Petitioner is Ricardo Antonio Medina Iturriaga, an adult individual residing at Reina Maud 6266, DPTO. 104, Villa Carabineros De Chile, Comuna De Lo Prado, Santiago, Chile, (hereinafter "Father"). 2. Respondent is Bettina Gisel Da Silva Aguirre, an adult individual currently believed to be residing at 3005 Market Street, Camp Hill, Pennsylvania, (hereinafter "Mother"). 3. The parties are parents to two children, Mattias Tadeo Medina Da Silva who was born January 2, 1998 and Soffia Gisel Medina Da Silva who was born January 19, 1996. (See attached Birth Certificates, Exhibit "A") 4. Petitioner is the Father of the subject minor children. 5. (See Exhibit "C") (hereinafter "Order") Said Order has been registered with the Prothonotary of Cumberland County simultaneously with the filing of the within Petition. This Order has not been modified and continues to be in full force and effect. 7. Said Order was entered upon the agreement of the parties herein and provides that Mother could leave Chile with the children in October of 2005. Additionally, the Order provides that Father will have custody of the children in Chile during their summer school holiday for a minimum of thirty (30) days, at his residence. 8. Father has not seen the children, nor had any contact with them, since they left Chile in October 2005. At the time Mother left Chile with the children, Mother advised Father that she was moving to the state of Michigan in the United States and had an employment contract with a business located in Holland, Michigan. 9. Father attempted to enforce the Order in Holland, Michigan, but was unable to locate Mother therein and unable to serve her with legal process. 10. Father has since determined that Mother is currently residing in Camp Hill, Cumberland County, Pennsylvania. 11. Father brings this Petition as an Expedited Petition to Enforce Court Order based upon the belief that if Mother is provided with advance notice of the proceedings herein, that she will again flee her current location with the children in an effort to thwart Father's efforts to exercise his rights of visitation and custody of the children. In light of Mother's failure to abide by the Order of October 7, 2005, Father has applied to the Chile Central Authorities under the Hague Convention for relief. See attached Exhibits as follows: Application under the Hague Convention on the Civil Aspects of International Child Abduction. (Exhibit "D"); Form under the Convention of the Hague of 1980 on the Civil Aspects of the International Subtraction of Children. (Exhibit "E"); Statement of Father. (Exhibit "F"); Correspondence from Paula Correa Camus to National Center for Missing and Exploited Children. (Exhibit "G"); Statement of Social Worker. (Exhibit "H"). 13. Father brings this Petition pursuant to the Uniform Child Custody Jurisdiction and Enforcement Act 23 Pa. C.S.A. §5405 and pursuant to the Hague Convention on the Civil Aspects of International Child Abduction, done at the Hague on October 25, 1980, 42 USC 11601 et.seq. 14. Father herein brings the within Petition and requests this Honorable Court enforce the Order of October 7, 2005 entered by the Second Minors Court of Santiago, Chile. 15. Father has not seen the children since they left Chile in 2005. Father was not afforded visitation with the children in summer 2009 and now they have started the new school year. In light of Mother's efforts to conceal the children's whereabouts from Father. Father requests that he receive custody of the children for the week long Christmas and New Year's holiday recess from school. Father believes the children are attending Camp Hill School District and believes their holiday recess is from December 24, 2009 until January 3, 2010. WHEREFORE, in light of the above, Father requests this Honorable Court issue an Order requiring Mother to supply the children to Father in Chile for the Christmas school holiday from December 24, 2009 until January 1, 2010 and issue an Order providing dates certain for Father's thirty (30) days with the children in summer 2010. I met this woman in Santiago, Chile, during 1993; we lived together during two years in two different addresses, both in Santiago. On 1985 we went to live alone, getting married at the end of that year. On January 19, 1996 my daughter Soffia Gisell Medina Da Silva was born. Then we went to live to Cerrillos and on January 2, 1998, my son Mattias Tadeo Medina Da Silva was born. . My mother in.law, Elena Adriana Aguirre Peralta, came to live with us - that is to say myself, my wife Bettina Gisell Da Silva Aguirre and my two