WHEREAS, STEPHEN J. PITTENGER AND PAULA K. PITTENGER, are about
to execute contemporaneously herewith a contract with D. CULLY INC. DB/A C & C
CONSTRUCTION, for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN TRACT of land situate, lying and being in East Pennsboro Township,
Cumberland County, Pennsylvania, being known as Center Street, Lot 5, Plan for East
Pennsboro Township, Plan Book 80 Page 150, Parcel No. 09-16-1052-073 and having a address
of : 821 Center Street, Enola, PA. 17025
Now, 1 y , 2009, at the time of and immediately before the execution of the principal
contract, an before any authority has been given by the said owners to the said contractor to
commence work on the said building, or purchase materials for the same in consideration of the
making of the said contract with contractor and the further consideration of One ($1.00) Dollar
to contractor paid by owner, it is agreed that no lien shall be filed against the building and/or
land by the contractor, or any subcontractor, nor by any of the material men or worlanen or any
other person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
