CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE
And now comes Farmers and Merchants Trust Company of Chambersburg, by its
attorneys, James, Smith, Dietterick & Connelly LLP, and files this Complaint in Mortgage
Foreclosure as follows:
1. The Plaintiff is Farmers and Merchants Trust Company of Chambersburg, which
has its principal place of business at P.O. Box 6010, Chambersburg, Pennsylvania 17201.
2. The Defendants, Gordon Holl a/k/a Gordon D. Holl and Amy Holl a/k/a Amy H.
Holl, are adult individuals whose last known address is 355 Hunters Road, Newville,
Pennsylvania 17241.
3. On or about June 1, 2000, Defendants executed a Note in favor of Plaintiff in the
original principal amount of $430,000.00. A true and correct copy of said Note is marked
Exhibit "A", attached hereto and made a part hereof.
4. On or about June 1, 2000, as security for payment of the aforesaid Note,
Defendants made, executed and delivered to Plaintiff a Mortgage in the original principal amount
of $430,000.00 on the premises hereinafter described, with said Mortgage being recorded in the
Office of the Recorder of Deeds of Cumberland County on June 5, 2000, in Mortgage Book
Volume 1616, Page 452. A true and correct copy of said Mortgage containing a description of
the premises subject to said Mortgage is marked Exhibit "B", attached hereto and made a part
hereof.
Defendants are the record and real owners of the aforesaid mortgaged premises.
6. Defendants are in default under the terms of the aforesaid Mortgage and Note for,
inter alia, failure to pay the monthly installments of principal and interest when due.
7. On or about July 8, 2009, Defendants were mailed combined Notices of
Homeowners' Emergency Mortgage Assistance Act of 1983 and Notices of Intention to
Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance Act,
Act 91 of 1983 and Act 6 of 1974, 41 P.S. §101, et seq.
8. The amount due and owing Plaintiff by Defendants is as follows:
Principal $ 400,341.93
Interest through 8/17/09 $ 21,703.60
Late Charges $ 3,408.79
Attorney's Fees $ 1,300.00
Title Costs $ 410.00
TOTAL $ 427,164.32
plus interest on the principal sum ($400,341.93) from August 17, 2009, at the rate of $36.14 per
diem, plus additional late charges, and costs (including additional escrow advances), additional
attorneys' fees and costs and for foreclosure and sale of the mortgaged premises.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due
of $427,164.32, with interest thereon at the rate of $36.14 per diem from August 17, 2009 plus
additional late charges, and costs (including additional escrow advances), additional attorneys'
fees and costs and for foreclosure and sale of the mortgaged premises.

