Hartzell, by and through his undersigned attorneys and petitions this Court for the settlement of a small estate pursuant to Section 3102 of the Probate, Estates and Fiduciaries Code, stating in support the following: 1. The petitioner is Dale O. Hartzell, of 128 Pazker Street in the Borough of Cazlisle 2. The petitioner's wife, Mazion R. Hartzell ("the decedent"), died testate on January 27, 2006. The decedent was also survived by two adult children, both of whom aze also the children of the petitioner. 4. The decedent's last will and testament, executed on December 2, 1992, makes no pre-residuary bequests and directs the distribution of her "residuary estate in accordance with the Intestate Laws of the Commonwealth of Pennsylvania [then] in effect." 5. Section 2102 of the PEF Code ("shaze of Surviving Spouse") at Subsection (3), provides that "[i]f there are surviving issue of the decedent all of whom aze issue of the surviving spouse also, [then the intestate shaze of the surviving spouse shall be] the first $30,000 plus one-half of the balance of the intestate estate." 6. Section 2101 (3) was amended to increase the amount of the spousal allowance from $20,000 to $30,000 in 1980, and was in effect both when the decedent's will was executed and on the date of death. The decedent's entire estate consisted of Ameriprise Financial Services account no. 1118 0102 3 001, invested exclusively in 1,036.22 shazes of the RiverSource Balanced A mutual fund, which had an average fair mazket value on the date of death of $10.09 per shaze, for a total date-of--death value of $10,455.46. ~~ 8. The value of the said mutual fund shazes as of the date of this petition is $9,035.83. 9. All other property owned by the decedent was held by the entireties with her husband, the petitioner. 10. All of the decedent's funeral expenses and debts have been paid, and no inheritance taxes are owed to the Commonwealth. WHEREFORE, the petitioner prays this Honorable Court issue a Decree awarding distribution of decedent's Ameriprise Financial Services account no. 1118 0102 3 001, invested exclusively in 1,036.22 shazes of the RiverSource Balanced A mutual fund, to the petitioner, pursuant to 20 Pa.
