COMPLAINT
AND NOW, this 26th day of April, 2004, comes Plaintiff, by and through his
attorney, Joseph D. Buckley, and cornplains of Defendants as follows:
I. Plaintiff, Brian Nailor, is an adult United States citizen who current resides at
2030 Walnut Bottom Road, Carlisle, Cumberland County, P A.
2. Plaintiff, a finish carpenter and cabinet maker, owns and operates a business
called Brian Nailor Carpentry, Etc. also from said 2030 Walnut Bottom Road,
Carlisle, P A 17013 location.
3. Defendants, James and Denise Kanelas, are adult Unites States citizens,
currently husband and wife, who own and reside in the property located at 6
Abbey Lane, Camp Hill, Cumberland County, P A 170 II.
4. On several occasions during the years 2000 through 2002 Defendant, Denise
Kanelas, then Denise Romminger, employed Plaintiff for carpentry work and
other jobs at her then residence.
5. During said time period all work completed for Defendant Denise Kanelas
was performed on a time and material basis, all in a professional workmanlike
manner and bills for work were presented at the end of the work completed.
6. At the end of said time period Plaintiff extended credit to Defendant Denise
Kanelas, then Romminger, for work completed based on her statements that
she was having marital difficulties and would have to make payments to
Plaintiff over time.
7. Plaintiff permitted said Defendant to make time payments for work
performed.
8. In July 2003, Defendant Denise Kanelas contacted Plaintiff and requested that
he come to her new residence as she and her husband needed some work
performed.
9. Plaintiff arrived at the Defendants' home and spoke with the Defendants
regarding potential work.
10. Plaintiff was showed through the home and Defendants described in detail the
various work they desired including, repair and replacement of a door, crown
molding in a bedroom, cabinets and shelving in the nursery and shelves in
many area and some other minor jobs. '
II. Defendants also specifically requested that Plaintiff build them a umque,
custom buffet cabinet for the dining room made to a certain size and with
specific dimensions.
12. Plaintiff asked if Defendant Denise Kanelas if she desired a written estimate
for the work and she replied "No, I just want it done."
13. Defendants inquired whether the work could be completed by the end of
October and Plaintiff told them of his existing commitments but promised he
would begin as soon as openings permitted. Plaintiff estimated that he could
not cornplete Defendants' work, especially the custom piece, until sometime
in November 2003.
14. On August 8, 2003, Plaintiff installed the crown molding in Defendants'
bedroom.
15. By late September, 2003, Plaintiff had replaced the back door, installed the
crown molding and had made an example of the shelves for approval and
received an installment payment of $1000.00 toward materials from
Defendants.
16. On Septernber 26, 2003, Defendants approved the shelves and Defendant
James Kanelas approved the height the shelving were to be placed on the wall.
17. On September 29, 2003, the nursery cabinets and shelving were delivered to
Defendants' residence.
18. Defendants were to paint the shelves and cabinets prior to having Plaintiff
install the same.
19. Prior to installation Defendant James Kanelas reiterated the desired height of
the cabinets and shelves.
20. On October I, 2003, Plaintiff delivered to Defendants an invoice for time and
materials to date in the amount of $3,709.20 less the deposit given Plaintiff of
$1,000.00. (A copy of the Job Work Order is attached hereto, made a part
hereto and marked Exhibit "A").
21. At this time Plaintiff and another cabinet maker were crafting the custom
buffet cabinet for the Defendants' dining roorn.
22. On October 11, 2003, Plaintiff spoke with Defendant Denise Kanelas
regarding the custom mobile buffet cabinet.
23. During this conversation, said Defendant inquired as to the cost of the custom
piece; Plaintiff advised Defendant that to date with the time and materials the
cost was $3,000.00 - $4,000.00 and that upon completion the cost would be
more.
24. On October 22, 2003, Plaintiff installed Defendants nursery shelves and
cabinet.
25. On October 22, 2003, Plaintiff had completed the custom buffet cabinet and
delivered a bill to Defendants in the amount of $6,201.95. (A copy of the Job
Work Order is attached hereto, made a part hereto and marked Exhibit "8").
26. On October 23, 2003, Plaintiff installed shelving in the Defendants'
downstairs playroom.
27. On October 23, 2003, Plaintiff telephoned Defendant Denise Kanelas and
informed her that all work was completed, but that Plaintiff would not install
the custorn buffet cabinet until he received payment.
28. Defendant telephoned Plaintiff and dernanded he cease all work being done
for Defendants.
29. Plaintiff who had completed all work specifically requested by Defendants
prior to having been instructed to cease all work, sent Defendants a final
corrected bill for the work performed at their home and for the custom work
they requested. (A copy of the invoice dated November 3, 2003 is attached
hereto, made a part hereto and marked Exhibit "C").
30. Plaintiff performed all work for Defendants in a professional workmanlike
manner and followed their specific directions during his ernploy.
31. The custom buffet cabinet which Defendants specifically requested Plaintiff
construct for them is a unique piece, custom built to Defendants' requirements
and specifications.
32. Plaintiff has presented a bill for the services totaling $10,167.08 less
$1,000.00 rendered at the specific request of Defendants and they have
refused to pay the balance due of$9,167.08.
33. Defendants have breached their agreement with Plaintiff for work requested
and performed.
34. Defendants have breached their agreement for the construction of a unique
and custom piece of furniture designed and specified by Defendants.
WHEREFORE, Plaintiff requests this Honorable Court enter a judgrnent in his favor
against Defendants in the amount of $9,167.04 plus interest, costs of this suit and any
other amounts the Court deems fair and just.