PROMISSORY NOTE

Principal Amount: $430,000.00 Date of Note: June 1, 2000
PROMISE TO PAY. Gordon Holl and Amy Holl ("Borrower") promise to pay to FARMERS AND MERCHANTS TRUST COMPANY OF
CHAMBERSBURG ("Lender"), or order, in lawful money of the United States of America, the principal amount of Four Hundred Thirty
Thousand & 001100 Dollars ($430,000.0, together with interest on the unpaid principal balance from June 1, 2000, until paid in full.
PAYMENT. Subject to any payment changes resulting from changes in the Index, Borrower will pay this loan in accordance with the following
payment schedule:
6 consecutive monthly interest payments, beginning July 5, 2000, with interest calculated on the unpaid principal balances
at an Interest rate of 8.900% per annum; 54 consecutive monthly principal and interest payments of $3,636.60 each,
beginning January 5, 2001, with interest calculated on the unpaid principal balances at an interest rate of 8.9000% per
annum; 119 consecutive monthly principal and interest payments in the initial amount of $3,796.13 each, beginning July 5,
2005, with Interest calculated on the unpaid principal balances at an interest rate of 0.00 percentage points over the Index
described below; and 1 principal and interest payment In the initial amount of $295,406.06 on June 5, 2015, with interest
calculated on the unpaid principal balances at an interest rate of 0.00 percentage points over the Index described below.
This estimated final payment is based on the assumption that all payments will be made exactly as scheduled and that the
Index does not change; the actual final payment will be for all principal and accrued interest not yet paid, together with any
other unpaid amounts under this Note.
The annual interest rate for this Note is computed on a 365/360 basis; that is, by applying the ratio of the annual interest rate over a year of 360 days,
multiplied by the outstanding principal balance, multiplied by the actual number of days the principal balance is outstanding. Borrower will pay Lender
at Lender's address shown above or at such other place as Lender may designate in writing. Unless otherwise agreed or required by applicable law,
payments will be applied first to accrued unpaid iterest, then to principal, and any remaining amount to any unpaid collection costs and late charges.
VARIABLE INTEREST RATE. The interest rate on this Note is subject to change from time to time based on changes in an independent index which
is the New York Prime Rate as published in the Wall Street Journal. When a range of rates has been published, the higher of the rates will be used.
(the "Index"). The Index is not necessarily the lowest rate charged by Lender on its loans. If the Index becomes unavailable during the term of this
loan, Lender may designate a substitute index after notice to Borrower. Lender will tell Borrower the current Index rate upon Borrower's request.
Borrower understands that Lender may make loans based on other rates as well. The interest rate change will not occur more often than each time
there has been a change in the Index. The Index currently is 9:5006/6 per annum. The interest rate or rates to be applied to the unpaid principal
balance of this Note will be the rate or rates set forth above in the "Payment" section. NOTICE: Under no circumstances will the interest rate on
this Note be more than the maximum rate allowed by applicable law. Whenever increases occur in the interest rate, Lender, at its option, may do one
or more of the following: '(a) increase Borrower's payments to ensure Borrower's loan will pay off by its original final maturity date, (b) increase
Borrower's payments to cover accruing interest, (c) increase the number of Borrower's payments, and (d) continue Borrower's payments at the same
amount and increase Borrower's final payment.
PREPAYMENT. Borrower agrees that all loan fees and other prepaid finance charges are earned fully as of the date of the loan and will not be subject
to refund upon early payment (whether voluntary or as a result of default), except as otherwise required by law. Except for the foregoing, Borrower
may pay without penalty all or a portion of the amount owed earlier than it is due. Early payments will not, unless agreed to by Lender in writing, relieve
Borrower of Borrower's obligation to continue to make payments under the payment schedule. Rather, they will reduce the principal balance due and
may result in Borrower making fewer payments.
LATE CHARGE. If a payment is 16 days or more late, Borrower will be charged 6.000% of the regularly scheduled payment
DEFAULT. Borrower will be in default H any of the following happens: (a) Borrower fails to make any payment when due. (b) Borrower breaks any
promise Borrower has made to Lender, or Borrower fails to comply with or to perform when due any other term, obligation, covenant, or condition
contained in this Note or any agreement related to this Note, or in any other agreement or loan Borrower has with Lender. (c) Borrower defaults under
any loan, extension of credit, security agreement, purchase or sales agreement, or any other agreement, in favor of any other creditor or person that
may materially affect any of Borrower's property or Borrower's ability to repay this Note or perform Borrower's obligations under this Note or any of the
Related Documents. (d) Any representation or statement made or fumished to Lender by Borrower or on Borrower's behalf is false or misleading in any
material respect either now or at the time made or furnished. (e) Borrower dies or becomes insolvent, a receiver is appointed for any part of Borrower's
property, Borrower makes an assignment for the benefit of creditors, or any proceeding is commenced either by Borrower or against Borrower under
any bankruptcy or insolvency laws. (f) Any creditor tries to take any of Borrower's property on or in which Lender has a lien or security interest. This
includes a garnishment of any of Borrower's accounts with Lender. (g) Any of the events described in this default section occurs with respect to any
guarantor of this Note. (h) A material adverse change occurs in Borrower's financial condition, or Lender believes the prospect of payment or
performance of the Indebtedness is impaired. (i) Lender in good faith deems itself insecure.
LENDER'S RIGHTS. Upon default, Lender may, after giving such notices as required by applicable law, declare the entire unpaid principal balance on
this Note and all accrued unpaid interest immediately due, and then Borrower will pay that amount. Upon default, including failure to.pay upon final
maturity Lender, at its option, may also, if permitted under applicable law, increase the variable interest rate on this Note by 2.000 percentage, points.

