Klemm and the law offices of Nudelman, Nudelman & Ziering, P.C., and files the following Complaint in Civil Action and in support thereof aver as follows: 1. Plaintiff, CAPITAL ONE BANK (USA), N.A., is a foreign business corporation located at 4851 Cox Road, Glen Allen, VA 23060. Pursuant to 15 Pa. C.S.A. § 4122, "a foreign business corporation shall not be considered to be doing business in this Commonwealth for the purposes of this subchapter by reason of carrying on in this Commonwealth any one or more of the following acts ... (8) [s]ecuring or collecting debts or enforcing any rights in property securing them [or] (9) [t]ransacting any business in interstate or foreign commerce." NN54406 2. Defendant, WESLEY O WEAVER, is an individual and citizen of the Commonwealth of Pennsylvania, who is believed to currently reside at, 1007 BRENTWATER RD, CAMP HILL PA 17011-1508. 3. At the special insistence and request of the Defendant, Defendant was issued a credit card by CAPITAL ONE BANK (USA), N.A., account number 5178052495548345. 4. The Defendant is responsible for an unpaid balance in the amount of $7,837.76 and interest in the amount of $442.97. 5. Plaintiff has made demand to Defendant for $8,280.73, but Defendant has willfully failed and/or refused to reimburse Plaintiff for the aforesaid sum due. Wherefore, Plaintiff demands Judgment in its favor and against the Defendant in the amount of $8,280.73 and interest from the date of breach, with continuing interest thereon at the legal rate from the date of Judgment plus anticipated court costs.
