y p ,comes the Plaintiff, Cargill Animal
Nutrition by their attorney, Bernard A. Yannetti, Jr., Esq., and files this Complaint and in
support thereof avers as follows:
1. The Plaintiff is Cargill Animal Nutrition, with its principal place of business
located at 512 West King Street, Shippensburg, Pennsylvania 17257.
2. The Defendant is Troy A. Waggoner, with an address of 440 Mt. Rock Road,
Newville, Pennsylvania 17241.
3. Plaintiff is a supplier of feed and nutrition materials for farming and other
operations.
4. Defendant is a farmer or other type of entrepreneur that requires materials that
Plaintiff supplies.
5. On or about April 24, 2008, Defendant purchased materials from Plaintiff on
credit. The Application for Line of Credit Request is attached hereto, made a part
hereof and marked Exhibit "A."
6. Defendant has purchased materials from the Plaintiff for which there remains an
unpaid balance as of this date in the amount of $19,101.72. Copies of the
invoices are marked Exhibit "B" attached hereto and made a part hereof.
7. Plaintiff has made repeated demands for payment of the amount of $19,101.72,
and despite repeated demands, Defendant has failed to pay his account.
8. Pursuant to the credit agreement, Defendant is responsible for attorneys' fees
associated with the collection of this debt as well as the additional costs and
expenses of collection.
9. Plaintiff has incurred attorney's fees and costs associated with the collection of
this debt and therefore makes a demand for reimbursement of the same.
WHEREFORE, Plaintiff demands judgment against Defendant in the amount of
$19,101.72, plus finance charges, costs, fees and attorney's fees associated with the collection of
the balance currently due.

4. In response to paragraph four Defendant admits that he is in the business of
raising milk cows.
5. In response to paragraph five Defendant admits that he has purchased certain
items on credit from Plaintiff.
6. In response to paragraph six Defendant denies that this is the sum of money due.
In further response, Defendant states that feed prices were increased without his
consent or pre notification each time there was a feed change.
7. In response to paragraph seven, Defendant admits that he has received copies of
invoices.
8. In response to paragraph eight Defendant neither admits nor denies this allegation
Ashe is without sufficient information to form a belief as to the assertions made
herein. To the extent required by court rule, Defendant denies the same as it is
untrue as plead.
9. In response to paragraph nine, Defendant is without sufficient information as to
form a belief as to the truth and veracity of the allegation. To the extent an
answer is required; Defendant denies the same as it is untrue as plead.
WHEREFORE, Defendant respectfully requests this court dismiss Plaintiffs
complaint with prejudice as to all matters contained therein, and assess costs for
Defendant for attorney fees so wrongfully incurred.