Borrower does not pay. Borrower also will pay Lender that amount. This includes, subject to any limits under applicable law, Lender's attorneys' fees
and Lender's legal expenses whether or not there is a lawsuit, including attorneys' fees and legal expenses for bankruptcy proceedings (including
efforts to modify or vacate any automatic stay or injunction), appeals, and any anticipated post-judgment collection services. If not prohibited by
applicable law, Borrower also will pay any court costs, in addition to all other sums provided by law. If judgment is entered in connection with this
Note, interest will continue to accrue on this Note after judgment at the interest rate applicable to this Note at the time judgment is entered. This Note
has been delivered to Lender and accepted by Lender in the Commonwealth of Pennsylvania. If there is a lawsuit, Borrower agrees upon
Lender's request to submit to the jurisdiction of the courts of Franklin County, the Commonwealth of Pennsylvania. This Note shall be
governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.

DISHONORED ITEM FEE. Borrower will pay a fee to Lender of $25.00 it Borrower makes a payment on Borrower's loan and the check or
preauthorized charge with which Borrower pays is later dishonored.
RIGHT OF SETOFF. Borrower grants to Lender a contractual security interest in, and hereby assigns, conveys, delivers, pledges, and transfers to
Lender all Borrower's right, title and interest in and to, Borrower's accounts with Lender (whether checking, savings, or some other account), including
without limitation all accounts held jointly with someone else and all accounts Borrower may open in the future, excluding however all IRA and Keogh
accounts, and all trust accounts for which the grant of a security interest would be prohibited by law. Borrower authorizes Lender, to the extent
permitted by applicable law, to charge or setoff all sums owing on this Note against any and all such accounts.
COLLATERAL This Note is secured by a Mortgage dated June 1, 2000, to Lender on real property located in Cumberland County, Commonwealth of
Pennsylvania, all the terms and conditions of which are hereby incorporated and made a part of this Note.
GENERAL PROVISIONS. Lender may delay or forgo enforcing any of its rights or remedies under this Note without losing them. Borrower and any
other person who signs, guarantees or endorses this Note, to the extent allowed by law, waive presentment, demand for payment, protest and notice of
dishonor. Upon any change in the terms of this Note, and unless otherwise expressly stated in writing, no party who signs this Note, whether as maker,
guarantor, accommodation maker or endorser, shall be released from liability. All such parties agree that Lender may renew or extend (repeatedly and
for any length of time) this loan, or release any party or guarantor or collateral; or impair, fail to realize upon or perfect Lender's security interest in the
collateral; and take any other action deemed necessary by Lender without the consent of or notice to anyone. All such parties also agree that Lender
may modify this loan without the consent of or notice to anyone other than the party with whom the modification is made. The obligations under this
Note are joint and several. If any portion of this Note is for any reason determined to be unenforceable, it will not affect the enforceability of any other
provisions of this Note.
CONFESSION OF JUDGMENT. Borrower hereby irrevocably authorizes and empowers any attorney or the Prothonotary or Clerk of any Court in the
Commonwealth of Pennsylvania, or elsewhere, to appear at any time for Borrower, and with or without complaint filed, as of any term, confess or enter
judgment against Borrower for the entire principal balance of this Note and all accrued interest, together with costs of suit, and an attorney's
commission of ten percent (10%) of the unpaid principal balance and accrued interest for collection, but in any event not less than Five Hundred
Dollars ($500); and for so doing, this Note or a copy of this Note verified by affidavit shall be sufficient warrant. The authority granted in this Note to
confess judgment against Borrower shall not be exhausted by any exercise of that authority, but shall continue from time to time and at all times until
payment in full of all amounts due under this Note.
PRIOR TO SIGNING THIS NOTE, EACH BORROWER READ AND UNDERSTOOD ALL THE PROVISIONS OF THIS NOTE, INCLUDING THE
VARIABLE INTEREST RATE PROVISIONS AND THE NOTICE TO COSIGNER SET FORTH BELOW. EACH BORROWER AGREES TO THE
TERMS OF THE NOTE AND ACKNOWLEDGES RECEIPT OF A COMPLETED COPY OF THE NOTE.

