COMPLAINT IN MORTGAGE FORECLOSURE
I. Plaintiff is MANUFACTURERS & TRADERS TRUST COMPANY SIB/M TO KEYSTONE
FINANCIAL BANK, N.A., PO Box 840, Buffalo, NY 14240-0840.
2. The name(s) and addressees) ofthe Defendant(s) is/are ROSEMARY E. GRANT, 338 & 342 Walton
Street, Lemoyne, PA 17043, who is/are the mortgagor(s) and real owner(s) of the mortgaged premises
hereinafter described.
3. On June 23, 1993 mortgagor(s) made, executed and delivered a mortgage upon the premises hereinafter
described to FARMERS TRUST COMPANY, which mortgage is recorded in the Office of the Recorder
of Deeds of Cumberland County as Book: 1117 Page: 122. The mortgage has not been assigned unless
said assignment to the Plaintiff is hereafter mentioned. The aforementioned mortgage was assigned to:
MANUFACTURERS & TRADERS TRUST COMPANY S/B/M TO KEYSTONE FINANCIAL
BANK, N.A. by Assignment of Mortgage which Assignment is lodged for recording; and these
documents are matters of public record and are incorporated herein by reference in accordance with
Pennsylvania Rule of Civil Procedure 1019(g).
4. The premises subject to said mortgage is described as attached.
5. The mortgage is in default because monthly payment of principal and interest upon said mortgage due
December 29, 2003, and each month thereafter are due and unpaid, and by the terms of said mortgage,
upon default in such payments for a period of one month, the entire principal balance and all interest due
thereon are collectible forthwith.
6. The following amounts are due on the mortgage:

7. The Attorney's Fees set forth above are in conformity with the Mortgage documents and Pennsylvania
law, and, will be collected in the event of a third party purchaser at Sheriff's Sale. If the Mortgage is
reinstated prior to the Sale reasonable Attorney's Fees will be charged based on work actually
performed.
8. Notice of Intention to Foreclose and a Notice of Homeowners' Emergency Mortgage Assistance has
been sent to Defendant( s) by Certified and regular mail, as required by Act 160 of 1998 of the
,Commonwealth of Pennsylvania, on the date(s) set forth in the true and correct copy of such notice(s)
attached hereto as Exhibit "A". The Defendant(s) haslhave not had the required face-to-face meeting
within the required time and Plaintiff has no knowledge of any such meeting being requested by the
Defendant(s) through the Plaintiff, the Pennsylvania Housing Finance Agency, or any appropriate
Consumer Credit Counseling Agency.
WHEREFORE, Plaintiff demands an in rem judgment in mortgage foreclosure in the sum of $44,623.83,
together with interest at the rate of $4.28, per day and other expenses incurred by the Plaintiff which are
properly chargeable in accordance with the terms of the mortgage, and for the foreclosure and sale of the
mortgaged premises.

Pennsylvania Rule of Civil Procedure No. 1035.1 et seq. for the following reasons:
I. Plaintiff is MANUFACTURERS & TRADERS TRUST COMPANY S/B/M TO

"Plaintiff").
2. Defendant is ROSEMARY E. GRANT (hereinafter "Defendant").
3. Plaintiff filed its Complaint in mortgage foreclosure on May 24, 2004. A true and
correct copy of the Complaint is attached hereto as Exhibit A.
4. Defendant filed and Answer on or about June 25, 2004, which does not raise any
issue of material fact. True and correct copy of the Answer is attached hereto as Exhibit B.

5. Plaintiff has attached an Affidavit to the instant Motion that avers all facts
necessary to prove a prima facie case in mortgage foreclosure and that corroborates the facts as

4. The mortgage is held by Plaintiff. The mortgag'~ was assigned to
MANUFACTURERES & TRADERS TRUST COMPANY S18./M TO KEYSTONE FIANCIAL
BANK N.A. which Assignment is lodged for recording; and these documents are matters of
public record and are incorporated herein by reference in accordlillce with Pennsylvania Rule of
Civil Procedure 10 19(9).
5. The Mortgage is in default because monthly payments of principal and interest
due December 29, 2003 and each month thereafter are due and unpaid. At no time from
December 29,2003 to the present has the Defendant tendered the amount of payments required
to bring the Mortgage current and I have at all times been willing to accept same.
6. Notice of Intention to Foreclose and a Notice ofHomt:owners' Emergency Mortgage
Assistance has been sent to Defendant by Certified and regular mail, as required by Act 160 of
1998 of the Commonwealth of Pennsylvania, on the date(s) set forth in the true and correct copy
of such notice is attached hereto as Exhibit "A". The Defendant has not had the required face-to-
face meeting within the required time and Plaintiff has no knowi<:dge of any such meeting being
requested by the Defendant through the Plaintiff, the Pennsylvania Housing Finance Agency, or

