JURY TRIAL DEMANDED
AND NOW, come the Plaintiffs, Cynthia A. Thomas, by and through her
attorneys, Johnson, Duffie, Stewart & Weidner, and files this Complaint and in support
thereof avers as follows:
1. Plaintiff, Cynthia A. Thomas, is an adult individual residing at 4182 Elk
Court, No. 117, Mechanicsburg, Cumberland County, Pennsylvania 17050.
2. Defendant, Randal L. Bowles, an adult individual residing at 735 Tower
Road, Enola, Cumberland County, Pennsylvania 17025.
3. The parties hereto were involved in a relationship beginning in 1999.
4. In the Fall of 2001, the parties hereto jointly acquired real property known
and numbered as 803 Chester Road, Enola, Cumberland County, Pennsylvania 17025.

5. On May 31, 2006, the parties sold this jointly-owned real estate and
realized the proceeds from this sale at $31,795.52. A true and correct copy of the
HUD-1 Settlement Statement from said sale is attached hereto and incorporated herein
as Exhibit A.
6. The parties acquired the 803 Chester Road property in 2001 from the
Plaintiff's cousin at a reduced price, and sold 803 Chester Road in 2006 for $169,000.
7. The Defendant utilized the proceeds from the sale of the jointly-held
property at 803 Chester Road to purchase and construct a lot and home located at 735
Tower Road, Enola, Cumberland County, Pennsylvania.
8. The Defendant purchased the lot located at 735 Tower Road, from his
mother.
9. Prior to construction of the new home at 735 Tower Road, the parties
hereto went to Integrity Bank to get a construction loan. The Bank representatives told
the parties that they were unaware that they were not married and indicated that there
would be an additional $200 application fee for the Plaintiff.
10. Both parties indicated that they intended to be married in the future and
due to the added costs associated with putting the Plaintiff on the deed at that time, the
parties decided it was of no consequence.
11. At all times relevant hereto, it was the intent of the parties to be married
and in fact, referred to one another as fianc6 and, on occasion, the Defendant referred
to the Plaintiff as his wife.
12. The Defendant utilized the proceeds from the jointly-owned real estate
located at 803 Chester Road to acquire and construct a home at 735 Tower Road.
13. In October, 2008, the Defendant asked the Plaintiff for a separation, and
the Plaintiff left their home located at 735 Tower Road.
14. During the time in which the Plaintiff and Defendant cohabitated in the
Chester Road property and in the Tower Road property, the Plaintiff contributed to the
household expenses, as did the Defendant.
15. The parties hereto held title to the property located at 803 Chester Road
as joint tenants with the right of survivorship, further evidencing their intention to
formally marry in the future.
UNJUST ENRICHMENT
16. Paragraphs 1-15 are incorporated herein as if the same were set forth
fully.
17. Defendant's retaining the $31,795.52 and utilizing it to purchase the
property located at 735 Tower Road and by failing to divide that money equally with
Plaintiff, constitutes a benefit conferred upon the Defendant and acceptance and
retention of the benefit.
18. Under these circumstances, it would be inequitable for the Defendant to
retain the benefit without paying Plaintiff one-half (1/2) of the net proceeds from the sale
of 803 Chester Road.
19. To allow the Defendant to obtain the benefit would be unjust as the
Plaintiff was instrumental in acquiring the property located at 803 Chester Road,
contributed towards the every-day bills incident to ownership of said property, and
realized $31,795.52 from the sale of this jointly-owned real estate.
WHEREFORE, the Plaintiff prays this Honorable Court to enter a judgment in her
favor in the amount of $15,897.76 plus interest and costs.
CONTRACT IMPLIED IN LAW / QUASI-CONTRACT
20. Paragraphs 1-19 are incorporated herein as if the same were set forth
fully.
21. Due to the fact that Defendant has been unjustly enriched at the expense
of Plaintiff, the law implies that contract between the Plaintiff and Defendant.
22. The Plaintiff, by providing a benefit, must be compensated for the benefits
that have been unjustly received by the Defendant.
WHEREFORE, the Plaintiff prays this Honorable Court to enter a judgment in her
favor in the amount of $15,897.76 plus interest and costs.
CONTRACT IMPLIED IN FACT
23. Paragraphs 1-22 are incorporated herein as if the same were set forth
fully.
24. Over the years, by making representations to others that the Plaintiff and
Defendant will be married and by selling the Chester Road property which was owned
as joint tenants with the right of survivorship to acquire a new home in which the parties
were going to live and eventually be married creates a contract implied in fact.
25. The conduct of the Plaintiff and Defendant, as set forth herein, creates a
mutual agreement and intent to promise that has not been verbally expressed.
WHEREFORE, the Plaintiff prays this Honorable Court to enter a judgment in her
favor in the amount of $15,897.76 plus interest and costs.