Defendants Gordon Holl and Amy Holl, by and through their attorney, Sally J.
Winder, file the following preliminary objections to plaintiff s Complaint in Mortgage
Foreclosure:
FAILURE OF PLEADING TO CONFORM TO LAW OR RULE OF COURT
1. Rule 1018.1(b), Pa.R.C.P., specifies the form of Notice to Defend with which every
complaint filed by a plaintiff must begin.
2. Plaintiff in this case has not followed the form required by the Rules of Civil
Procedure as noted in paragraph 1. A copy of the incorrect Notice to Defend is
incorporated by reference herein as Exhibit "A".
3. By not following the required form, plaintiff has violated the specified Rule of Court.
4. Plaintiff's complaint should be dismissed.
FAILURE OF PLEADING TO CONFORM TO RULE OF COUNT
5. Paragraph 7 of Plaintiff's complaint avers that Notice of Homeowners' Emergency
Mortgage Assistance Act of 1983 and Notice of Intention to Foreclose Mortgage were
mailed to Defendants in compliance with the Homeowner's Emergency Mortgage
Assistance Act, Act 91 of 1983 and Act 6 of 1974, 41 P.S. §101, et seq.
6. The aforesaid Notices are writings upon which the Plaintiffs right to commence an
action in mortgage foreclosure against Defendants is based.
7. Rule 1019(i), Pa. R.C.P., specifies that, when a claim is based upon a writing, the
pleader shall attach a copy of the writing to its pleading.
8. Plaintiff in this did not attach a copy of the above-referenced writings to its complaint.
9. By not attaching a copy of the above-referenced writings to its complaint, Plaintiff has
violated the specified Rule of Court.
10. Plaintiff s complaint should be dismissed.
FAILURE OF PLEADING TO CONFORM TO LAW
11. Provisions of the Homeowners' Emergency Assistance Act of 1983 and Act 6 of
1974, 41 P.S. §101, et seq. require that the Notices, upon which the Plaintiff's right to
commence an action in mortgage foreclosure against Defendants is based, shall be served
upon the Defendants by first class mail, and by either registered or certified mail.
12. Plaintiff's complaint does not state the method or manner in which the required
Notices were served upon Defendants.
13. By not specifying the manner or method in which the required Notices were served,
the Plaintiff has violated the provisions of ;the above-referenced laws.
14. Plaintiff's complaint should be dismissed,

Plaintiff, Farmers and Merchants Trust Company of Chambersburg, by its attorneys,
James, Smith, Dietterick & Connelly, LLP, files the following Reply to Defendants' Preliminary
Objections as follows:

APPLICATION FOR MORTGAGE ASSISTANCE. -Your mortgage is in default for the
reasons set forth later in this Notice (see following pages for specific information about the nature of your
default.) If you have tried and are unable to resolve this problem with the lender, you have the right to
apply for financial assistance from the Homeowner's Emergency Mortgage Assistance Program. To do
so, you must fill out, sign and file a completed Homeowner's Emergency Assistance Program, Application
with one of the designated consumer credit counseling agencies listed at the end of this Notice. Only
consumer credit counseling agencies have applications for the program and they will assist you in
submitting a complete application to the Pennsylvania Housing Finance Agency. To temporarily stop the
lender from filing a foreclosure action, your application MUST be forwarded to PHFA and received
within thirty (30) days of your face-to-face meeting with the counseling agency.

decision on your application.

