COMPLAINT
AND NOW come plaintiffs, Treva L. Bryson and John A. Bryson,
by their attorney, Kent H. Patterson, and file this complaint as
follows:
1. Plaintiffs Treva L. Bryson and John A. Bryson are adult
individuals residing at 20 Bayberry Drive, Silver Spring
Township, Cumberland County, Pennsylvania (Mechanicsburg, PA
17050) .
2. Defendant PDSI, Inc. is a Delaware corporation doing
business in the Commonwealth of Pennsylvania and having a
registered office c/o CT Corporation System, 1515 Market Street,
Suite 1210, Philadelphia, PA 19102.
3. The events referred to in this complaint occurred on
the premises located at 5305 Simpson Ferry Road, Hampden
Township, Cumberland County, Pennsylvania which is a strip mall

now known as Mechanicsburg Plaza, in the driveway and/or walkway
and/or parking area at or near the portion of the strip mall
where the CVS Pharmacy had been located.
4. At all times mentioned in this complaint, defendant was
the owner or possessor of the premises referred to above which
were open to the plaintiff and other members of the public.
COUNT I.
TREVA L. BRYSON v. PDSI. INC.
5. On or about December 5, 1999 at approximately 3:00 p.m.
plaintiff drove to the strip mall of which defendant was the

owner or possessor, parked her car in the parking area in front
of the CVS Pharmacy store and walked from the parking area across
the driveway and/or walkway area towards the concrete sidewalk in
front of the CVS Pharmacy store.
6. As plaintiff was walking across the macadam driveway
and/or walkway she stepped into a hole or depression in the
macadam which caused her to fall and she was thrown to the
ground.
7. The fall of plaintiff was caused by the negligence and
carelessness of defendant which consisted of the following:
A. Maintaining the macadam driveway, walkway
and/or parking area in front of the strip mall in an

unreasonably dangerous condition for plaintiff and others to
walk on.
B. Failure to inspect the driveway, walkway and
parking areas in front of the strip mall to determine
whether it was safe for plaintiff and others to walk on.
C. Failure to repair the macadam driveway, walkway
and parking areas of the strip mall and in particular to
repair the depression and hole in the macadam into which
plaintiff stepped and fell.
D. Failure to warn plaintiff and others coming to the
strip mall of the dangerous condition of the macadam area in
which plaintiff fell.
E. Failure to exercise reasonable care in maintaining
the macadam'driveway, walkway and parking areas.
8. As a result of the negligence and carelessness of
defendant, plaintiff sustained injuries consisting of injury to
her left ankle, including muscle and ligament sprain, posterial
tibial tendonitis and other injuries.
9. As a result of the negligence and carelessness of
defendant, plaintiff has required medical treatment from
physicians and other healthcare providers including x-rays,
therapy, medication, rest and other treatment.

10. As a result of the negligence and carelessness of
defendant, plaintiff has and will incur medical expenses and will
or may be required to undergo medical treatment in the future.
11. As a result of the negligence and carelessness of
defendant, plaintiff has undergone pain and suffering and shock
and damage to her nervous system and will undergo pain and
suffering and shock and damage to her nervous system in the
future.
12. As a result of the negligence and carelessness of
defendant, plaintiff has or will suffer loss of life's pleasures
and enjoyment.
13. As a result of the negligence and carelessness of
defendant, plaintiff has suffered impairment of her earning power
and loss of income and may suffer future impairment of her
earning power and income.
14. As a result of the negligence and carelessness of
defendant, plaintiff has or will suffer disfigurement and
permanent disability to her person.
WHEREFORE, plaintiff demands judgment against defendant in
an amount in excess of the jurisdictional amount requiring
arbitration referral by local rules of court.

COUNT II.
JOHN A. BRYSON v. PDSI. INC.
15. Plaintiff incorporates by reference paragraphs 1
through 14.
16. As a result of the negligence and carelessness of the
defendant, plaintiff John A. Bryson has been obligated or may be
obligated in the future to expend various sums of money for
medicine and medical treatment of his wife, plaintiff Treva L.
Bryson.
17. As a result of the negligence and carelessness of the
defendant, plaintiff John A. Bryson was and may in the future be
required to provide care for his wife, plaintiff Treva L. Bryson.
18. As a result of the negligence and carelessness of the
defendant, plaintiff John A. Bryson has been deprived of the
comfort, companionship, services and assistance of his wife and
will be deprived or may be deprived of such consortium,
assistance and care in the future.

WHEREFORE, plaintiff demands judgment against defendant in
an amount in excess of the jurisdictional amount requiring
arbitration referral by local rules of court.

NEW MATTER
19. The accident and all damages involved in this case were caused by the
I direct and proximate result of the negligence and recklessness of Plaintiff, generally
and in the following particulars:
20. Plaintiffs' Complaint fails to state a claim upon which relief may be
granted.
21. Plaintiffs have failed to mitigate their damages.
22. If Plaintiffs sustained the injuries and damages as alleged in their
Complaint, then same were caused by other entities or parties over which Answering
Defendant had no control.
23. Plaintiffs' claims are barred, in whole and/or in part, by the appropriate
Statute of Limitations.

24. Plaintiffs voluntarily adopted a dangerous and hazardous method or
manner of performing the actions that they were then undertaking when there was a
safe method available and they thereby assumed the risk of injury in performing their
actions.
25. Plaintiffs' claims are barred, or must be reduced, as a result of
Plaintiffs' own negligence, which was the proximate cause of the incident described
in Plaintiffs' Complaint, pursuant to the Pennsylvania Comparative Negligence Act,
42 Pa. C.S.A. ~7100.
26. This Court lacks jurisdiction over the subject matter of the within action.
27. If Plaintiffs sustained the injuries and damages as alleged in their
Complaint, then the same were not proximately caused by any action or failure to act

28. Answering Defendant avers that Plaintiffs' cause of action is barred or
limited by the Sudden Emergency Doctrine.
