We represent Ervin Leasing Company ("Ervin"), the Assignee of Trimble Navigation
Limited/Trimble Financial Services with respect to a Lease Agreement, dated November 27, 2007,
by and between Trimble Financial Services and Larry V. Neidlinger (the "Lease"), pertaining to
certain land surveying equipment consisting of a Trimble 5800 Robotic Total Station with
accessories (collectively, the "Equipment"). Our client has advised that Mr. Neidlinger's estate has
defaulted in making the payments which are due under the Lease. I understand that several
months ago an employee of my client had spoken with Mr. Neidlinger's son, Justin, who indicated
that payments under the Lease would continue, but that no payments had been received, and there
had been no response to my client's inquiries regarding payment. Accordingly, by this letter we are
providing you with written notice of Ervin's claim against the Estate of Larry V. Neidlinger pursuant to
20 Pa. C. S. §3384.
I have enclosed a copy of the Lease Agreement and attachments and a copy of the
Assignment and Bill of Sale in favor of Ervin. Ervin's interest in the Equipment is reflected in a UCC-
1 Financing Statement filed December 10, 2007, in the Pennsylvania Department of State, as filing
number 2007121005470.
Pursuant to Section 17 of the general terms and conditions of the Lease, in the event of
default, Ervin has the right to recover an amount which includes: (1) all past due and current
installments of Base Rent and other amounts payable under the Lease, (2) all remaining

installments of Base Rent for the Initial Term discounted at the rate of 5% per annum, (3) the
amount of any tax credit required to be recaptured as a result of the early disposition of the
Equipment (4) an amount equal to 15% of the original cost of the Equipment (5) all applicable late
charges and interest payable pursuant to Section 10 of the general terms and conditions of the
Lease and (6) all expenses, including reasonable attorneys' fees incurred by Ervin in exercising any
of its rights and remedies under the Lease. As of July 21, 2009, the accelerated balance due was
$29,235.90, and additional late charges and interest will continue to accrue.
Under Section 11 of the general terms and conditions of the Lease, 'the Lessee bears all risk
of loss, theft, damage or destruction of the equipment from any cause whatsoever. Therefore, your
client should take appropriate steps to protect and secure the Equipment.
Please advise as to the present disposition of the Equipment, and your client's intentions with
respect to its obligations under the Lease.
