On 06/14/2005 FRACES JOANNA MCKEEFERY A/K/A FRANCES J. MCKEEFERY
made, executed and delivered a mortgage upon the premises hereinafter described to
NEW CENTURY MORTGAGE CORPORATION which mortgage is recorded in the
Office of the Recorder of CUMBERLAND County, in Mortgage Book No. 1914, Page
4225. By Assignment of Mortgage recorded 12/06/2005 the mortgage was assigned to
MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INCORPORATED which
Assignment is recorded in Assignment of Mortgage Book No. 723, Page 432. The
PLAINTIFF is now the legal owner of the mortgage and is in the process of formalizing
an assignment of same. The mortgage and assignment(s), if any, are matters of public
record and are incorporated herein by reference in accordance with Pa.R.C.P. 1019(g);

which Rule relieves the Plaintiff from its obligations to attach documents to pleadings if
those documents are of public record.
The premises subject to said mortgage is described as attached.
The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 02/01/2009 and each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such payments after a date specified
by written notice sent to Mortgagor, the entire principal balance and all interest due
thereon are collectible forthwith.

If the mortgage is reinstated prior to a Sheriffs Sale, the attorney's fee set forth above may
be less than the amount demanded based on work actually performed. The attorney's fees
requested are in conformity with the mortgage and Pennsylvania law. Plaintiff reserves
its right to collect attorney's fees up to 5% of the remaining principal balance in the event
the property is sold to a third party purchaser at Sheriffs Sale, or if the complexity of the
action requires additional fees in excess of the amount demanded in the Action.

8. Notice of Intention to Foreclose pursuant to Act 6 of 1974 is not required because the
defendant(s) is/are not a "Residential Mortgage Debtor" as defined by the Act, having failed
to provide Plaintiff notice of its acquisition of title.
9. This action does not come under Act 91 of 1983 because the mortgaged premises is not
owner-occupied.
10. Mortgagor FRANCES JOANNA MCKEEFERY A/K/A FRANCES J. MCKEEFERY
died on March 6, 2009, leaving a Will dated 12/2/98. Letters Testamentary were granted to
JOHNNA L. SEETON on 3/13/09 in Cumberland County, No. 21-2009-248. Decedent's
surviving heir at law is THE PENNSYLVANIA LEGISLATIVE ANIMAL NETWORK.
11. Plaintiff does not hold the named Defendants, JOHNNA L. SEETON and THE
PENNSYLVANIA LEGISLATIVE ANIMAL NETWORK, personally liable on this cause
of action. This action is being brought to foreclose the interest of the said Defendants in
the aforesaid real estate only, and the Defendants have been named in accordance with the
requirements of Pa R.C.P. 1144(a)(2) and 20 Pa.C.S.A. § 301(b).

WHEREFORE, PLAINTIFF demands an in rem Judgment against the Defendant(s) in the sum of
$93,218.36, together with interest from 08/21/2009 at the rate of $14.35 per diem to the date of
Judgment, and other costs and charges collectible under the mortgage and for the foreclosure and
sale of the mortgaged property.

08/26/2009 R. Thomas Kline, Sheriff who being duly sworn according to law states that he made a diligent search and
inquiry for the within named defendant, to wit: Johnna L. Seeton, but was unable to locate her in his
bailiwick. He therefore deputized the Sheriff of Dauphin County, PA to serve the within Complaint In
Mortgage Foreclosure according to law.
08/28/2009 R. Thomas Kline, Sheriff who being duly sworn according to law states that he made a diligent search and
inquiry for the within named defendant, to wit: Pennsylvania Legislative Animal Network, Inc., but was
unable to locate them in his bailiwick. He therefore deputized the Sheriff of Dauphin County, PA to serve
the within Complaint In Mortgage Foreclosure according to law.
08/31/2009 R. Thomas Kline, Sheriff, who being duly sworn according to law, states that he made a diligent search
and inquiry for the within named defendant to wit: Johnna L. Seeton, but was unable to locate her in his
bailiwick. He therefore returns the within Complaint in Mortgage Foreclosure as not found as to the
defendant Johnna L. Seeton. The Enola Postmaster has advised the defendant has moved and left no
forwarding address. An exact address is not available.
