PETITION FOR THE AWARD OF AN ESTATE OF A MINOR
WITHOUT THE APPOINTMENT OF A GUARDIAN
This petition is filed to request the award of an estate of two minors without the
appointment of a guardian or the entry of securtiy persuant to §5101 of the Probate, Estates and
Fiduciaries Code, 20 Pa.C.S. §5101:
1. The identity of the minors are Elizabeth M. Halford, who is 11 years of age and
was born on August 6, 1998; and, Amanda R. Halford, who is 7 years of age and born on
October 18, 2001. Both minors reside with their parents at 708 16th Street, New Cumberland,
Cumberland County, Pennsylvania.
2. The minors' natural and custodial parents are David S. Halford and Jeannie M.
Halford, who also reside at 708 16th Street, New Cumberland, Cumberland County,
Pennsylvania.
3. This petition is by said David S. Halford and Jeannie M. Halford, the natural and
custodial parents of the minors, and who again, reside with the minors at 708 16th Street, New
Cumberland, Cumberland County. Pennsylvania.
4. The minors have no guardian of their estate, and the appointment of a guardian for
their estates is necessary because the minars each are entitled to recieve from the Lincoln Finacial
Group under Annuity Contract No. 95-4036779, owned by their grandfather, James D. Halford,
deceased, the amount of $11,000, and said Lincoln Financial Group will not release said funds, being
over $10,000 per beneficiary, without Court order.
5. The net value ofthe monies owedto each ofthe minors from Linclon Financial Group
is $11,000 and the minors have no other separate estate, either real or personal, and therefore, the
amounts do not exceed the statutory limit of $25,000 as set by §5101 of the Probate, Estates and
Fiduciaries Code, 20 Pa.C.S. §5101.
b. Petitioners will deposit the awarded annuity proceeds in interest bearing accounts at
the New Cumberland Federal Credit Union at its office located at 345 Lewisberry Road,
New Cumberland, Cumberland County, Pennyslvania.
7. Said accounts will be titled in the name of each minor, noting on the records of said
accounts that they are subject to the express restriction that no withdrawals may be made from such
account until the minor attains the age of majority except as authorized by Court Order.
Petitioners will, within 20 days of the deposit at the New Cumberland Federal Credit
Union, file with the Court of the record in this proceeding, evidence of the marking of such account
restrictions.
WHEREFORE, your petitioners requestthat the Court issue an orderto the Lincoln Financial
Group that the proceeds of the Annuity Contract No. 95-406779 for the beneftit of the respective
minors, Elizabeth M. Halford, and Amanda R. Halford be made payable to the petitioners herein for
deposit into restrictive accounts denying withdrawals from said accounts without court order until
the attainment of majority by the respective minor has been reached.