Mortgagors and Real Owners of the real property located at)38 & 342 Walton Street, Lemoyne,
PA 17043 ("Property").
Plaintiff filed a Complaint and Defendant filed an Answer. Plaintiff has now moved for
Summary Judgment and this memorandum is offered in support of Plaintiff's Motion.
This memorandum is offered in support of the Motion.
II. LEGAL ARGUMENT
Summary judgment is govemed by Pa.R.C.P. 1035.1 ~et. ~, Pa.R.C.P. 1035.2 provides
that "After the relevant pleadings are closed, but within such time as not to unreasonably delay trial,
any party may move for summary judgment.... " Summary judgment is appropriate to be entered:
(1) whenever there is no genuine issue of any material fact as to a necessary element of the cause of
action or defense..." Pa.R.C.P. 1035.2(1). Pa.R.C.P. No. 1141 notes that the foregoing assumpsit
rule shall apply to Actions of Mortgage Foreclosure.
Pa.R.C.P. 1035.2(2) requires the party who opposes the motion to provide the Court, in
response to the motion, with "...evidence of facts essential to the. . . defense which, in a jury trial,
would require the issues to be submitted to a jury." Specifically, Pa.R.C.P. 1035.3 states, in
pertinent part:
(a) The adverse party may not rest upon the mere allegations or deuials of the pleadings but
must file a response within thirty days after service of the motion identifying
(I) one or more issues of fact arising from evidence in tne record controverting the evidence
cited in support of the motion or from a challenge to the credibility of one or more witnesses
testifying in support of the motion...
Plaintiff has included an affidavit in support of its Motion for Summary Judgment, pursuant
to Pa. R. C. P. 1035.4, which states in relevant part:
Supporting and opposing affidavits shall be made on personal
knowledge, shall set forth such facts as would be admissible
in evidence, and shall show affirmatively that the signer is
competent to testify to the matters stated therein. Verified or
certified copies of all papers or parts thereof ref<::rred to in an
affidavit shall be attached thereto or served th(:rewith. The
court may permit affidavits to be supplemented or opposed
by depositions, answers to interrogatories, or further
affidavits.
The only issue before the Court is whether Defendant's Answer raises any legal or factual
issue, which provides a basis for denying Plaintiff its request for summary judgment. Plaintiff
respectfully suggests it does not.
Defendant admits paragraphs 1, 2, 4 and 3 in part of the Complaint, specifically the
identities of the parties, the making, execution, and delivery of the mortgage in question of the
Property.
In paragraph 3 of the Answer, Defendants deny for lack of knowledge the assignment of the
mortgage. The execution and non-assignment of the mortgage, the recording information and the
legal description of the Property are matters of public record Ilnd may not be denied for lack of
knowledge. See. Goodrich vs. Amram 2d. Section 1029(c):1 ato.p. 279-80. Accordingly, said lack
of knowledge denials constitute admissions. Moreover, there is absolutely no requirement that a
mortgage document be attached to the Complaint. See, Pa.R.C.P. 1019(g).
Paragraphs 5 and 6 of the Complaint contain the specifil; averments of default and amounts
due and owing upon the mortgage required to be averred in ac:tions of mortgage foreclosure as set
forth in Pa.R.C.P. No. 1147(4) and (5).
Defendants answer these specific averments by invoking general denials under Pennsylvania
Rule of Civil Procedure 1029.
The lack of specific, detailed response to Plaintiffs specific averments of defaults constitutes
an admission of the default and amounts due and owing upon the mortgage. See. New York
Guardian Mortgagee COfOOration vs. Dietzel. 362 Pa. Super 426,524 A2d 951 (Pa. Super 1987).
Thus, while Defendants default is a legal conclusion, Plaintiff respectfully suggests this
honorable Court should conclude, based upon the deemed admissions of the Defendant and the
verified facts of Plaintiff in its affidavit in support of its Motion" that Plaintiff is entitled to summary
