Plaintiff, CHASE BANK USA, N.A. is a corporation with offices at 3700 WISEMAN BLVD. SAN ANTONIO , TX 78251 2. Defendant , is adult individual(s) residing at the address listed below: CLARENCE BURKETT 8 NEPONSIT LN CAMP HILL, PA 17011 Count I - 5183373330156521 3. Defendant applied for and received a credit card issued by Plaintiff bearing the account number 5183373330156521 . 4. Defendant made use of said credit card and has currently a balance due and owing to Plaintiff, as of September 28, 2009 , in the amount of $13552.62 5. Defendant is in default of the terms of the Cardholder Agreement having not made monthly payments to Plaintiff thereby rendering the entire balance immediately due and payable. A true and correct copy of the Statement of Account is attached hereto, marked as Exhibit "1" and made a part hereof. 6. Plaintiff avers that the Agreement between the parties provides that Defendant will pay Plaintiff's attorneys' fees. 7. Plaintiff avers that such attorneys' fees will amount to $150.00 . 8. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or refused to pay the principal balance, finance charges, attorneys' fees, or any part thereof to Plaintiff. WHEREFORE, Plaintiff prays for judgment on Count I against Defendant , CLARENCE BURKETT , INDIVIDUALLY the amount of $13552.62 with continuing interest thereon at the statutory rate of 6.000o per annum from September 28, 2009 , plus attorneys' fees of $150.00 and costs. Defendant applied for and received a credit card issued by Plaintiff bearing the account number 4366163068932405 . 11. Defendant made use of said credit card and has currently a balance due and owing to Plaintiff, as of September 28, 2009 , in the amount of $6189.15 . 12. Defendant is in default of the terms of the Cardholder Agreement having not made monthly payments to Plaintiff thereby rendering the entire balance immediately due and payable.
