For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the
surviving spouse is three (3) percent [72 P.S. §9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero
(0) percent [72 P.S. §9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements
for disclosure of assets and filing a tax return are still appligble even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a
natural parent, an adoptive parent, or a stepparent of the child is zero (0) percent [72 P.S. §9116 (a) (1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half {4.5) percent,
except as noted in 72 P.S. §9116 1.2) [72 P.S. §9116 (a) (1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. §9116 (a) (1.3)]. A
sibling is defined under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

AGREEMENT OF SALE
THIS AGREEMENT of Sale is entered into this day of June, 2009, by and between the
Estate of Pauline B. Caldwell, deceased, c/o 126 E. King Street, Shippensburg, Cumberland
County, Pennsylvania, hereinafter called "Seller", and Kathy J. Lloyd of 1642 Walnut Bottom
Road, Newville, Cumberland County, Pennsylvania, hereinafter called "Purchaser".
IT IS MUTUALLY AGREED AS FOLLOWS:
1. The Seller agrees to sell, grant and convey to the Purchaser, and. the Purchaser agrees
to purchase and accept the conveyance of that certain parcel of real estate, with the improvements
thereon erected, known and numbered as 8 McFarland Street, situatf; in Newville Borough, __
Cumberland County, Pexuisylvania, designated as Cumberland County Tax :Parcel #28-21-0361-025,
and more particularly bounded and described in Deed recorded in Cumberland County Deed Book
"K", Volume 15, Page 240 (hereinafter called "the premises").
2. Purchaser agrees to pay the sum of Eighty One Thousand and 00/100 ($81,000.00)
Dollars to Seller as the full purchase price and consideration for the premises, payable in cash or
other immediately available funds, unless otherwise herein provided, at settlement of this transaction
as scheduled and provided herein below.
3 . Final settlement of this transaction shall be made at the office of Irwin & McKnight,
P.C., 60 West Pomfret Street, Carlisle, Pennsylvania, and shall be made on or before thirty (30) days
from the date hereof, which time shall be of the essence, at which time of settlement Seller shall
tender to Purchaser a properly drawn and executed deed of special warranty, conveying to Purchaser
a good and marketable title in fee'simple, flee and cleaz of all liens, tenancies and encumbrances,
except easements or building and use restrictions visible on the ground or of prior record.
4. All real estate taxes for the current yeaz shall be prorated between the parties to date
of final settlement, county and borough or township taxes on a January 1 to L>ecember 31 year basis
and school taxes on a July 1 to June 30 basis. Pennsylvania Realty Transfer Tax and any other sale
or transfer taxes to be paid equally by Seller and Purchaser. Purchaser shall be responsible for any
additional Pennsylvania Realty Transfer Tax imposed on any assignment of this Agreement.
5. Seller assumes the risk of loss by fire or other casualty until transfer of title and agrees
that the premises shall remain in substantially its present condition until date of settlement,
reasonable wear and tear excepted, and if it is not, Purchaser may rescind this contract.
6. Should Seller fail or refuse to convey as hereinafter provided, na addition to any other
remedies at law or in equity, Purchaser may require the reimbursement of reasonable title
examination expenses incurred by Purchaser.
7. This Agreement shall not be recorded in the Office of the FZecorder of Deeds or in any
other office or place of public record, and if Purchaser shall record this Agreement or cause orpermit
the same to be recorded, Seller may, at Seller's option, elect to treat Bitch act as a breach of this
Agreement and declare this Agreement to be null, void and of no further effect, retaining the amount
paid down as hand money.
8. This Agreement shall be null, void and of no further effect if Seller does not deliver a
fully executed copy/thereof to Purchaser on or before July 10, 2009.

confers upon personal representatives, the power to sell at public or private sale any real estate not
specifically devised.