BANKRUPTCY, THE FOLLOWING PART OF THIS NOTICE IS FOR INFORMATION

HOW TO CURE YOUR MORTGAGE DEFAULT
NATURE OF THE DEFAULT - the MORTGAGE debt held by the above Lender on your property
located at: 355 Hunters Road, Newville PA 17241-9423, IS SERIOUSLY IN DEFAULT because you
have failed to pay promptly installments of principal and interest, as required, for a period of at least sixty
(60) days. YOU HAVE NOT MADE MONTHLY MORTGAGE PAYMENTS from May through July
2009. The following amounts are now past due:

IF YOU DO NOT CURE THE DEFAULT - If you do not cure the default within THIRTY
(30) DAYS of the date of this Notice, the lender intends to exercise its rights to accelerate the
mortgage debt. This means that the entire outstanding balance of this debt will be considered
due immediately and you may lose the chance to pay the mortgage in monthly installments. If
full payment of the total amount past due is not made within THIRTY (30) DAYS, the lender
also intends to instruct its attorneys to start legal action to foreclosure upon your mortgaged
Property.
IF THE MORTGAGE IS FORECLOSED UPON - The mortgaged property will be sold by
the Sheriff to pay off the mortgage debt. If the lender refers your case to its attorneys, but you
cure the delinquency before the lender begins legal proceedings against you, you will still be
required to pay the reasonable attorney's fees that were actually incurred, up to $50.00.
However, if legal proceedings are started against you, you will have to pay all reasonable
attorney's fees actually incurred by the lender even if they exceed $50.00. Any attorney's fees
will be added to the amount you owe the lender, which may also include other reasonable costs.
If you cure the default within the THIRTY (30) DAY period, you will not be required to
pay attorney's fees.
OTHER LENDER REMEDIES - The lender may also sue you personally for the unpaid
principal balance and all other sums due under the mortgage.
RIGHT TO CURE THE DEFAULT PRIOR TO SHERIFF'S SALE - If you have not cured
the default within the THIRTY (30) DAY period and foreclosure proceedings have begun, you
still have the right to cure the default and prevent the sale at any time up to one hour before the
Sheriff s Sale. You may do so by paying the total amount then past due, plus any late or other
charges then due, reasonable attorney's fees and costs connected with the foreclosure sale and
any other costs connected with the Sheriff's Sale as specified in writing by the lender and by
performing ggy other requirements under the mortgne_ Curing your default in the manner set
forth in this notice will restore your mortgage to the same position as if you have never
defaulted.
EARLIEST POSSIBLE SHERIFF'S SALE DATE- It is estimated that the earliest date that
such a Sheriff's Sale of the mortgaged property could be held would be approximately six
months from the date of this Notice.' A notice of the actual date of the Sheriff s Sale will be
sent to you before the sale. Of course, the amount needed to cure the default will increase the
longer you wait. You may find out at any time exactly what the required payment or action will

Legal Rights and Protections Under the SCRA
Service members on "active duty" or "active service," or a dependent of such a service member
may be entitled to certain legal protections and debt relief pursuant to the Service members Civil
Relief Act (50 USC App. §§ 501-596) (SCRA)
Who Mgy Be Entitled to Legal Protections Under the SCRA?
• Active duty members of the Army, Navy, Air Force, Marine Corps, Coast Guard, and
active service National Guard;
• Active service members of the commissioned corps of the National Oceanic and
• Atmospheric Administration;
• Active service members of the commissioned corps of the Public Health Service:
• United States citizens serving with the armed forces of a nation with which the United
• _ States is allied in the prosecution of a war or military action; and
+ Their spouses
What Legal Protections Are Service members Entitled To Under the SCRA?
• The SCRA states that, a debt incurred by a service member, or service member and
spouse jointly, prior to entering military service shall not bear interest at a rate above 6
percent during the period of military service.
• The SCRA states that, in a legal action to enforce a debt against real estate that is filed
during, or within 90 days after the service member's military service, a court may stop
the proceedings for a period of time, or adjust the debt. In addition, the sale, foreclosure,
or seizure of real estate shall not be valid if it occurs during, or within 90 days after the
service member's military service unless the creditor has obtained a court order
approving the sale, foreclosure, or seizure of the real estate.
• The SCRA contains many other protections besides those applicable to home loans.

