Plaintiff is a corporation having offices at 453 Lincoln Street in Carlisle, Pennsylvania. 2. Defendant is a corporation having its offices and place of business at PO Box 171731, Arlington, Texas 76003. 3. To induce the extension of credit, Defendant executed and delivered to Plaintiff an Application for Credit, a true and correct copy of the Terms and Conditions are attached hereto, marked Exhibit "1 ", and made a part hereof. 4. According to the terms and conditions of the Application for Credit, any disputes arising out of the document or the business relationship established between the parties shall be governed by the laws of the Commonwealth of Pennsylvania and venue will lie in the Court of Common Pleas of Cumberland County. 5. At the special instance and request of Defendant, Plaintiff sold and delivered to Defendant certain goods, wares and merchandise, as is more specifically shown by Plaintiffs Order of Confirmation and Packing Slips, copies of which are attached hereto, marked Exhibit "2", and made a part hereof. 6. Defendant received and accepted the aforementioned goods, wares and merchandise. 7. The prices charged by Plaintiff were the fair, reasonable, and market prices that prevailed at the times of the transactions. 8. Plaintiff avers that the balance due amounts to $5,994.88, as is more specifically shown by Plaintiffs Statement, a true and correct copy of which is attached hereto, marked Exhibit "3", and made a part hereof. 10. Plaintiff claims service charges as damages on the liquidated debt from December 3, 2008. 11. Plaintiff avers that service charges amounts to $508.34 to August 17, 2009. 12. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and refused to pay the aforesaid balance, service charges, or any part thereof to Plaintiff.