30, Denied, Plaintiff's work was incomplete, unworkmanlike, and unsatisfactory.
The averments set out in Defendants' New Matter are incorporated herein.
31. Denied. The agreement between the parties was that Plaintiff would construct
cabinets in Defendants' dining room. Plaintiff never presented a plan or other data from
which Defendants could approve such cabinets, the cabinets were never designed to
Defendants' knowledge or satisfaction, and Defendants do not believe there was anything

unique or unusual about the cabinets. The cabinets have never been installed in or
delivered to Defendants' home.
32. Defendants admit that Plaintiff has submitted a statement and made such a
demand but denies that any further payment to Plaintiff is due for the reasons set forth in
their New Matter, the averments of which are incorporated herein by reference.
33, Denied. Plaintiff is the party that breached the oral agreement between the
parties for the reasons and in the manner set forth in Defendants' New Matter, the
averments of which are incorporated herein.
34, Denied for the reasons set forth in the answer to Paragraph 31 above and for

WHEREFORE. Defendants demand that Plaintiff's Complaint in this matter be
dismissed.
NEW MATTER
In addition to the foregoing averments, Defendants set forth the following New
Matter in response to Plaintiff's claim:
35. At all times relevant to this action, Plaintiff held himself out to Defendants as
an expert in cabinetry and carpentry.
36. In July of 2003, Plaintiff and Defendants entered into an oral agreement
whereby Plaintiff promised to construct and install in Defendants' home at 6 Abbey Lane
the following items:
A. A new door for the back sunroom; and
B. Crown molding in a small bedroom for their daughter; and
C. A built in cabinet in the daughter's bedroom measuring
approximately six feet high, thirty inches wide and sixteen to twenty inches
deep; and
D. Install four shelves approximately four feet long in the daughter's
bedroom; and
E. Install three triangular shelves in the corner of the child's playroom;
and

F. Build and install in the dining room cabinets which were to be
designed by Plaintiff and approved by Defendants before they were installed.
All of this work was to be completed by the end of August 2003 and Defendants made
known clearly to Plaintiff the requirement that the work be completed by that date.
37. At the time the parties entered into the oral agreement described in the
foregoing paragraph, Plaintiff advised Defendants that the total cost of the work he was
to do would be a "couple" grand, Plaintiff also agreed to prepare and submit to
Defendants a detailed proposal outlining the work to be done and the cost for such work.
In reliance upon these representations by Plaintiff, Defendants authorized Plaintiff to
commence the work.
38. Plaintiff did not complete the work as promised in his agreement with
Defendants. He did not complete the installation of the crown molding, the built in
cabinet and shelves in the daughter's bedroom, the shelves in the play room, or the
cabinet in the dining room.
39. Plaintiff did not perform his work in a good and workmanlike fashion, as
required by the agreement between the parties. Much of his work was shoddy and
incomplete and contained latent defects.
40. Plaintiff did not complete the work he did by the end of August 2003 as
required by the agreement between the parties and as promised by Plaintiff. Much of the
work he did was not done until October of 2003 and he has still not completed all of the
work required by the agreement between the parties.
41. Plaintiff breached the contract between the parties. Specifically:
A. He never provided the detailed estimate or proposal to outline and
describe the work he was going to do; and
B. He never prepared or presented to Defendants the details of the
cabinetry he claimed he would install in their dining room; and
C. He failed to complete the work under the agreement as he
promised; and
D. He did not complete what work he did in accordance with the time
schedule he promised; and
E. The work that Plaintiff did for Defendants was not workmanlike or
of good quality and was not in the workmanlike and quality fashion as
required by the agreement between the parties or as promised by Plaintiff.

42. Defendants believe that Plaintiff has overcharged them by claiming payment
for work which he did not do or materials which he did not use in the work he claims to
have done for them, The prices that Plaintiff now seeks to charge Defendants for the
work he claims to have done for them are excessive and unreasonable.
WHEREFORE, Defendants demand that Plaintiff's Complaint be dismissed and that
judgment be entered in their favor in this matter.

36. Admitted in part, denied in part. It is admitted that Plaintiff and Defendants
entered into an agreement for work to be perfomled at Defendants' home; it
is denied that the work was to be finished by the end of August, 2003. To the
contrary it was that the work would not be able to begin until August, 2003,
with completion by December, 2003. By way offurther explanation, Plaintiff
not only installed the stated items, but also custom manufactured the items to
be installed.
37. Denied. The work was to be completed on a timf' and material basis as had
been the custom of prior work performed. By further explanation, Plaintiff
stated that he would need a couple of grand prior to beginning the work in
order to purchase materials.
38. Denied. Plaintiff completed the work but Defendants refused to pay for the
custom work, thus only the custom cabinets were not delivered.
39. Denied. Plaintiffs work was performed in a workmanlike quality.
40. Admitted in part. Plaintiff specifically stated the work could not be
performed and completed until December, 2003.
