Mechanicsburg, Cumberland County, Pennsylvania 17050. They are the
maternal aunt and uncle of the subject minor children.
2. Respondent, Christina L. Nieves, the Defendant in the above captioned custody action
is an adult individual who is currently incarcerated at the York County Prison, 3400 Concord Road,
York, York County, Pennsylvania 17402. She is the biological mother of the subject minor children.
She is not represented by counsel at this time. A copy of the prison roster is attached hereto as
Exhibit "A."
3. Respondent, Angel R. Nieves, Jr., the Defendant in the above captioned custody
action, is an adult individual who is currently incarcerated at SCI Graterford, P.O. Box 244,
Graterford, Pennsylvania 19426-0246. He is the biological father of the subject minor children. He
is not represented by counsel at this time. A copy of the PA Inmate Locator web is attached hereto as
Exhibit "B."
4. Simultaneous with the filing of this Petition for Emergency Relief, Petitioners are
filing a Complaint in Custody, requesting sole legal custody and primary physical custody of the two
subject minor children, Blair M. Nieves, born March 22, 1999, and Alexander S. Nieves, born
February 21, 2002.
5. Since July 14, 2008, the two subject minor children have resided with the Petitioners,
as both their parents were incarcerated. The Respondents have been incarcerated on numerous other
occasions during the lives of these children for driving under the influence (both), parole violations

intercepted a letter from Ms. Nieves, which indicated that Ms. Nieves was planning to relocate

9. Petitioners are fearful that when Ms. Nieves leaves prison, she will immediately travel
to their home and remove the subject minor children from their care and custody and relocate with
them to Virginia.
10. Both children are enrolled to begin classes at Sporting Hill Elementary this Fall. Blair
will begin Fifth Grade and Alexander will begin Second Grade.
11. Petitioners have also registered both children to play football this year.
12. The children are happy and thriving in the Petitioners' home.
13. Rule 1915.14 of the Pennsylvania Rules of Civil Procedure, permit "at any time after
commencement of the action, the court may on application or its own motion grant appropriate
interim or special relief. The relief may include but is not limited to the award of temporary custody,
partial custody or visitation; the issuance of appropriate process directing that a child or a party or
person having physical custody of a child be brought before the court; and a direction that a person
post security to appear with the child when directed by the court or to comply with any order of the
court."
14. Petitioners seek from this Honorable Court, the granting of a temporary award of sole
legal and physical custody of the subject minor children, Blair M. Nieves, born March 22, 1999, and
Alexander S. Nieves, born February 21, 2002, pending the parties participation in a custody
conciliation conference.
WHEREFORE, Petitioners, R. Scott George and Catherine J. George, request special relief
from this Honorable Court, granting them temporary sole legal physical custody over the minor
children, Blair M. Nieves born March 22, 1999, and Alexander S. Nieves, born February 21, 2002.

AND NOW, Monday, August 24, 2009 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Hubert X. Gilroy, Esq. the conciliator,
at 4th Floor, Cumberland Coun Courthouse, Carlisle on Thursday, October 01, 2009 at 8:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

Cara A. Boyanowski, Esquire, being duly sworn according to law, states the following:
I am the attorney for R. Scott George and Catherine J. George, the Plaintiffs in the
above-captioned child custody action.
2. Pursuant to my complaint in custody, the Court of Common Pleas of Cumberland
County appointed Hubert X. Gilroy, Esquire, as Custody Conciliation Officer, and scheduled a
custody conciliation conference for October 1, 2009.
3. On or about August 25, 2009, I forwarded a certified copy of the Order of Court
scheduling the custody conciliation conference, by certified mail, return receipt requested to both
Christina Nieves at the York County Prison and Angel Nieves, Jr. .at SCI Graterford prison.
4. On August 27, 2009, as evidenced by the signed Domestic Return Receipt cards,
both Christina Nieves and Angel Nieves, Jr., received a copy of the Order of Court scheduling
the October 1, 2009 custody conciliation conference before Hubert X. Gilroy, Esquire. True and
correct copies of the Domestic Return Receipts (PS Form 3811) are attached hereto as Exhibit
"A »
5. In addition to the Order of Court scheduling the October 1, 2009 custody
conciliation conference, on August 24, 2009, I forwarded a copy of the custody complaint, a copy
of the Petition for Emergency Relief, and a copy of the Order of Court, signed by the Honorable
Ebert on August 21, 2009, to Christina Nieves and Angel Nieves, Jr.
6. On August 26, 2009, as evidenced by the signed Domestic Return Receipt cards,
both Christina Nieves and Angel Nieves, Jr., received copies of the above named documents.
True and correct copies of the Domestic Return Receipts (PS Form 3811) are attached hereto as
Exhibit "B."

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following report:
1. The pertinent information pertaining to the children who are the subject of this
litigation is as follows:
Blair M. Nieves, born March 22, 1999, and Alexander S. Nieves, born February 21,
2002.
2. A Conciliation Conference was held on October 1, 2009, with the following
individuals in attendance:
The maternal aunt, Catherine J. George, with her husband, R. Scott George, and their
counsel, Cara A. Boyanowski, Esquire. The mother, Christina L. Nieves, attended
without counsel, and the father, Angel R. Nieves, Jr., did not appear. It is understood
that the father is in prison.
3. It was related to the Conciliator that the two minor children have been in the custody
of the Plaintiffs since July of 2008 while both Defendants have been incarcerated
since that time.
4. The mother agreed to the suggested temporary order with the understanding that she
could seek more detailed visitation or primary custody at a later date
5. The Conciliator recommends an Order in the form as attached.
