COMPLAINT IN DIVORCE UNDER
SECTION 3301(c) AND 3301(d) OF THE DIVORCE CODE
AND NOW COMES the above-named Plaintiff, James I. McAllister, by and through his
attorney, Cara A. Boyanowski, Esquire and the law firm of SERRATELLI, SCHIFFMAN,
BROWN & CALHOON, P.C., and seeks to obtain a Decree in Divorce from the above-named
Defendant, Kim E. McAllister, upon the grounds hereinafter more fully set forth:
DIVORCE
1. Plaintiff is James I. McAllister, an adult individual, who currently resides at 348
Huntington Avenue, Enola, Cumberland County, Pennsylvania 17025.
2. Defendant is Kim E. McAllister, an adult individual, who currently resides at 348
Huntington Avenue, Enola, Cumberland County, Pennsylvania 17025.
Plaintiff has been a bona fide resident in the Commonwealth for at least six
months immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on August 21, 1999 in Marysville,
Perry County, Pennsylvania.
5. The Plaintiff has been advised of the availability of counseling and that he may
have the right to request that the Court require the parties to participate in counseling. Having
been advised of such, Plaintiff has no desire to attend counseling sessions with Defendant.
6. There have been no prior actions of divorce or for annulment between the parties.
7. The Defendant is not a member of the Armed Services of the United States or any
of its allies.
8. The Plaintiff and Defendant are both citizens of the United States of America.
9. Plaintiff avers that there are no children born of this union.
10. The causes of action and sections of Divorce Code under which Plaintiff is
proceeding are:
A. Section 3301(c). The marriage of the parties is irretrievably broken.
After ninety (90) days have elapsed from the date of the filing of this Complaint,
Plaintiff intends to file an Affidavit consenting to a divorce. Plaintiff believes that
Defendant may also file such an Affidavit.
B. Section 3301(d). The marriage of the parties is irretrievably broken.
The Plaintiff and Defendant separated on August 1, 2009.
WHEREFORE, the Plaintiff prays your Honorable Court to enter a Decree in Divorce from
the bonds of matrimony.
I verify that the statements made in this Complaint are true and correct. I understand that
false statements herein are made subject to the penalties of 18 Pa.C.S.A. §4904 relating to unsworn
falsification to authorities.

AND NOW, comes the Defendant, Kim McAllister, by and through her attorneys, SMIGEL,
ANDERSON & SACKS, LLP, and files this Answer to Plaintiff's Complaint for Divorce Under
Section 3301(c) and Section 3301(d) of the Divorce Code and in support thereof avers as follows:
1. Admitted.
2. Admitted in part and denied in part. It is admitted that the Defendant is Kim E.
McAllister. It is denied that Defendant currently resides at 348 Huntington Avenue, Enola,
Cumberland County, Pennsylvania 17025. By way of further response, Defendant currently resides
at 594 Cassell Street, Marysville, Pennsylvania 17053.

this averment.

follows:

EQUITABLE DISTRIBUTION
11. Defendant repeats and realleges the averments of paragraphs 1 through 10 which are
incorporated by reference herein.
12. Plaintiff and Defendant possess various items of both real and personal marital
property which is subject to equitable distribution by this Court.
WHEREFORE, Defendant respectfully requests this Honorable Court equitably distribute
the marital property after an inventory and appraisement has been filed by the parties.
COUNT II
ALIMONY UNDER SECTION 3701 OF THE DIVORCE CODE
13. Defendant repeats and realleges the averments of paragraphs 1 through 12 which are
incorporated by reference herein.
14. Defendant requires support to adequately maintain her in accordance with the standard of
living established during the marriage.
WHEREFORE, Defendant respectfully requests this Honorable Court award her reasonable
alimony pursuant to Section 3701 of the Divorce Code.
COUNT III
ALIMONY PENDENTE LITE, COUNSEL FEES, COSTS AND
EXPENSES UNDER SECTION 3702
15. Defendant repeats and realleges the averments of paragraphs 1 through 14 which are
incorporated by reference herein.
16. Defendant does not have adequate means of support for herself during the course of this
litigation.
17. Defendant does not have sufficient funds to pay counsel fees, costs or expenses incidental
to this action.
18. Defendant has no health insurance other than that presently available to her through
Defendant's employment.
WHEREFORE, Defendant respectfully requests this Honorable Court award her alimony
pendente lite, counsel fees, costs and expenses.

1. Petitioner, Cara A. Boyanowski, Esquire, represented the Plaintiff, James I.
McAllister, in the above -captioned matter.
2. The Petitioner has not had any contact with Plaintiff for over one year nor any
response from Plaintiff to any correspondence sent to Plaintiff. Petitioner therefore considers it
Plaintiff's position that he no longer wishes to be represented by Petitioner.
3. Petitioner has informed Defendant's counsel, Deborah E. Crum, Esquire by letter
dated January 12, 2015 that she is no longer representing the Plaintiff.
4. There are currently no matters scheduled before this Court which would prevent
Plaintiff from being able to secure new counsel, if he so chooses.