• A service member or dependent, or both, may request relief under the SCRA by

FAILURE OF PLEADING TO CONFORM TO LAW OR RULE OF COURT
1. Rule 1017, Pennsylvania Rules of Civil Procedure (Pa.R.C.P.), specifies that a

OPINION AND ORDER OF COURT
EBERT, J., August 3, 2010 -
Plaintiff, Farmers and Merchants Trust Company, commenced a mortgage foreclosure
action against Defendants, Gordon Holl and Amy Holl, because of Defendants' failure to pay
monthly installments or principal and interest on their mortgaged property when due.
Defendants subsequently made a payment of $261,758.04 to Plaintiff and filed an Answer to
Plaintiff's Complaint. Plaintiff then filed a Motion for Summary Judgment alleging that the
Defendants failed to pay the total amount due and owing on the Mortgage and failed to establish
a defense to Plaintiff's Complaint in Mortgage Foreclosure. For the reasons stated below,
Plaintiff's Motion for Summary Judgment is denied.
STATEMENT OF FACTS
The following facts from the record are not in dispute. Defendants are the record and real
owners of the property located at 355 Hunters Road, Newville, PA ("Property").I On June 1,
2000, the Defendants executed a Note in favor of the Plaintiff in the principal amount of

$430,000 and entered a Mortgage on the Property to secure the Note.2 The Mortgage went into
default when Defendants failed to pay several monthly installments of the principal and interest.3
The Plaintiff filed a Complaint in Mortgage Foreclosure on August 20, 2009, to commence an
action in foreclosure. Plaintiff also mailed to Defendants a combined Notice of Homeowners'
Emergency Assistance Act of 1983 and Notice of Intention to Foreclose Mortgage, purportedly
in compliance with Act 91 of 1983 and Act 6 of 1974, 41 P.S. §101, et. seq.4 Defendants then
filed Preliminary Objections to Plaintiff s Complaint alleging that the Plaintiff failed to comply
with the statutory notice requirements, but the Objections were overruled on January 12, 2010.5
Thereafter, the Defendants made a payment of $261,758.04 to the Plaintiff on January 28, 2010.6
Defendants also filed an Answer and New Matter to Plaintiff s Complaint on February 1, 2010,
contending that the January 28 payment cured their default.? Plaintiff filed a Motion for
Summary Judgment on June 7, 2010, arguing that the Defendants are still in default and that they
owe the full remaining balance on the principal plus interest and fees.g
DISCUSSION
Summary Judgment Standard
In Pennsylvania, a court may grant summary judgment only when there is no genuine
issue of any material fact as to a necessary element of the cause of action or a defense that could
be established by additional discovery. Pa. R. C. P. 1035.2. The court must view the record in
the light most favorable to the non-moving party and must resolve all doubts as to the existence
of a genuine issue of material fact against the moving party. Fine v. Checcio, 870 A.2d 850,
z Pl.'s Compl. at ¶ 3, 4.

