Jeffrey S. Zinn's Petition to Settle a Small Estate Pursuant to the Probate, Estate and Fiduciaries
Code Act of 1972, Section 3102, in the Estate of Merriam A. Burns, it is hereby ORDERED that
an Order and Decree of Distribution is entered, awarding to Petitioner the UNUM survival
benefit check in the amount of Three Thousand Seven Hundred Forty-Seven Dollars and
Seventy-Five Cents ($3,747.7 5), as agent of Decedent's Estate, for purposes of cashing the
check, then distributing the cash as follows: ~

PETITION TO SETTLE A SMALL ESTATE PURSUANT TO THE PROBATE,
ESTATE AND FIDUCIARIES CODE, ACT OF 1972, SECTION 3102
TO THE HONORABLE JUDGES OF THE COURT OF COMMON PLEAS OF
CUMBERLAND COUNTY, ORPHANS' COURT DIVISION:
Petitioner, Jeffery S. Zinn, son of the deceased, and a party in interest, by his attorneys,
Caldwell & Kearns, P.C., respectfully represents the following matters:
1. Petitioner, Jeffery S. Zinn ("Petitioner"), is an adult individual residing at 325
Hemlock Road, Mechanicsburg, Cumberland County, Pennsylvania, 17055.
2. Petitioner is the son of the decedent, Merriam A. Burns ("Decedent")
3. Decedent died intestate on March 29, 2009. Decedent's Death Certificate is
attached hereto and incorporated herein as Exhibit "A".
4. At the time of her death, Decedent was domiciled at Manor Care Health Services
nursing home located at 940 Walnut Bottom Road, Carlisle, Pennsylvania, 17013.
5. Decedent had been a resident of Manor Care Health Services nursing home in

7. In addition to Petitioner Jeffery S. Zinn, Decedent was the parent of two other
children, both of whom are adults and are identified as:
Ronald Weigle Cherri Cribari

Dillsburg, PA 17019 Dillsburg, PA 17019
8. For the reason that the assets of the Estate do not amount to Twenty-Five
Thousand Dollars ($25,000.00), this Estate has not been offered for administration.
9. Petitioner is a party in interest under the provisions of Section 3102 of the
P.E.F. Code in view of the fact that he is the child of Decedent and a beneficiary of Decedent's
Estate.
10. Decedent did not own an interest in real estate.
11. Decedent's Estate consists of the following:
a. UNUM Extended Disability Benefits final benefit totaling Eight Hundred
Thirty-Nine Dollars and Ninety-Three Cents ($839.93); and
b. UNUM Life Extended Disability Benefits survivor benefit totaling Three
Thousand Seven Hundred Forty-Seven Dollars and Seventy-Five Cents ($3,747.75).
Please see Exhibit "B".
12. All of Decedent's interest in the foregoing assets does not exceed the sum of
Twenty-Five Thousand Dollars ($25,000.00).
13. Claims against the Estate are the following:
a) the remaining amount owed to Cocklin Funeral Home, Inc. in the amount
of One Thousand Nine-Hundred Ninety-Three Dollars and Thirty Cents
($1,993.30).

b) Stonemor Partners, L.P. for the opening of the grave at Cumberland Valley
Memorial Gardens and for the grave marker in the amount of Two
Thousand Seven Hundred Ninety-one Dollars ($2,791.00); and
c) Caldwell & Kearns, P.C. attorney fees in the amount of One Thousand
Dollars ($1,000).

14. Petitioner caused to be filed the Pennsylvania Inheritance Tax Return and no
inheritance tax is due on the property to be awarded under this Petition. A copy of the Receipt
from the Register is attached hereto and incorporated herein as Exhibit "D".
15. Petitioner has paid the final benefit check received from UNUM in the amount of
Eight Hundred Thirty-Nine Dollars and Ninety-Three Cents ($839.93) to Cocklin Funeral Home,
Inc.
16. Petitioner is currently holding the survivor benefit check from UNUM, which is
payable to the Estate of Merriam A. Burns, in the amount of Three Thousand Seven Hundred
Forty-Seven Dollars and Seventy-Five Cents ($3,747.75).
17. The remaining amount owed of One Thousand Two Hundred Eight Dollars and
Fifty-Five Cents ($1,208.45) owed to Stonemor Partners, L.P. and One Thousand Dollars
($1,000) to Caldwell & Kearns, P.C. will be paid by Petitioner, Jeffery S. Zinn, Ronald Weigle
and Cherri Cribari out of their own funds.
18. Ronald Weigle and Cherri Cribari have been provided with a copy of this Petition
and have given their written consent. Copies of the Consents are attached hereto and
incorporated herein as Exhibits "E" and "F".

WHEREFORE, Petitioner respectfully requests that this Honorable Court enter an Order
and Decree of Distribution authorizing the transfer of the UNUM survival benefit check in the
amount of Three Thousand Seven Hundred Forty-Seven Dollars and Seventy-Five Cents
($3,747.75) to Petitioner, Jeffery S. Zinn, then distribution of the cash as follows:
1. One Thousand Nine Hundred Ninety-Three Dollars and Thirty Cents
($1,993.30) to Cocklin Funeral Home, Inc.; and
2. One Thousand Five Hundred Eighty-Two Dollars and Forty-Five Cents
($1,582.45) to Stonemor Partners, L.P.