children. At that time she was 68 years old and she came to live with us arguing that she was broken and lost everything in Montevideo, Uruguay, where she lived. She was away from home for several days, stating that her friends' home were nearer to work than ours. All these make me follow here to really find out that she was having an affair. Due to this, she made an accusation at the 8th Civil Court for psychological maltreatment against her, which was not true, since she was never home. I had to work very hard and spend my few free time with my children. The actuary advised me to leave the house, for she could state in any moment that I pulled her down the stairs and that justice would be by her side instead of mine and I might go to jail. In a not officially way the actuary said to me "leave her, she is now with another person and both of you would have a very bad living together'. I accepted thinking that it was for the best for the physical and mental health of my kids. At that moment I stated her that I would not give her money for her, since she had proven me that she was not good managing money, she never helped while we were together to safe money, on the contrary, she wasted money knowing that I will always buy food for my children, pay school, clothes, having food tickets for the supermarket and names of witnesses that went with me every week taking food to my children. She had made the commitment that could visit my kids a full week-end, every two weeks. One day, without previous notice, she left not telling me where to visit my children, but sf-did ar; ?1 accused me demanding my signature and justifying herself saying that she did not hagRM?Ti Off` contact telephone number, nor my mobile number, which, in fact, she did have, for they vc_- °' the same for the last three years prior to our separation. She took out my children from school without leaving a trace, which is against the law. In Chile it is penalized to leave minors without school. She also went out of the country several times, leaving my children in charge of my mother in law, a 73 years old women. Afterwards, on May 1995 she definitively left the country. I was contacted from the 5th Minor Court requesting my signature authorizing my children to leave the country on the month of November, that is to say, my children were seven months alone with their grand mother, who did not contact me during all this time, nor let me see my children, since I found out where they were living. Desde esa fecha los ninos residieron con la madre, pero contribuyendo siempre el Sr. Medina a su manutenci6n. En abril de 2004 la Sra. Da Silva y los ninos se cambiaron de domicilio sin avisarle al Sr. Medina, viendose Emlin Este privado de todo contacto con sus hijos hasta el 7 de octubre de 2005. En esta fecha concurri6 al 50 Tribunal de Menores de Santiago, pues habia sido citado para,contestar a una solicitud de autorizaci6n de „G„ viaje de sus hijos solicitado por la Sra. Da Silva. La madre de los ninos no concurri6 a la audiencia pues ya se GOBIERN4 ®E CHILE CORPORACION DE ASISTENCIA JUDICIAL REGION METROPOLITANA encontraba residiendo en EEUU, siendo representada por un abogado y la abuela materna de los ninos, Elena Aguirre Peralta El Sr. Medina accedi6 a autorizar el viaje, teniendo como principal raz6n el hecho que los ninos tendrian una mejor calidad de vida en EEUU. Por ello en la audiencia se Ileg6 ante el tribunal a un avenimiento en los siguientes terminos: - El padre autorizaba el-viaje, los ninos irian a vivir a EEUU con la madre - El padre autorizaba el viaje, pero bajo la condici6n que los ninos viajaran a Chile a visitarlo una vez al ano. Esto durante [as vacaciones escolares de verano en EEUU, por un periodo de 30 dias. Los gastos de traslado serian financiados por la madre, y los de alimentaci6n, recreaci6n y salud de los ninos mientras estuvieran en Chile serian financiados por el padre. Sin embargo, desde la fecha de dicho acuerdo, el solicitante, Ricardo Antonio Medina Iturriaga, no ha tenido contacto ni noticia alguna de sus hijos Soffia Gisel y Mattias Tadeo. Solo sabe que residen en los Estados Unidos junto a su madre, la Sra. Da Silva, pero desconoce su domicilio exacto La unica informaci6n que tiene es que la Sra. Da Silva trabajaria para la empresa A.R. Blystra localizada en Holland, Michigan, EEUU. El contacto directo y regular entre padres a hijos es reconocido tanto por el Derecho Chileno como por el Derecho Internacional. El articulo 229 del C6digo Civil Chileno es el que contiene el Ilamado derecho de relaci6n directa y regular o "derecho de visitas" al