STIPULATION AGAINST LIENS
WHEREAS, DUANE A. BEARD AND COLLEEN T. BEARD, (the "Owner"), have..:
executed or are about to execute contemporaneously herewith a contract with~ '7_ i .~,~-r'
~vt'~,~ e ~"~ ~ T'6 ~ Pennsylvania contractor, (the "Contractor"), for construction of
a single family dwelling (collectively the "Improvements") on a tract of land located on LOT
NO. 118 GOOD HOPE FARMS SOUTH, situate in Hampden Township, Cumberland
County, Pennsylvania, known as Lot No. 118 GOOD HOPE FARMS SOUTH, and more
particularly described in Exhibit A attached hereto, incorporated herein by reference and made a
pan hereof (the "Premises").
NOW, December ~D-o~, 2000, before any authority has been given by the Owner to the
Contractor to commence work on the Improvements, or to purchase materials for the same, or to
enter into any contracts with any subcontractors or material men, or to authorize any purchases
by or through may subcontractors or material men, in consideration of the making of said contract
with the Owner and the further consideration of One ($1.00) Dollar, to Contractor paid by
Owner, and with the intent of all parties to be legally bound hereby, it is agreed that no lien shall
be filed against the Improvements, the Premises, or any part thereof, by the Contractor or may
subcontractor, or by any of the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased, for the Improvements to the Premises
(including hereafter changes made thereto), the fight to file liens being expressly waived.
It is the full intent of the Contractor, for himself and for any subcontractors or material
men claiming for themselves, or by, through or under the contract or the Contractor, that the right
to file a mechanic's lien, under the provisions of law and/or of Acts of Assembly in such cases
made and provided, for work done or materials famished in ad about the construction of the
Improvements to the Premises is hereby waived.
IN WITNESS WHEREOF, Owner and Contractor have executed this Stipulation Against
Liens the day and year first above written.

ALL THAT CERTAIN piece, parcel or lot of land, together with improvements, situated in Hampden Township,
County of Cumberland, and Commonwealth of Pennsylvania, and bounded and described as foBows:
BEGINNING at a point on the southern right of way line of Barbara Drive 50 feet wide, said point being located
at the northwestern corner of Lot No. 119; then along the western boundary line of Lot No. 119, through a 15
foot wide drainage easement, South 10 degrees 59' 7" East, for a distance of '110 feet, to a point at the
nadheastem corner of Lot No. 117 of Phase IV; thence along the northern boundary line of said Lot No. 117,
and along the centedine of said 15 foot wide drainage easement, South 70 degrees 45' 34" West, for a distance
of 107.23 feet to a point on the eastern dght of way lineal Joel Drive 50 feet wide; thence along said right of way
line of Joel Drive on the arc of a circle curving to the right, having a radius of 375. feet, and an arc length of
54.03 feet to a point; thence North 'l 0 degrees 59' 7" West, for a distance of 46.55 feet, to a point on the arc of a
circle curving to the right, having a radius of 25 feet and an arc length of 39.27 feet to a point on the southern
right of way line of Barbara Drive 50 feet wide; thence along said right of way line North 79 degrees 00' 53" East,
for a distance of 85 feet, to a point and the place of beginning.
This piece, parcel or lot of land contains approximately 12,772.96 square feet of land, has an address of
, Mechanicsburg, PA 17055, and is known and numbered as Lot No. 118 on the Final
Subdivision Plan for Good Hope Farms South - Phase III, which is recorded in Cumberland County in Plan
Book 77, page 82.
