Willacy, are adult individuals residing at 211 Forge Road, Boiling Springs, Cumberland County, Pennsylvania 17007. 2. Defendant, David Spotts, is an adult individuals riding at 912 Acri Road, Mechanicsburg, Cumberland County, Pennsylvania 17050. 3. On or about February 6, 2009, Plaintiff John C. Willacy was operating his 2005 Chrysler Town & Country Van on Interstate 81 South in Cumberland County, Pennsylvania. 4. Plaintiff exited Interstate 81 South at the High Street Exit and proceeded to merge into the right lane. 5. At that time and place, the Defendant who was operating a 2005 GMC 3500 truck towing a trailer had exited Interstate 81 South and pulled into the left-hand lane. 6. As Plaintiff exited, he got into the right-hand lane. 7. At that time, Defendant attempted to make a right-hand turn from the left-hand lane of Trindle Road. 8. At that time, the right side of Defendant's trailer struck the left front of Plaintiffs vehicle. 9. As the direct and proximate result of the collision, Plaintiffs vehicle was damaged in the amount of $3,184.96. A true and correct copy of the appraisal is attached hereto as Exhibit "A." 10. The collision occurred as a result of the negligence, recklessness and carelessness of the Defendant in that he: a. attempted to make a right-hand turn from the left lane of traffic; b. failed to yield the right of way to Plaintiff's vehicle which was lawfully in the right-hand lane; C. failed to make the right turn in a manner to avoid striking the Plaintiffs vehicle; and, d. violated the Pennsylvania Motor Vehicle Code by turning in front of Plaintiff's vehicle when it was not safe to do so. 11. As a direct and proximate result of the negligence of the Defendant, Plaintiffs vehicle was damaged in the amount $3,184.96. WHEREFORE, Plaintiffs John C. Willacy and Susan C.