establecer que "el padre o madre que no tenga el cuidado personal del hijo no sera privado del derecho ni quedara exento del deber, que consiste en mantener con el una relaci6n directa y regular..." El articulo 229 tambien establece que el derecho de visitas se "ejercera con la frecuencia y libertad acordada con quien to tiene a su cargo, o, en su defecto, con las que el juez estimare conveniente para el hijo Lo mismo establece al Art. 48 de la ley chilena 16.618, modificada por la ley 19.711. En el caso en cuest16n, ya existe un acuerdo entre los padres, autorizado por el tribunal competente, respecto de las visitas, el cual hasta la fecha no ha sido cumplido por la madre de los ninos. Incluso el Sr. Medina se ha visto impedido de tener contacto alguno con sus hijos, por desconocer por completo la ubicaci6n actual de los ninos. El articulo 21 de la Convenci6n de la Haya sobre los Aspectos Civiles de la Restituci6n Internacional de Ninos establece que podra dirigirse a la Autoridad Central de un Estado contratante una solicitud "pars que se organics o proteja el ejercicio efectivo del derecho de visitas". Conforme al articulo 5° letra b del citado Convenio, "...el derecho de visita comprendera el derecho de Ilevar al nino por un periodo limitado a un lugar que no sea su lugar de residencia habitual...", por to que las visitas transnacionales son de la esencia del derecho de visita bajo el Convenio de La Haya de 1980. Es por ello que el Sr. Medina solicita que se establezca un regimen de visitas respecto de sus hijos Soffia y Mattias, consistente en to siguiente; - Los ninos viajen a Chile una vez al ano, durante sus vacaciones escolares de verano, permaneciendo estos con el padre por un periodo de 30 dias. - R6gimen comunicacional consistente en un minimo de 1 Ilamado telef6nico semanal, durante el fin de semana, con cargo al Sr. Medina. Tambien solicita se le entregue un correo electr6nico de los ninos, para comunicarse sea por correo o por mensajeria instantanea. The article 229 of the Chilean Civil Code is the one that contains the right call of regular and direct relation or "right of visits" establishing that "the father or mother that do not have the personal care of the son will not be private of the right neither he will remain exempt of the duty, that consists of maintaining with him a regular and direct relation ...". The article 299 also establishes that the right of visits himself "will exercise pn the frequency and liberty agreed with whom it has to his charge or, in his defect, with the ones that the judge considers convenient for the son". The same as establishes the Art. 48 of the Chilean law 16.618, modified by the law 19.711. In the case in question, already an agreement among the parents exists, authorized by the competent court, regarding the visits, which to date has not been completed by the mother of the children. Even Mr. Medina has been seen impeded to have any contact with his children, by not knowing completely the current location of the children. The article 21 of the Convention of The Hague on the Civil Aspects of the International Restitution of Children, establishes that will be able to be directed to the Central Authority of a State contractor a request "so that be organized or protect the effective exercise of the right of visits". According to the article 50 letter b of the cited Covenant, "...the right of visit will be understood as the right to carry the child for a limited period of time to a place that is not the place of habitual residence ...", for which the transnational visits are of the essence of the right of visit under the Covenant of The Hague of 1980. That is why Mr. Medina requests that be established a state of visits regarding his children Soffia and Mattias, consistent in the following: • The children travel to Chile once a year, during their school holidays of summer, remaining these with the father for a period of 30 days • A communication state of a minimum of a weekly telephone call, during the weekend, with charge to Mrl. Isabel Paredes y la Srta. Valeria Arancibia Paredes hija de 6sta residen en la calle Reina Maud N°6266, Departamento N°104, Villa Carabineros de Chile, Comuna de Lo Prado, Ciudad Santiago. Republica de Chile. El barrio donde se ubica la vivienda esta habitado principalmente por personas de Clase Media Trabajadora; personas que cuentan con colocaci6n laboral formal, y presentan estabilidad econbmica estable y aceptable. La vivienda que habita el solicitante Sr. Ricardo Medina Iturriaga y su grupo familiar es un departamento de material s6lido, piso impermeable. Es