Benner. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402). Wilhide, et al., thence by said land now or formerly of Wayne K. Wilhide, et al., North 52 degrees 45 minutes 59 seconds West, 77.17 feet to an existing iron pin; thence by same, North 43 degrees 06 minutes 08 seconds West, 66.53 feet to an iron pin at corner of Lot No. 38 on the hereinafter described subdivision plan; thence by said Lot No. 38, North 73 degrees 25 minutes 13 seconds East, 197.08 feet to an iron pin in the western right-of-way line for Walleye Drive; thence in and along said right-of-way line for Walleye Drive by a curve to the left on a circle having a radius of 175 feet, for an arc distance of 38.99 feet, the chord of which is South 22 degrees 57 minutes 48 seconds East, 38.91feet to an iron pin; thence continuing along the western right-of-way line for Walleye Drive, South 29 degrees 20 minutes 48 seconds East, 53.21 feet to an iron pin at corner of Lot No. 36 on the hereinafter described subdivision plan, the point and place of BEGINNING. THE above description was taken from a final subdivision plan for North Middle Spring Estates by Eric L. Diffenbaugh, Professional Land Surveyor, which plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 91, at Page 61.