ANSWER TO PLAINTIFFS COMPLAINT AND NEW MATTER
AND NOW, come the defendant, Randal L. Bowles, by and through his attorneys, Dethlefs-
Pykosh Law Group, LLC., and files this answer to plaintiffs complaint and new matter:

6. Admitted in part. Admitted that the parties acquired 803 Chester Road in 2001 and sold it in 2006 for
$169,000. Defendant is unable to determine at this time if the property was purchased at a reduced price
and therefore that averment is thereby denied and strict proof thereof is demanded at trial.
7. Admitted in part. It is admitted that a portion of the proceeds from the sale of the property located at
803 Chester Rd. was utilized in acquisition and construction of the home at 735 Tower Rd. To the extent
that the averment suggests the entire amount was used to purchase the property and construct the home, it is
denied and strict proof thereof is demanded at trial.
8. Admitted.
9. The Defendant is unable to verify the averements in this paragraph and therefore the averements are
deemed denied. Strict proof thereof is demanded at trial.
10. Denied. Defendant admits that at the time of the purchase the parties were engaged to be married, all
references to intentions related to the deed of the property is hereby denied and strict proof thereof is
demanded at trial.

803 Chester Rd. was utilized in acquisition and construction of the home at 735 Tower Rd. To the extent
that the averment suggests the entire amount was used to purchase the property and construct the home, it is

13. Admitted in part. Defendant admits that he asked for a separation. Defendant disputes that the
separation took place in October 2008 and contends that the separation occurred in December 2008.

NEW MATTER
JUSTIFICATION
26. Defendant solely provided a cash payment for the purchase of the property located at 803 Chester
Road, Enola, Cumberland County, Pennsylvania 17025 in the amount of $25,068.56. A true and correct
copy of the HUD-1 Settlement Statement from said purchase is attached and incorporated herein as
Defendant's Exhibit A.
27. Plaintiff did not provide any assistance with a down payment for the purchase of the property located at
803 Chester Road.
28. Plaintiff and Defendant rented back 803 Chester Road from the buyers following the sale of the
property.
29. Defendant paid the buyers $3,250.00 out of the proceeds of the sale of 803 Chester Road for rent
allowing the Plaintiff and Defendant to remain at the property following the sale.
30. Defendant paid Plaintiff $2,000.00 on December 6, 2008. A true and correct copy of check number
1530 is attached hereto and incorporated as Defendant's Exhibit B.
31. Defendant paid Plaintiff $1,000.00 on December 15, 2008. A true and correct copy of check number
1531 is attached hereto and incorporated as Defendant's Exhibit C.
32. Defendant was justified in not paying half of the proceeds of the sale of the property located 803
Chester Road to Plainfiff.
33. Defendant was entitled to retain from the proceeds of the sale the amount of the down payment
contributed solely by him at the time of purchase of the property.
34. Plaintiff s entitlement to half of the proceeds of the sale without allowing a setoff for money paid by the
Defendant for the purchase of the property would be inequitable.
WHEREFORE, the Defendant respectfully requests this Honorable Court enter judgment in favor of the
Defendant.