judgment.
Defendant, contrary to her unsupported allegation in paragraph 5 of her response, has never
offered the total amount necessary to reinstate the mortgage. Plaintiff would gladly accept full
reinstatement under the mortgage, as it is likely to suffer a loss if this litigation continues.
Moreover, as this is a conventional loan, Plaintiff is under no lc:gal duty to accept less than the full
arrears unless settlement negotiations led to a new contract. Once the entire loan is accelerated,
partial payments cannot cure the default. The Ministers and Missionaries Benefit Board. etc. vs.
Goldsworthv. 385 A2d 358 (Pa. Super. 1977).
Defendants general denials regarding/allegations that tht: damages are incorrectly calculated
is not a basis to deny Plaintiff judgment as a matter of law. Default in an action of mortgage
foreclosure is an absolute. Once default under the terms of the mortgage has been established, the
court must enter judgment in favor of the holder of the mortgage. The question of accounting is
saved for another day, specifically, after a Sheriffs Sale of tht: Property. The Supreme Court of
Pennsylvania held in Landau vs. Westem Pennsvlvania Nationall Bank, 445 Pa. 217, 282 A.2d. 335
(1971):
The mortgagors are unquestionably entitled to an accounting, but that
accounting is not due until the property is sold at Sheriffs Sale and
distribution of the proceeds is made. Judgment in mortgage
foreclosure action must be entered for a sum certain or no execution
could ever issue on it. 445 Pa. at 226, 282 Ad. at 335.
This Supreme Court decision directs a court to enter summary judgment in favor of the
p1aintift7mortgagee where the defendant/mortgagor admits the default upon the mortgage. Landau
vs. W. Pa. Nat. Bank. 455, Pa. 217, 255-266, 282 A. 2d 335, 340 (1971).
Pennsylvania Courts have long and repeatedly upheld the reasonableness and enforceability
of a request in an action of mortgage foreclosure for attorne)~s fees equal to 5% of the principal
balance of the mortgage as demanded in Plaintiff's Complaint at paragraphs 6 and 7. Robinson vs.
Loomis. 51 Pa. 78 (1865); Galligan vs. Heath. 260 Pa. 457 (1919); Foulke vs. Hatfield Fair Grounds
Bazaar. Inc.. 196 Pa. Super Ct, 155 (1961); First Federal S&L Assn. vs. Street Road Shopving
Center, 68 D & C 2d 751, 75 (Bucks County) (1974).
Moreover, as further explained in Paragraph 7 of Plaintiff's Complaint, the attorney's fees
demanded in Paragraph 6 of Plaintiff's Complaint would only be collected in the event of a third
party purchaser at Sheriff's Sale. Defendant continues to have the option of paying all arrears and
costs up to one hour before the Sheriff's Sale in conformity wiith the provisions of Act 6 in which
case attorney's fees will be assessed based on work actually performed. See. Pennsylvania Act 6 of
1974,41 P.S. Section 401 et. seo.
Defendant moves on to deny paragraph 8 of the Complaint by stating she has insufficient
knowledge the required Act 91 notices were received. This denial is insufficient, as Plaintiff did not
aver that Defendant receives the Act 91 notice. Plaintiff complied with Act 91, averred that fact in
its Complaint, verified that fact under penalty of peIjury on two occasions and attached copies of the
Act 91 Notice to its Complaint. The required Act 91 Notice was sent by Plaintiff on April 7, 2004
(See, Exhibit A of Complaint). The law only requires that Ithe Act 91 Notice be sent and not
necessarily received. See, 35 P.S. 1680.403(c)(a).
II. CONCLUSION
All material averments of the within motion are verified in the attached signed and sworn
affidavit pursuant to PaR.c.p. No. 1035. Defendant cannot simply rely upon the averments of the
Answer to raise an issue of fact. Phaff vs. Gardner. 45]1 Pa. 146, 303 A2d 352 (1973).
Accordingly, Defendants answer admits all material facts, ther,e are no issues of material fact and
the Court should grant Plaintiff's Motion for Summary Judgment.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court enter judgment in
its favor and against Defendant as prayed for in Plaintiffs Complaint.

