MOTION TO MAKE CITATIONS ABSOLUTE ~%
AND TO GRANT LETTERS OF ADMINISTRATION
AND NOW comes Brian K. Peters, the petitioner in the above matter, and moves the Court as
follows:
1. The moving party herein is Brian K. Peters, who filed a petition for letters of administration
with the Register of Wills of Cumberland County on 31 July 2009.
2. The respondents herein are the other five children of the decedent, Louise Romaine Kimmel.
They are Vanessa A. Peters, Chris A. Peters, and Tina L. Peters.
3. On 31 March 2009, Brian K. Peters filed his petition for letters of administration. In that
petition he requested the Register of Wills to issue a citation upon the respondents to show cause why
he should not be granted letters of administration.
4. On 3 August 2009, the Register of Wills issued her citation to the respondents in accordance
with Brian K. Peters' petition. The citation required the response of the respondents within 20 days
from the date of the citation. A copy of that citation is attached hereto and marked as Exhibit A.
5. The citations were duly served upon the respondents by regular mail. None of the citations
served by regular mail have been returned by the United States Postal Service.
6. None of the respondents have filed any response with the Register of Wills.

7. More than 20 days have passed since the issuance of the citation. More than 20 days have
passed since the citation was served upon all of the respondents.
WHEREFORE, Brian K. Peters, by his attorney, respectfully moves the Register of Wills of
Cumberland County to issue letters of administration to him in accordance with his original petition and
the documents attached thereto.