una vivienda de dos niveles; en el primer nivel se ubica una habitacidn que cumple las funciones de comedor y sala de estar, cocina y servicio higi6nico y en el segundo nivel se ubican tres dormitorios con un total de tres camas. En to que se refiere a equipamiento y artefactos para la realizacibn de,los quehaceres dom6sticos, cuenta con el equipamiento necesario para el estar y confort de las personas que habitan la vivienda. En general, las condiciones habitacionales del Sr. Ricardo Medina Iturriaga y su grupo familiar son adecuadas para el habitat de las personas que moran en ella; no se observa hacinamiento ni promiscuidad. De dicho matrimonio nacib una hija quien conforma el grupo familiar del cual es jefe de hogar, el solicitante Sr. Medina Iturriaga. Cabe mencionar que la Sra. Isabel Paredes a la fecha presenta ocho meses de embarazo, espera un hijo del solicitante, Sr. Ricardo Medina Iturriaga. Srta. Valeria Arancibia Paredes, hija deAa?areja del solicitante, cuenta con 16 anos de edad, alumna de tercer afio de Ensex?anza Media. Sr. Ricardo Antonio Medina Iturriaga, padre de los niffos/as y solicitante quien a la fecha cuenta con 38 aflos de edad, estado civil Casado con la Sra. Bettina Gisel Da Silva quien es la madre de los ninos/as por los cuales solicita se regule R6gimen Comunicacional y/o Visitas. El solicitante es Licenciado de Enseiianza Media y laboralmente se capacit6 como Decorador de Interiores En la actualidad es propietario de un medio de transporie de estudiantes cumpliendo, a la vez, las funci6n de conductor. En entrevistas realizadas, visita al hogar y antecedentes recabados es posible manifestar que se trata de un hogar normal en que las relaciones son arm6nicas entre sus miembros, los roles de los integrantes estan bien definidos y se observa existencia y respeto de normas del buen convivir. No se visualizan conflictos de convivencia, al contrario, el trato entre los integrantes del grupo familiar es de respeto y afecto. 3: SITUACION ECONOMICA El Sr. Ricardo Medina Iturriaga y el grupo familiar que conforma en la actualidad cuenta con los siguientes ingresos mensuales: • $550.000 Pesos Chilenos equivalente a 1.019 D61ares; ingreso econ6mico que percibe el solicitante como transportista de escolares. • $195.267 Pesos Chilenos equivalente a 362 D61ares; remuneracibn mensual que percibe la Sra. SITUACION DE SALUD Eri general, las bgndiciones de, salud del grupo familiar en estudio son aceptables puesto que Ainguno de sus miembros sufre enfermedades cr6nicas y/o invalidant es. Si bien es cierto el grupo familiar incurre en gastos relacionados con atenci6n y control medico consignados'en el panto N°3 del pesente Informe "Situaci6n Econ6m1ca", , 6stos opedecen al seguimiento medico del Sra. Isabel Paredes Figueroa, pareja del solicitante, amerita por su estado de gravidez, puesto que espera un hijo del Sr. Medina Iturriaga. 6.-RELACION DE LOS HECHOS En el ano 1992 el solicitante Sr. Ricardo Medina Iturriaga conoci6 a la Srta. Bettina Gisel Da Silva Aguirre, se inici6 una relaci6n sentimental la cual deriv6 en una convivencia de 3 afios para contraer matrimonio el 5 de Diciembre del ado 1995. La pareja se radic6 en la comuna de Cerrillos de la ciudad de Santiago. El 19 de Enera de 1996 naci6 la hija mayor del matrimonio la nifla Soffia Gisel . Medina Da Silva. Segue manifiesta el solicitante Sr. Medina Iturriaga, la vida matrimonial transcurri6 en forma arm6nica, sin la presencia de conflictos; armonia que habria sido alterada por la presencia de la Sra. Elena Aguirre Peralta madre de la c6nyuge y'suegra del solicitante, esta Sra. habria llegado en el alto 1997 y se instal6 a residir en la vivienda del matrimonio en calidad de allegada, la presencia de la suegra influy6 para que se produjeran los primeros conflictos de la pareja. En dicho affo el solicitante y su familia Gambian de residencia, a la comuna de Maipu en la ciudad de Santiago de Chile. El 2 de Enero del afto.1998 pace el hijo menor del matrimonio el nifio Mattias Tadeo Medina Da Silva. En Octubre del alto 1998 el solicitante Sr. Medina Iturriaga autoriza a sus hijos a viajar junto a su madre y abuela materna a Uruguay para to cual financia el viaje de su familia, aun cuando, el Sr, Medina Iturriaga insistia en el pronto regreso de su familia a Chile; su c6nyuge a hijos, volvieron de Uruguay en Mayo del alto 1999. De regreso de Uruguay la relaci6n de pareja continu6 y la c6nyuge Sra. Bettina Da Silva Aguirre reanuda su formaci6n acaddmica, financiando sus estudios el solicitante Sr. Medina Iturriaga. La c6nyuge obtiene los titulos de "Traductora de Inglds