DEFENDANT'S ANSWER TO PLAINTIFF'S MOTION FOR
SUMMARY JUDGMENT
AND NOW, comes Defendant, ROSEMARY E. GRANT, (hereinafter referred to
as the "Defendant"), and moves this court for denial of Plaintiff's Motion for Summary
Judgment in accordance with Pennsylvania Rules of Civil Procedure NO.1 035.1, et
seq., for the following reasons:

4. Admitted in part and denied in part. It is admitted that Defendant on or about
25 June 2004 filed an Answer to Plaintiff's Complaint in the above action. It is
denied that said Answer does not raise any issue of material fact. In Defen-
dant's Answer, it was stated that the Defendant dial not have sufficient informa-
tion as to the correctness of the averments of the amounts due on the mortgage
as set forth in Paragraph 6 of Plaintiff's Complaint. Defendant, from and after
December 2003, requested of Plaintiff, both in writing and by telephone, through
various of its representatives, whose names and telephone numbers in Buffalo,
New York, apparently Plaintiff's principal place of business, had been provided
to Defendant requesting a specific listing of the application of all payments of
principal and interest and escrow tax account theretofore made by Defendant to
Plaintiff on the subject mortgage so that Defendant could determine that all of
the payments she had theretofore mC!de had been applied to the indebtedness.
Despite such repeated requests, Plaintiff failed to provide to Defendant any such
specific listing of payments made by Defendant. Defendant also had been
working with officers of M& T Bank, an affiliated and commonly owned business
of Plaintiff. Defendant made a payment of Thirty Thousand Dollars ($30,000) on
or about 4 June 2004 to M&T Bank, with the request and expectation that
officers of M&T Bank would make a payment on account of the mortgage debt to
Plaintiff so as to attempt to effect a global settlement repayment schedule of all
of the indebtedness owed by Defendant to Plaintiff and its related entity bank of
M& T Bank. Defendant has been advised and therefore avers that despite the
best efforts of officers and attorneys for M&T Bank, they have been unable to
reach any such settlement with Plaintiff. While the Affidavit accompanying
Plaintiff's Motion for Summary Judgment makes the bold assertion in Paragraph
7 thereof that the amounts due on the said mortga'ge as of the date of the filing
of the Complaint was Forty-Four Thousand Six Hundred Twenty-Three Dollars
and Eighty-Three Cents ($44,623.83), there is no substantiation offered thereof
or any form of an amortization schedule and a specific date, time and amount of
the installments theretofore made by Defendant to Plaintiff on said mortgage
indebtedness. Defendant believes and therefore alvers that not all of her
payments made to Plaintiff on account to Plaintiff under said mortgage were
correctly applied, in part as said mortgage was ori~,inally entered into by Defen-
dant with Farmers Trust Company on 23 June 199:3, which by subsequent bank
and bank holding company mergers was then assi(jned to no less than two
successor mortgagee entities before being assigned to Plaintiff. In order to
prevail in the granting of summary judgment, Plaintiff, which bears the burden of
proof in this instance, must produce evidence of facts central to the cause of

action and must demonstrate that there are no material issue of facts in dispute.
Plaintiff has failed to meet that standard in this instance. See Defendant's
Affidavit attached hereto.
5. Defendant's Answer to Plaintiffs Paragraph 4 in Plaintiff's Motion for Summary
Judgment set forth above is incorporated herein. As further answer to said
Paragraph 5 is the Affidavit attached to Plaintiff's Motion which fails to aver all
facts necessary to prove a prima facie case and t'D corroborate the facts as pled
in Plaintiff's Complaint. See Defendant's Affidavit attached hereto.
WHEREFORE, Defendant requests this Honorable Court dismiss Plaintiff's
Motion for Summary Judgment and deny the grant of Summary Judgment to Plaintiff.

PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT
ROSEMARY E. GRANT, being duly sworn accordling to law, deposes and says:
1. I am the Defendant, Mortgagor and record owner in the above-captioned action.
(hereinafter the "Defendant").
2. I have personal knowledge of the matters referred to in Defendant's Answer to
Plaintiff's Motion for Summary Judgment and as Slst forth below, I make this
Affidavit in support of Defendant's Answer to Plaintiff's Motion for Summary
Judgment, and that the facts set forth below are a,jmissible in evidence and I am
competent to testify to the matters stated herein.
3. Defendant, from and after December 2003, requested of Plaintiff, both in writing
and by telephone, through various of its representatives, whose names, ad-
dresses and telephone numbers in Buffalo, New York, apparently Plaintiff's
principal place of business, had been provided to Defendant requesting a
specific listing of the application of all payments 01' principal, interest and escrow
amounts theretofore made by Defendant to Plaintilff on the subject mortgage so
that Defendant could determine that all of the payments she had theretofore
made had been applied to the indebtedness and on account of real estate taxes.

telephone or via E-mail, to Defendant any such sp,scific listing of payments made

5. Defendant also had been working with officers of M&T Bank, an affiliated and
commonly owned business of Plaintiff, to resolve past due amounts owed M&T
Bank on several commercial loans.
6. Defendant made a payment of Thirty Thousand Dollars ($30,000) on or about
4 June 2004 to M&T Bank, with the request and Elxpectation that officers of M&T
Bank would make a payment on account of the mortgage debt to Plaintiff so as
to attempt to effect a global settlement repayment schedule of all of the indebt-
edness owed by Defendant to Plaintiff and its related entity bank of M&T Bank.
7. Defendant has been advised that despite the best efforts of officers and attor-
neys for M& T Bank, they have been unable to reach any such settlement with
Plaintiff.
8. While the Affidavit accompanying Plaintiffs Motion for Summary Judgment
makes the bold assertion in Paragraph 7 thereof t11at the amounts due on the
said mortgage as of the date of the filing of the Complaint was Forty-Four

