MARTIN VS RICKY A. MARTIN STIPULATION AGAINST LIENS WHEREAS RICKY A. MARTIN entered into a contract with RICKY A. MARTIN AND N/A , to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of (a) building(s) upon those certain pieces or parcels of land situated in SOUTHAMPTON TOWNSHIP , CUMBERLAND County, Pennsylvania, being more particularly bounded and described as follows: Deed from Interfaith Housing Alliance, Inc., Dated 7-a0'09 and intended to be recorded preceding the recording of this stipulation to Ricky A. Martin. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402). Wilhide, et al., thence by said land now or formerly of Wayne K. Wilhide, et al., North 39 degrees 54 minutes 18 seconds East, 100.00 feet to an existing iron pin on line of Lot Nos. 36 on the hereinafter described subdivision plan; thence by said Lot No. 36, South 52 degrees 45 minutes 59 seconds East, 168.22 feet to an iron pin on the western right-of-way line for Walleye Drive; thence along the western right-of-way line for Walleye Drive by a curve to the right on a circle having a radius of 125.00 feet, for an arc distance of 11.62 feet, the chord of which is South 37 degrees 06 minutes 42 seconds West, 11.62 feet to an iron pin; thence continuing along the western right-of-way line for Walleye Drive, South 39 degrees 46 minutes 32 seconds West, 95.85 feet to an iron pin at corner of Lot No. '34 on the hereinafter described subdivision plan, the point of BEGINNING. THE above decription was taken from a final subdivision plan for North Middle Spring Estates by Eric L. Diffenbaugh, Professional Land Surveyor, which plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 91, Page 61.