y Profesora de Japon6s". Una vez graduada la Sra. Bettina Da Silva Aguirre, c6nyuge del solicitante y madre de sus hijos, ingresa al mercado laboral colocundose como Vendedora en una joyeria, ascendiendo posteriormente al cargo de Jefa de Local. Segue manifiesta el solicitante Sr. Medina Iturriaga, cuando su c6nyuge empez6 a trabajar comenzaron problemas graves en la pareja porque t A g u s t i n a s 1 4 1 9 S 0 n t i a g 0 F o n o j\g 2 7 9 0 0 f a% 61-281,00 f ? ?r. 1a. REGION METROPOLITANA ella habria, experimentado un cambio radical; habria presentado conductas refiidas con su Estado Civil y su rol de madre de familia. En el mes de Mayo del afto 2002 se produjo la ruptura de la relaci6n de pareja y ambos c6nyuges Sr. Mediana Iturtiaga y SXa..Iaa Silva Aguirre decidieron separarse de hecho, continuaron residiendo en el mismo hogar, pero separados de cuerpos. En esta situaci6n y pasados 15 dias la c6nyuge denunci6 al Sr. Medina Iturriaga por Violencia Intrafamiliar ante el 8° Tribunal Civil de la ciudad.de Santiago. En audiencia ante dicho tribunal de Justicia se acuerda que el Sr. Medina 4urriaga, para prevenir conflictos, abandone el hogar. Segue relata el solicitante Sr. Medina Iturriaga desde la fecha de la separaci6n de hecho hasta el afto 2004 61 contribuia activamente a la manutenci6n de sus hijos; dicha contribuci6n consistia en mercaderia; para alimentaci6n de los nifios, insumos escolares, los proveia del gas y financiamiento para atenci6n y tratamiento odontol6gico de sus hijos. Posteriormente, segun manifiesta el solicitante Sr. Medina Iturriaga, la c6nyuge y sus hijos se cambiaron de domicilio sin avisarle la nueva direcci6n; priv'andolo de la comunicaci6n con sus hijos, desde Abril del afto 2004 hasta el 7 Octubre de 2005 fecha en que el solicitante fue citado al 5° Juzgado de Letras de. Menores de la ciudad de Santiago donde firm6 un Avenimiento autorizando el viaje de sus hijos al extranjero. En dicha audiencia no se present6 la madre de los nifios Sra. Bettina Da Silva Aguirre, quien ya se encontraria residiendo en Estados Unidos, en su representaci6n acudi6 un Abogado y la Sra. Elena Aguirre Peralta abuela materna de los nifios Soffia y Mattias Medina Da Silva. Segun declara el solicitante la principal raz6n que se esgrimi6 para que autorizara el viaje de sus hijos habria sido el 6ptimo estandar de vida del cual gozarian sus hijos en Estados Unidos en comparaci6n con el estandar de vida regular que 61 les podria proporcionar si permanecian en Chile. Ademas agrega el Sr. Medina Iturriaga, que en dicha oportunidad careci6 de una representaci6n legal eficiente to cual limit6 su actuar y defensa ante el Tribunal competente. Segue consta en copia autorizada del 5° Juzgado de Letras de Menores de la ciudad de Santiago de Chile, documento que se adjunta. En la mencionada audiencia se acord6 to siguiente: El padre de los nifios autoriza para que sus hijos Soffia Gisel y Mattias Medina Da Silva viajen fuera de Chile con su madre la Sra. Bettina Gisel Da Silva Aguirre. El padre manifiesta que otorga la autorizaci6n bajo la condici6n que sus hijos viajen a Chile una vez al afto durante las vacations de escolares del verano de Estados Unidos, por un periodo minimo de 30 dias y que los costos del traslado los cubra la madre de los nifios y que los gastos de alimentaci6n, recreaci6n y previsi6n en salud los cubrira-el solicitante. Bettina Gisel Da Silva Aguirre, ante el 5 ° Juzgado de ?Letras de ,Mengres de Santiago, el solicitante no ha tenido contacto, comunicaci6n y/o noticias de sus hijos/as, incluso ignora el domicilio de los niflos Soffia Gisel y Mattias Tadeo Medina Da Silva, to unico que conoce es que los ninos residen en Estados Unidos. Es preciso mencionar que el soliditante Sr. Ricardo Medina Iturriaga ha intentado ubicar a sus hijos por distfips medios; via internet, directorios telef6nicos, Policia de Investigaciones de Vhile, todo to cual ha resultado infructuoso, el iinico dato que conoce es que la Sra. Bettina Da Silva Aguirre c6nyuge y madre de sus hijos trabaja en la empresa "A.R.BLYSPRA, ESTADO DE MICHIGAN, ESTADOS UNIDOS. CONCLUSIONES Estudiado los antecedentes socioecon6micos del solicitante Sr. Ricardo Antonio Medina Iturriaga es posible seHalar que: • El Sr. Medina Iturriaga y su actual grupo familiar; su pareja la Sra. Isabel Paredes Figueroa, la hija de su pareja la joven Valeria Arancibia Paredes conforman un nlicleo familiar estable y arm6nico. It is to mention that the Mrs. Isabel Paredes at the present date is eight months pregnant, expecting a son of the requester, Mr. Ricardo Medina Iturriaga. Miss