9. Defendant believes that not all of her payments m1lde to Plaintiff on account
under said mortgage were correctly applied, in part as said mortgage was
originally entered into by Defendant with Farmers Trust Company on 23 June
1993, which by subsequent bank and bank holdinf;1 company mergers was then
assigned to no less than two successor mortgagee entities before being as-
signed to Plaintiff.
10. Further, Defendant believes that Plaintiff has not h'::mored the terms and condi-
tions of the 23 June 1993 mortgage in that the intel"est rate adjustments have not
been complied with in accordance with said mortgclge.
11. In the Spring of 2004, Defendant made two monthl)1 mortgage payments to
Plaintiff, which Defendant was told were refused, blJt said payment checks were
never returned to Defendant and were cashed by Plaintiff.
12. Defendant received a letter, dated 5 April 2004, from Kim Stewart, Senior
Mortgage Counselor, Collections Department of Plaintiff, advising Defendant

that Plaintiff was affording her as a courtesy assistance in exploring alternatives
in connection with meeting her mortgage obligations. See Exhibit 1 attached
hereto.
13. Defendant responded to Kim Stewart's letter, Exhibit 1, by providing all re-
quested information.
14. Defendant next received two letters, both dated 5 May 2004, from Mark Hall,
Credit Counselor, Collection Department of Plaintiff, advising Defendant to send
further tax return information and acknowledging receipt of Defendant's "workout
package." See Exhibits 2 and 3 attached hereto.
15. Subsequently, Defendant was advised orally by Mr. Jesse Rogers that her
request for a workout was denied.
16. Thereafter, Defendant received a letter, dated 13 May 2004, from Plaintiffs
Foreclosure Department advising that Defendant's mortgage documents were
forwarded to Plaintiff's attorneys for foreclosure proceedings. See Exhibit 4
attached hereto.
17. Thereafter, with no further notice and with no opportunity to continue discussions
with Plaintiff and with Plaintiff continuing to refuse to provide Defendant with any
substantiation of the applications by Plaintiff of Delfendant's payments to Plain-
tiff, Plaintiff caused the instant foreclosing proceedings to be commenced on
24 May 2004.
18. Meanwhile, Defendant received a letter, dated 8 JlJly 2004, from said
Mr. Rogers, Specialist, Loss Mitigation of Plaintiff, regarding workout options, to
which Defendant replied to said Mr. Rogers by her letter, dated 16 July 2004.
See Exhibits 5 and 6 attached hereto.
19. Defendant has had no further correspondence with Plaintiff since 16 July 2004.
See Exhibit 6 attached hereto.
20. Defendant continues to request Plaintiff make available to her a schedule of
payments made by her on said mortgage so she cain determine, and challenge if
necessary, that Plaintiff has correctly applied all payments made by her on
account of the above mortgage indebtedness.

21. Defendant continues to request Plaintiff to negotiate with her to achieve a
mutually agreeable workout package so as not to lose her home and principal
residence to Plaintiff's foreclosure.

This is in response to your July 8, 2004 letter regarding my status.
My attorney, William E. Miller, Jr. and I met with Keith P. Mangan, Vice President of
M&T and Matt Eshelman, M & T Attorney, to review the outstanding debt I owe M & T and
agreed upon steps I need to take to get back on track. In additie.n, the lawsuit with Frank
Piscioneri / Presence was settled in full by payment of $42,000, payable to Miller & Associates,
P .C. (my attomey's firm), Mr. Miller hand delivered a check to Matt Eshelman, Attorney for M
& T, payable to Manufacturers & Traders Trust Company in the amount of $30,000, These
proceeds were distributed against debts with Manufacturers & Traders Trust Company,
overseen by Keith P. Mangan, V.P. and my home mortgage loan 0009794322. I did not
receive 'one cent nor one dollar" from the settlement payment as the balance currently resides
in escrow and most likely will be payment for the attorney's fees.
I am desperately interested in keeping my home that I hav,a been paying on since March
of 1983. The information provided by fax and through our previous telephone discussion
remain the same. I would like to explore the possibility of extending the maturity date of the
mortgage loan from 2008 to perhaps 2014 or 2015. The reduction in the payment amount
would be extremely helpful for me in making my payments to M & T Trust Company and M & T
Mortgage Corporation.
I would be available to talk with you momings before 11 :00 A.M. and during the day on
Tuesdays and Wednesdays (my weekend) while currently employ'ed with Home Depot. Please
