GUEST I, Andrew G. Guest, a resident of Cumberland County, Pennsylvania, being of sound and disposing mind and memory, and over the age of 18 years, do make, publish, and declare this to be my Last Will and Testament. I revoke all prior Wills and Codicils by me, heretofore made. ****TWO**** c N o ~~ `° ,~ ?~~ ~ c' _ I declare that I am currently divorced. 'ice>rlsx ~ ~~ ****THREE**** r j ~~ ~ a o 1. I have two (2) children whose names are: Jessica Nicole Guest, born September 24, 1993 James Thomas Guest, II, born March 25, 1995 2. The above-mentioned children are living. I have no deceased children. 3. The terms "child" and "children" as used in this Will include the children mentioned herein, any children hereafter born to me, deceased children, and any children I may hereafter adopt. ****FOUR**** I have intentionally omitted to make provision in this Will for any future spouse which I might have. **s*FIVE**** I give, devise, and bequeath the proceeds from the sale of my van unto April L. Casper. ****SIX**** I give, devise, and bequeath the rest, remainder, and residue of my estate, both real property and personal property, unto my beloved children then living, in equal shares, on a per capital and not per stirpes basis. Should any of the aforementioned children of mine have predeceased me, but the issue of such predeceased child survive me, then that share of my estate which would otherwise have passed to my deceased child shall pass per capita and not per stirpes to my surviving child. I further specifically bequeath all of my tools to my beloved son, James T. Guest, II, and my heirloom coat rack unto my beloved daughter, Jessica N. Guest. I direct that my executrix have the discretion to put these items as well as other personal items into storage until she feels it is the appropriate time to give such items to my children. As well, my executrix shall have the discretion to sell any other items of personal property as she may deem appropriate. ****SEVEN**** In the event that at the time of my death any beneficiary of mine has not reached the age of 25, then any property bequeathed to a minor child or minor children from my estate shall be held in a separate trust for such child under the following terms: Until such child reaches the age of 25, the Trustee shall invest the principal of such trust and pay to or for the benefit of the child any part of all of the net income or principal thereof as the Trustee, in his or her sole discretion, considers advisable for the child's health or education. Any undistributed income shall be added to the principal at the end of each year. When the child reaches the age of 25, any remaining principal of the trust shall be paid or transferred to such child to be his or hers absolutely. In the event of such child's death before reaching the age of 25, any remaining principal of the trust shall be paid to the child's estate. I hereby appoint Pamela R. Thomas to serve as Trustee. In the event that the said Trustee is unable or unwilling to serve for any reason, then I appoint April L. Casper as Trustee. I wish to further state that I do completely trust Pamela R. Thomas and April L. Caster to oversee the trust fund for my children. I have complete faith in their abilities as well as decision-making, and I ask that their decisions be respected and otherwise followed. Furthermore, I do have confidence in their ability to spend money for any educational and health needs that they feel are appropriate. The Trustee shall not be required to post bond or other security for the performance of his or her duties of file accounts in any jurisdiction, and may otherwise administer my estate without court supervision to the maximum extent permitted by law. While held by the trustee, the principal and income of any trust hereunder shall be free from the control, debts, liabilities, and assignments of the beneficiary of the trust and shall not be subject to process for the enforcement of judgments of claims against the beneficiary. ****EIGHT**** If any provision of this Will or any Codicil thereto is held inoperative, invalid, or illegal, it is my intention that all remaining provisions, thereof, shall continue to be fully operative and effective so far as possible and reasonable. ****~~,**s* I direct my executrix, hereinafter named, to pay all of my funeral expenses, administration and expenses of my estate, including inheritance and succession taxes, state or federal, which may be due by the passage of or succession to any interest in my estate under the terms of this instrument, and all my just debts. ****TEN**** I appoint Pamela R. Thomas Executrix of this Will, and direct that no hond or other form of security be required by reason of her acting in such capacity. ****ELEVEN**** Should Pamela R. Thomas be unable or unwilling to act in the capacity of Executrix, I appoint Cheryl Ann Clazk as Executrix and direct that no bond or other form of security be required by reason of her acting in such capacity.
