MCKEEFERY made, executed and delivered a mortgage upon the premises hereinafter described to NEW CENTURY MORTGAGE CORPORATION which mortgage is recorded in the Office of the Recorder of CUMBERLAND County, in Mortgage Book No. 1914, Page 4225. By Assignment of Mortgage recorded 12/06/2005 the mortgage was assigned to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INCORPORATED which Assignment is recorded in Assignment of Mortgage Book No. 723, Page 432. The PLAINTIFF is now the legal owner of the mortgage and is in the process of formalizing an assignment of same. The premises subject to said mortgage is described as attached. The mortgage is in default because monthly payments of principal and interest upon said mortgage due 02/01/2009 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon failure of mortgagor to make such payments after a date specified by written notice sent to Mortgagor, the entire principal balance and all interest due thereon are collectible forthwith. If the mortgage is reinstated prior to a Sheriffs Sale, the attorney's fee set forth above may be less than the amount demanded based on work actually performed. MCKEEFERY died on March 6, 2009, leaving a Will dated 12/2/98. Letters Testamentary were granted to JOHNNA L. SEETON on 3/13/09 in Cumberland County, No. 21-2009-248. Decedent's surviving heir at law is THE PENNSYLVANIA LEGISLATIVE ANIMAL NETWORK. 11. Plaintiff does not hold the named Defendants, JOHNNA L. SEETON and THE PENNSYLVANIA LEGISLATIVE ANIMAL NETWORK, personally liable on this cause of action. This action is being brought to foreclose the interest of the said Defendants in the aforesaid real estate only, and the Defendants have been named in accordance with the requirements of Pa R.C.P. 1144(a)(2) and 20 Pa.C.S.A. § 301(b).
