FAMILY SETTLEMENT AND FINAL RELEASE IN
THE ESTATE OF HARVEY E. SHEAFFER. JR.
ESTATE NUMBER 21-08-1110
KNOW ALL MEN BY THESE PRESENTS, that:
WHEREAS, Harvey E. Sheaffer, Jr., late of Cumberland County, Pennsylvania,
died testate on October 18, 2008, having first made his last Will and Testament which
was duly executed on February 11, 1982; and,
V'JHEREAS, the said last Will and Testament named Doris Jean Wagner, Pauline
T. Calaman, Donna M. Calaman, Betty J. Cornman and Darlene L. Monismith, as
Executors of the Estate of Harvey E. Sheaffer, Jr.; and,
WHEREAS, Letters Testamentary were duly issued by the Register of Wills of
Cumberland County, Pennsylvania to Doris Jean Wagner, Pauline T. Calaman, Donna
M. Calaman, Betty J. Cornman and Darlene L. Monismith on November 12, 2008; and,
WHEREAS, the residue of the estate is available for distribution to the residual
beneficiaries, who are the decedent's daughters, Doris Jean Wagner, Pauline T.
Calaman, Donna M. Calaman, Betty J. Cornman and Darlene L. Monismith; and,
WHEREAS, the Executors have gathered the assets of the estate and paid all
known expenses of the estate and the sum of $13,000.00 is available for distribution at
this time; and,
WHEREAS, a small sum remains in the estate checking accountQp~rovid~r

WHEREAS, any sums remaining in the estate checking account after approval of
the Pennsylvania Inheritance Tax Return and the payment of any remaining expenses,
including some filing fees, the remaining sums shall be divided equally between Doris
Jean Wagner, Pauline T. Calaman, Donna M. Calaman, Betty J. Cornman and Darlene
L. Monismith.
NOW, THEREFORE, KNOW YE, that we, being the residual beneficiaries of
Harvey E. Sheaffer, Jr., do hereby acknowledge that we have each this day agreed to
receive from the aforesaid personal representative, in full satisfaction and payment of all
sum or sums of money, legacies, bequests, and devises as are given, devised and
bequeathed to us by Harvey E. Sheaffer, Jr., due to us under his said Last Will and
Testament, the sum of $2,600.00.
AND, we do hereby stipulate that in order to avoid the expense and time involved
in the filing of a formal account and schedule of distribution, we agree that no account is
necessary and we do hereby agree that we do consent to distribution being made
without the filing of an account and schedule of distribution, the same to be with the
same force and effect as if they had been filed and confirmed by the Orphans' Court
Division of the Court of Common Pleas of Cumberland County; and,
AND FURTHER, we do release the said executors from any and all claims
against them for their administration of this estate and any and all other matter affecting
the administration of the estate.
THEREFORE, we do hereby covenant and agree that should any liability come
due to the estate of the said decedent after the signing of this agreement, we covenant
and agree that we will pay any legally enforceable claims, demands, suits, or causes of
action which may be successfully prosecuted against the said estate or the aforesaid
personal representative after the signing, sealing and delivery of this family settlement
agreement and final release.
IN WITNESS WHEREOF, we have hereunto set our hand and seal the day and
year below written opposite my name.

the undersigned officer, personally appeared Doris Jean Wagner, Pauline T. Calaman,
Donna M. Calaman, Betty J. Comman and Darlene L. Monismith (known to me or
satisfactory proven) to be the persons whose names are subscribed to the within
instrument, and acknowledged that they executed the same for the purposes therein
contained.