Valeria Arancibia Paredes, daughter of the couple of the requester, is 16 years old, and is student of third year of high school. Mr. Ricardo Antonio Medina Iturriaga, father of the children and requester, who to the date is 38 years old, marital status married with the Mrs. Bettina Gisel Da Silva, who is a mother of the children and to whom he requests a Communication and/or Visits System be regulated. The requester has full high school educational level and in terms of work he qualifies as an Interior Decorator. Currently he is owner of a student transportation, complying, at the same time, the functions of driver. FACTS RELATIONS In the year 1992 the requester, Mr. Ricardo Medina Iturriaga, knew Mrs. Bettina Gisel Da Silva Aguirre, a sentimental relation was initiated, which derived in a.contact of 3 years to contract marriage on December 5, 1995. The couple was settled in the commune of Cerrillos of the city of Santiago. In January 19, 1996 was born the older daughter of the marriage, the girl Soffia Gisel Medina Da Silva. As declared by the requester, Mr. Medina Iturriaga, married life elapsed in harmonic way, without the presence of conflicts; harmony that would have been altered by the presence of Mrs. Elena Aguirre Peralta, mother of the spouse and mother-in-law of the requester. This lady would have arrived in the year 1997 and was installed to reside in the dwelling of the marriage as close person. The presence of the mother-in-law influenced so that the first conflicts of the couple were produced. In the said year, the requester and his family changed from residence to the commune Maipu in "the. city of Santiago of Chile. In January 2, the year 1998 was born the youngest son of the marriage, the boy Mattias Tadeo Medina Da Silva. In October of the year 1998 the requester, Mr. Medina Iturriaga, authorizes his children to travel with their mother and maternal grandmother to Uruguay for which he finances the trip of his family, still when the Mr. Medina Iturriaga insisted on the quick return of his family to Chile; his spouse and children returned from Uruguay in May of the year 1999. After the return from Uruguay the relationship of the couple continued and the spouse, Mrs. Bettina Da Silva Aguirre, resumes her academic formation, financing her studies the requester, Mr. Medina Iturriaga. The spouse obtains the titles of "Translator of English and Teacher of Japanese". Once graduated, Mrs. Bettina Da Silva Aguirre, spouse of the requester and mother of his children, enters to the labor market being placed as a saleswoman in a jewelry store, elevating subsequently to the charge of Chief of Localities. As declared by the requester, Mr. Medina Iturriaga, when his spouse began to work, they began to have serious problems as a couple, because she experienced a radical chap_ w....k' would have presented acts at variance with or contrary to her marital status and her roYbfyTMv 47 . mother. J , _3 ? ,t ,t In the month of May of the year 2002, the relationship as a couple was broken, and both spouses, Mr. Medina Iturriaga and Mrs. Da Silva Aguirre, decided to separate in fact, but continued residing in the same home but separated of bodies. Under this situation and after 15 days, the spouse denounces Mr. Medina Iturriaga for Intrafamiliar Violence before the 8th Civil court. of the city of Santiago. In the audience before the said court of Justice, it is agreed that Mr. Medina Iturriaga should abandon the home in order to prevent conflicts. As stated by requester, Mr. Medina Iturriaga, since the date of the separation in fact to the year 2004, he contributed actively to the maintenance of his children; said contribution consisted of merchandise for diet of the children, school supplies, provided them of gas and financing for attention and dental treatment of his children. Subsequently, as declared by the requester, Mr. Medina Iturriaga, the spouse and his children changed of residence without notifying him the new direction, depriving him of communication with his children, from April of the year 2004 until October 7, 2005, date in which the requester was cited to the 5th. Court of Letters of Minor of the city of Santiago, where he signed an Agreement authorizing the trip of his children abroad. In this audience the mother of the children, Mrs. Bettina Da Silva did not appear, since Mrs. Da Silva was already residing in the United States, in her representation a Lawyer responded and the Mrs- Elena Aguirre Peralta, maternal grandmother of the children Soffia and Mattias Medina Da Silva. As declared by the requester, the main reason