HomeMy WebLinkAbout08-14-09 (2)C7 O C 4 ~.4 m A {` -rte !~- ~ t ~:~ i ~ m +~ 7v~ -c~ `-,' ~~ c:7 ~ ~ _ : r FAMILY SETTLEMENT AND FINAL RELEASIa'~ ~,; - ,; In Re: Estate of Walter William Tartar, Deceased `~ No. 2105-0545 KNOW ALL MEN BY THESE PRESENTS, that WHEREAS, Walter William Tartar, Late of Shippensburg, Cumberland County, Pennsylvania, died intestate on May 20, 2005, WHEREAS, the said Patti Tartar, his widow, was issued Letters of Administration on the estate of the said decedent, which were duly issued by the Register of Wills of Cumberland County, PA to the said Administratrx hereinafter called the personal representative, to No. 21 05-0545. WHEREAS, the said personal representative has gathered the assets of the estate of the said decedent and the assets consist of cash and real estate for a total value of $81,496.57, as set forth in the attached Exhibit A. WHEREAS, the debts and deductions in the said estate, amount to 19,146.50 (See Exhibit B) and inheritance taxes of $1,200.00 (See Exhibit C). WHEREAS, William A. Addams, attorney for the estate, has agreed to reduce his fee from $4,000 to $2,250, thereby reducing the debts from $19,146.50 to $17,39b.50 WHEREAS, because there was a dispute over the decedent's share of ownership of 738 Burdette Drive, between the Administratrx, the previous wife of the decedent, and the decedent's three sons, it was necessary to enter into a Petition for special relief; Entry of an Order for Equitable Distribution of Marital Property and Injunction necessary to preserve Marital Property, Pursuant to Section 3323 of The Divorce Code, were filed in Delaware County, Pennsylvania, to No. 83- 6390. As a result of the Petition, Patti Tarter, Margaret A. Dolan Tartar, the former wife of the decedent, and the three sons of the decedent have agreed to a settlement of $16,500 in exchange for Patti Tartar's interest in the said 738 Burdette Dr., Upper Chichester Twp., Delaware County, PA. WHEREAS, additional attorney fees of $4,000 were incurred payable to William R. Hagner, Esquire, O'Donnell, Hagner and Williams, 211 W. Lancaster Ave., Paoli, PA 19301, in order to resolve this matter. Therefore, there is a revised balance for distribution of $38,496.57 to be distributed less the debts as follows: Total Assets $38,496.57 Total Debts 22,596.50 Balance for Distribution $15,900.07 WHEREAS, It is agreed among the parties to this Release, that Patti Tartar shall receive the Balance for Distribution Total Distributed 15,900.07 WHEREAS, the balance for distribution has been distributed as set forth in the aboveschedule of distribution. NOW, THEREFORE we, the undersigned beneficiazies, being all of the beneficiaries of the said decedent and being those persons entitled to inherit do hereby, each of us, acknowledge that we have received from the aforesaid estate, in full satisfaction any sums of money due us. AND, each of us does hereby stipulate and agree that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, that no account is necessary and we do hereby agree and consent to distribution being made without the filing of an account and schedule of distribution to be with the same force and effect as if filed and confirmed by the Orphans' Court Division of the Court of Common Pleas of Cumberland County, PA. THEREFORE, each of us does hereby remise, release, quitclaim and forever discharge the said personal representative, her heirs, executors, and administrators and assigns, of and from the said estate and from all actions, suits, payments, accounts, reckonings, claims, and demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever touching upon the estate of the said decedent.