857 (Pa. 2005}. Furthermore, the court may grant summary judgment only where the right to
summary judgment is clear and free from doubt. Marks v. Tasman, 589 A.2d 205, 206 (Pa.
1991). In an action for foreclosure due to Defendants' failure to pay a debt, summary judgment
is proper where the Defendant admits that he has failed to make the payments due and fails to
sustain a cognizable defense to the Plaintiff s claim. Gateway Towers Condominium Assn v.
Krohn, 845 A.2d 855 (Pa.Super. 2004).
Analysis
At issue then is whether the Defendants are in default under the terms of the Mortgage
and Note and/or do they have a cognizable defense. Plaintiff alleges in the Complaint that the
Defendants are in default of their Note and Mortgage since the Defendants failed to pay several
months' installment payments. Plaintiff maintains that the full amount of the Note is due and
owing, arguing that foreclosure is appropriate. Plaintiff further contends that an award of
summary judgment is proper, arguing from case law that summary judgment is properly granted
when a mortgagor admits to being in default under the terms of the note and mortgage.
Defendants counter that they are no longer in default, having cured the default with a lump sum
payment of $261,758.04 on January 28, 2010. Defendants further argue that since Plaintiff chose
to be governed by the provisions of Act 91 and Act 6, but has not complied with the Act 91 and
Act 6 notice requirements they have a cognizable defense.
As a preliminary matter, we note that Act 6 Notices are only required in cases where the
principal amount is $217,873 or less. 41 P.S. §101; 41 P.S. § 403. Because the original amount
for the Note in the instant case was $430,000, Act 6 Notice requirements would not ordinarily
govern. If Act 6 were to apply to the instant proceeding, Plaintiff would be required to grant a

period of time for Defendants to cure their default before accelerating the loan amount. 41 P.S. §
403.
The record clearly shows that Plaintiff sent a combined Act 91 and Act 6 Notice to the
Defendants.9 In fact Plaintiff avers in the Complaint that the combined Notices were mailed "in
compliance with the Homeowners' Emergency Mortgage Assistance Act, Act 91 of 1983 and
Act 6 of 1974." 10 Plaintiff later included a copy of the Notice in the Reply to Defendants'
Preliminary Objections. The Notice contains provisions which seemingly allow Defendants to
cure the default prior to acceleration of the debt.l 1 Equally clear in the record is evidence that
the Defendants believed that the Act 91 and Act 6 Notice requirements were binding on the
foreclosure proceedings. The Defendants' Preliminary Objections focus on whether the Act 91
and Act 6 Notices were properly sent and served.12 All of the subsequent documents on record
filed by Defendants are replete with references to the applicability of the Act 91 and Act 6
Notices. Furthermore, it is not until after the Defendants made the payment to cure the default
that Plaintiff clearly denies that the Act 6 Notice requirements even apply to Defendants' loan.is
Thus, the evidence on record raises the question of whether the Act 6 Notice requirements should
apply in the instant foreclosure proceedings.
One court has noted that an "erroneously sent Act Six Notice may well have misled the
defendants and certainly the retention of the maney sent which was only sent for the purpose of
curing the default establishes a contract between defendants and plaintiff which cannot be
unilaterally abrogated by the latter while it still retains the money." The Fidelity Bank v.

McAlinden, 30 Pa. D. & C.3d 298, 299-300 (Pa. Com. Pl. 1982). While the facts in Fidelity
Bank dealt with the opening of a judgment by confession in a mortgage case, they are in many
ways nearly identical to the instant case. The court in FidelityBank concluded that principles of
equity "support the position of defendants who have received an erroneous notice, paid a
considerable amount of the mortgage and sent the amount they reasonably thought might cure
the default and then find the plaintiff has taken such money and nevertheless failed to cure the
default." Id.
Similarly, in the instant case Defendants maintain that they relied on the Plaintiff's
combined Act 91 and Act 6 notices which appeared to allow them to cure their default.14 In that
belief they paid the sum of $261,758.04 to the Plaintiff who kept the money but maintains that
the payment did not cure the default. While this Court realizes that the opinion in Fidelity Bank,
being a Philadelphia Common Pleas Court opinion, is not binding upon this Court, at least for the
purposes of Summary Judgment, we find the reasoning used by Judge Lord in Fidelity Bank to
be compelling and accordingly find that the Plaintiff's right to Summary Judgment is not clear
and free from doubt.
CONCLUSION
A genuine issue of material fact exists as to whether the Defendants' Mortgage is in
default or whether Plaintiff s error with regard to the Act 6 and Act 91 notices afford them a
cognizable defense. Accordingly, Plaintiff's Motion for Summary Judgment is denied.
Accordingly, the following order will be entered.