used so that he authorized the trip of their children would have been the optimum standard of life of which they would enjoy in the United States in comparison with the standard of regular life that he would be able to provide them if they remained in Chile. Besides, adds Mr. Medina Iturriaga, in that opportunity he lacked of an efficient legal representation, which limited his to act and defense before the competent Court. As it is. evident in authorized copy of the 51 Court of Letters of Minors of the city of Santiago of Chile, document that himself enclosed. In the said audience, the following was agreed: • The father of the children Soffia Gisel and Mattias Medina Da Silva authoirzes his children to travel abroad with their mother, Mrs. Bettina Gisel Da Silva Aguirre • The father says that he gives the authorization under the condition that his children travel to Chile once a year, on summer school vacations in United States, for a period of 30 days and that all travel costs would be paid by their mother and all diet, recreation and forecast in health will covered by the requester. Since October ,7 2005, date in which the father of the children and requester, Mr. Medina Iturriaga, authorized his children so that they travelled out of the country with his spoue?'a''''`• and mother of the children, Mrs. Bettina Gisel Da Silva Aguirre, before the 5° Cou f: Letters of Minors of Santiago. The requester has not had contact, communication ar?d?or'' . ,t news of the residence of the children Soffia Gisel and Mattias Tadeo Medina Da Silva, the only thing that he knows is that the children reside in the United States. It is precise to mention that the requester, Mr. Ricardo Medina Iturriaga, has tried to locate his children by different means; by internet, telephone boards of directors, Chile Investigations Police, all which has turned out fruitless, and the only data that he knows is that Mrs. Bettina Da Silva Aguirre, spouse and mother of his children works in the business'TO.R. BLYSPRA, STATE OF MICHIGAN, United States". CONCLUSIONS After studying the socioeconomic antecedents of the requester, Mr. Ricardo Antonio Medina Iturriaga, is possible to indicate that: • Mr. Medina Iturriaga and his current family group, his couple, Mrs. Isabel Paredes Figueroa, the daughter of Mrs. Isabel Paredes, the young Valeria Arancibia Paredes, they conform a stable and harmonic family. This Honorable Court has scheduled a hearing on the Verified Petition of Biological Father on September 17, 2009, at 1:30 P.M. before The Honorable Edgar B. Bayley. 5. When the parties lived together in Chile, Biological Father raped Mother. 6. Biological Father also physically abused Mother and threatened her life in front the Children, and he beat the Children when they attempted to protect Mother. 7. Mother and the Children continue to live in fear of Biological Father to this day. 8. Mother met Andrew Richard Blystra (hereinafter "Adoptive Father") while Chile. 9. In February of 2005, Mother was taken to Florida by Adoptive Father to medical attention for the long term effects of the head trauma and abuse she suffered the hands of Biological Father. 10. On October 7, 2005, Biological Father agreed to allow the Children to leave and go to the United States. 11. Biological Father was informed of an opportunity to see the Children on Octo 8, 2005, but he did not take advantage of that time. 12. Mother and Adoptive Father initially intended to move to Michigan, but moved to Georgia when a better job opportunity presented itself to Adoptive Father. 13. Mother was divorced from Biological Father on March 20, 2007, by Fin Judgment and Decree of the Superior Court of Cobb County, Georgia. A copy of tl Final Judgment and Decree dated March 20, 2007, is attached hereto as Exhibit "A" ar is made a part hereof. 14. Mother was married to Adoptive Father on May 13, 2007. A copy of the Marriage Certificate is attached hereto as Exhibit "B" and is made a part hereof. 15. The parental rights of Biological Father were terminated, and the adoption of Children by Adoptive Father was granted, on August 21, 2007, by Final Order Adoption of the Superior Court of Cobb County, Georgia. A copy of the Final Order Adoption is attached hereto as Exhibit "C" and is made a part hereof. 16. Due to the termination of Biological Father's parental rights to the Children, Order of October 7, 2005, that Biological Father seeks to enforce is no enforceable. 17. Due to the termination of Biological Father's parental rights to the Children,' lacks standing and lacks capacity to sue for custody of the Children.
