RUSSELL, Plaintiff V. PATRICIA A. MILLER, Defendant IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PA NO. 09- 4935 Ceu;4 1 CIVIL ACTION - LAW JURY TRIAL DEMANDED COMPLAINT 1. The Plaintiff, Matthew S. Russell is an adult resident of Shippensburg, Cumberland County, Pennsylvania. 2. The Defendant, Patricia A. Miller is an adult resident of Shippensburg, Cumberland County, Pennsylvania. 3. On or about November 28, 2007, at approximately 5:30 p.m., Plaintiff Matthew Russell was traveling South on Ritner Road in West Pennsboro Township, Cumberland County, Pennsylvania. 4. At that time and place, Defendant Miller was traveling North on Ritner Road. 5. Defendant Miller encountered a farm tractor also proceeding North on Ritner Road, which was situated partly on the traveled portion of the highway, and partly on the berm. 6. Defendant Miller decided to pass the tractor and in so doing entered the northbound travel lane of Ritner Road. 7. Defendant Miller, while passing in the oncoming lane of traffic, impacted the front of Plaintiff Russell's vehicle, causing it to go out of control onto the West berm of Ritner Road, and Road, and then back across the travel lines of Ritner Road, impacting the vehicle operated by Michael Morton. 8. All of Plaintiff's damages as hereinafter related are the direct and proximate result of the negligence of Defendant Miller and that she: a. violated the Pennsylvania Vehicle Code; b. crossed over into the oncoming lane of traffic when it was not safe to do so; C. failed to keep a proper lookout on the road for oncoming traffic; d. executed a dangerous passing maneuver in the face of oncoming traffic; e. failed to keep her vehicle under proper and adequate control; f. failed to move her vehicle back into the northbound lane of traffic before impacting Plaintiff Russell; and g. violated the laws of the Commonwealth of Pennsylvania. 9. As a result of Defendant's negligence, Plaintiff Matthew Russell has sustained serious and permanent injuries which include but are not limited to the following: a. facial and right orbital fracture resulting in optic nerve damage; b. closed head injury resulting in brain bleed; C. tramautic brain injury resulting in cognitive deficits; d. spinal injury; e. solid organ injury; and f. first rib fracture. 10. Asa result of Defendant's negligence, Plaintiff Matthew Russell has suffered injuries which are or may become permanent. 11. By reason of the aforesaid injuries sustained by Plaintiff Matthew Russell, incurred liability for medical treatments, medications and similar expenses in an effort to restore himself to health and claim is made therefor. 12. Because of the nature of his injuries, Plaintiff Matthew Russell has been advised and therefore avers that he may be forced to incur similar expenses in the future and a claim is made therefor. 13. As a result of the aforementioned injuries, Plaintiff Matthew Russell has undergone and in the future will undergo great physical and mental suffering, great inconvenience in carrying out his daily activities, loss of life's pleasures and enjoyment and a claim is made therefor. 14. Plaintiff Matthew Russell continues to be plagued by persistent pain and limitation and therefore, avers that injuries may be of a permanent nature causing residual problems for the remainder of his lifetime and a claim is made therefor. 15. As a result of the aforementioned injuries, Plaintiff, Matthew Russell has in the past and will in the future sustain a loss of earnings and earning capacity and claim is made therefore. 16. As a result of the disfigurement from the aforementioned injuries, Plaintiff Matthew Russell has been and in the future will be subject to great humiliation, embarrassment, and disfigurement claim is made therefor. WHEREFORE, Plaintiff demands judgment against Defendants in an amount in excess of Fifty Thousand ($50,000.00) Dollars, exclusive of interest and costs and in excess of any jurisdiction amount requiring compulsory arbitration.
