WHEREAS, BRET T. SOBOTA AND LORIS F. CEDENO of Mechanicsburg,
Pennsylvania is about to execute contemporaneously herewith, a contract, with ROLAND
BUILDERS, INC. of Mechanicsburg, Pennsylvania, for the erection of a RESIDENTIAL
HOME building upon a lot of land situate:
ALL THAT CERTAIN tract or parcel of real estate situate in Upper Allen Township,
Cumberland County, Pennsylvania, being more particularly bounded and described as
follows:
BEGINNING at a point on the northern legal right-of-way of the cul-de-sac (private
road) at the southwest corner of Lot No. 5 on the hereinafter described Final
Subdivision Plan; thence along the southern line of Lot No. 5 North 73 degrees 19
minutes 11 seconds East a distance of 400.92 feet to a point on the western line of Lot
No. 1 on the hereinafter described Final Subdivision Plan; thence along the western line
of said Lot No. 1 South 04 degrees 24 minutes 00 seconds East a distance of 664.44 feet
to a point on the northern line of lands now or formerly of Eric H. and Mary
Humphries; thence along a the northern line of said lands now or formerly of Eric H.
and Mary Humphries North 82 degrees 24 minutes 00 seconds West a distance of
311.00 feet to a point at the southeast corner of Lot No. 7 on the hereinafter described
Final Subdivision Plan; thence along the eastern line of said Lot No. 7 North 21 degrees
21 minutes 22 seconds West a distance of 474.53 feet to a point on the southern legal
right-of-way line of the cul-de-sac of Susie's Way (private road); thence along the
southern legal right-of-way line of the cul-de-sac of Susie's Way by a curve to the left
having a radius of 50 feet a distance of 91.25 feet to a point at the southwest corner of
Lot No. 5 of the hereinafter described Final Subdivision Plan, the point and place of
BEGINNING.
CONTAINING 5.056 acres.
BEING Lot No. 6, Final Subdivision Plan Ford Farm Road-Plan No. 2, dated February
1, 1989, recorded in the Office of the Recorder of Deeds of Cumberland County in Plan
Book 57, Page 131.
BEING the same premises which Joshua M. Greenhoe and Christina M. Bove, his wife
by Deed dated November 2, 2005 and recorded December 5, 2005 in the Office of the
Recorder of Deeds in and for the County of Cumberland to Book 272 Page 1058granted and conveyed unto Bret T. Sobota.
UNDER AND SUBJECT TO Amended and Restated Covenants, Restrictions and
Reservations Applicable to Final Subdivision Plan Ford Farm Road-Plan No. 2, dated
May 12, 1989, recorded in the Office of the Recorder of Deeds of Cumberland Count
in Miscellaneous Book 3656, Page 217, and Second Amendment to Covenants
Restrictions and Reservations Applicable to Final Subdivision Plan Ford Farm Road
Plan No. 2, dated July 17, 1989, recorded in the Office of the Recorder of Deeds of
Cumberland County in Miscellaneous Book 367, Page 412 and Final Decree (Maser v.
Gemini Equipment), dated June 16, 2003, and recorded in the Office of the Recorder of
Deeds of Cumberland County, Miscellaneous Book 698, Page 2442.
Now, at the time of and immediately before the execution of the principal contract and
before any authority has been given by the said BRET T. SOBOTA AND LORIS F. CEDE
to
the said ROLAND BUILDERS, INC to commence work on the said building, or pch urchase
materials for the same in consideration of the making of the said contract with BRET T
SOBOTA AND LORIS F. CEDENO and the further consideration of One Dollar, to ROL
BUILDERS, INC. paid by BRET T. SOBOTA AND LORIS F. CEDENO it is agreed that no

material men or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such lien a
