IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. ~2~/-~-7 2004 ,/~ ~"-~ MECHANICS' LIEN STIPULATION AGAINST LIENS WHEREAS, Owners have entered into an Agreement dated MAY 6, 2004, as the same may be amended, modified or supplemented from time to time ("Contract"), with Contractor to provide materials and perform labor necessary for TENANT IMPROVEMENTS FOR LIBERTY MUTUAL at that certain commercial office building known and numbered as 275 Grandview Drive, Camp Hill, Pennsylvania, which situate upon that certain lot or piece of ground owned by Owner and located in East Pennsboro Township, Cumberland County, Pennsylvania, which is more particularly described on Exhibit "A" attached hereto. NOW, THEREFORE, it is hereby stipulated and agreed by and between Owner and Contractor, as part of the Contract and for the consideration therein set forth, that neither the undersigned Contractor, any subcontractor or materialman, nor any other person furnishing labor or materials to the Contractor under the Contract may file a lien or claim, commonly called a mechanics' lien or mechanics' lien claim, for work done or materials furnished under the Contract or any part thereof. This Stipulation is made and intended to be filed with the Prothonotary for the County of Cumberland, Commonwealth of Pennsylvania, in accordance with the requirements of Section 402 of the Mechanics' Lien Law of 1963, 49 Pa.C.S. ~ 1402. HEAGY Title: Title: H:\STIPULATION AGAINST LIEN SgffEAG Y STIPULATION AGAINST LEINS DOC EXHIBIT "A" Ail THAT CERTAIN piece or parcel of land with the buildings and improvements thereon erected lying and situate in the Township of East Pennsboro, County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the western side of Erford Road, said point being the northwestern intersection of Erford Road and a 60 foot wide street known as Grandview Road (formerly known as Moose Road); thence along the north side of said Grandview Road South 66 degrees 48 minutes 45 seconds West a distance of 409.30 feet to a point; thence by lands now or formerly of the Charles A. Holmes Estate North 17 degrees 56 minutes 15 seconds West a distance of 355.0 feet to a point; thence by same North 72 degrees 03 minutes 45 seconds East a distance of 104.54 feet to a point; thence by same North 28 degrees 03 minutes 44 seconds West a distance of 219.19 feet to a point; thence by lands now or formerly of the Pennsylvania State Education Association North 68 degrees 08 minutes East a distance of 390.60 feet to a point; thence along the western line of Erford Road South 09 degrees 00 minutes 45 seconds East a distance of 190.98 feet to a point; thence by same and a curve to the left having a radius of 1,756.43 feet, an arc length of 372.58 feet to a point, the place of BEGINNING. CONTAINING 5.0 acres. The above description was prepared by D. P. Raffensperger Associates, Inc., Camp Hill, Pennsylvania, under date of December 6, 1972, as a result of a survey made, and as amended by a further survey made by said D. P. Raffensperger Associates, Inc., under date of October 2, 1973, survey #D. I.-344.
