AUDITOR'S INTERIM REPORT, October 19, 2009 AND REQUEST FOR ORDER
To the Honorable J. Wesley Oler, Jr.:
Your Honor has appointed me Auditor in the above captioned matter and charged me
with reviewing the existing file and a multitude of prehearing issues raised by the parties and to
schedule and hold a hearing as soon as scheduling permitted. Ten days of hearings have been
held and five days of hearings are scheduled for October 26-30, 2009.
On October 9, 2009 the Executrices/Trustees filed two documents: a Petition to Take
Testimony Outside the Commonwealth and a Motion for Remote Testimony of Witness James
L.S. Browdish, Esquire. Both the Petition and Motion relate to work performed by a Florida
attorney hired by the Estate/Trust relative to litigation involving the Estate/Trust in Florida and
to permit the witness to testify via telephone or video cam relative to matters. One of the
Objectors agreed to permit the remote testimony and one did not so agree. The undersigned is
comfortable with remote testimony.
Thus, I recommend that both the Petition to Take Testimony Outside of the
Commonwealth and the Motion for Remote Testimony of Witness James L.S. Bowdish, Esquire
be granted.
