COMPLAINT FOR PRIMARY PHYSICAL CUSTODY
AND NOW, this day of October, 2009, comes the Plaintiff, Mary
Katherine Hays, by her attorney, Diane M. Dils, Esquire, and respectfully avers the
following:
1. The Plaintiff is Mary Katherine Hays, an adult individual currently residing at
10 Mayberry Lane, Mechanicsburg, Cumberland County, Pennsylvania
17050.
2. The Defendant is Christopher W. VanDenEeden, an adult individual currently
residing at (p West Main Stree ('Me hamcsburg, Cumberland County
Pennsylvania 17050.

3. The Plaintiff and Defendant were never married; however, they are the
natural parents of one child; namely: Sophia Grace VanDenEeden, born
December 13, 2007 in Harrisburg, Pennsylvania.
4. The Plaintiff and Defendant have not resided together since May of 2008.
5. The minor child has been in the primary physical custody of her mother since
May of 2008.
6. There has been limited and sporadic contact between the Defendant and the
minor child since May of 2008.
7. The Plaintiff believes that it is in the best interest of her daughter that there be
a specific schedule set forth to provide for periods of partial custody in the
Defendant with the minor child.
8. Previous to the current address of the Plaintiff, the minor child resided on
Portland Street in Mechanicsburg, Pennsylvania with both Plaintiff and
Defendant.
9. The minor child has resided in Cumberland County, Pennsylvania since her
birth on December 13, 2007.
10. The Court of Common Pleas of Cumberland County has jurisdiction in this
matter.

11. The Plaintiff has not participated as a party or witness in any capacity in other
litigation concerning the custody of the minor children in this or any other
Court.
12. The Plaintiff has no information of the custody proceedings concerning the
children pending in a Court of this Commonwealth or any other state.
13. The Plaintiff does not know of a person not a party to the proceedings who
has physical custody of the children or claims to have custody or visitation
rights with respect to the children.
14. The Plaintiff respectfully prays Your Honorable Court to enter and Order for
shared legal custody, primary custody in her with partial custody rights in the
Defendant.
WHEREFORE, the Plaintiff, Mary Katherine Hays, respectfully prays Your
Honorable Court to grant her request for primary physical custody.

ORDER OF COURT
AND NOW, Friday, October 16, 2009 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Tuesday, November 10, 2009 at 9:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

consideration of the attached Custody Conciliation Report, it is ordered and directed as
follows:
1. The Mother, Mary Katherine Hays shall have sole legal custody of Sophia
Grace VanDenEeden born December 13, 2007.
2. Mother shall have primary physical custody of the child.
3. Father shall have the following periods of partial physical custody:
A. Beginning, Sunday, November 22, 2009, alternating Sundays from
1:00 p.m. to 6:30 p.m.
B. Such other times as the parties agree.
4. Transportation shall be shared such that the receiving party shall transport.
5. Neither party may use illegal drugs or partake in alcoholic beverages to
the point of intoxication immediately before or during their periods of physical custody.
6. Telephone calls from Father to Mother are limited to issues regarding the
child.
7. Father shall provide his own baby supplies and the child shall sleep in her
crib during Father's periods of physical custody.
8. This Order is entered pursuant to a Custody Conciliation Conference. The
parties may modify the provisions of this Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control. Either party may contact the
Conciliator within 90 days of the date of this Order to request another conciliation
conference.
