Plaintiff is US BANK NATIONAL ASSOCIATION ND dba Elan Financial Services, with place of business located at 9321 Olive Boulevard, St. Louis, Missouri. 2. Defendant is All Metal Structures LLC, with a place of business located at 8 Jenny Drive, Boiling Springs, Cumberland County, Pennsylvania. 3. Defendant is Todd L Travitz, an adult individual residing at, 8 Jenny Drive, Boiling Springs, Cumberland County, Pennsylvania. Count I US Bank National Association ND dba Elan Financial Services v. All Metal Structures LLC 4. Plaintiff is a national banking association, engaged in various types of banking business including lending through the issuance of credit cards. 5. Plaintiff furnished credit to the defendant by means of a(n) M&T Bank credit card with account number ending in 6210 hereinafter referred to as the credit card account. 6. Plaintiff kept accurate running records of all debits and credits to the account. 7. Plaintiff mailed to defendant monthly statements for the account including the billing statement attached hereto as Exhibit A. The monthly statements accurately stated the previous balance, the debits and credits to the account for the prior billing period. 8. Before plaintiff mailed Exhibit A, defendant had for many months made payments on account of the billing statement or retained the statement without payment. 8. Defendant's actions as set forth above constituted an account stated between parties for the sum of $6,146.41 which sum reflects the Exhibit A statement balance less credits, if any, which were applied subsequent to the date of Exhibit A. Wherefore, plaintiff demands judgment for Count I against defendant for the sum of $6,146.41, and the costs of this action. Count II US Bank National Association ND dba Elan Financial Services v. Todd Travitz 9. Plaintiff incorporates herein by reference above paragraphs 4 through 8. 10. On or about December 16, 2004, defendant, Todd Travitz, executed his personal guaranty of the obligations of All Metal Structures LLC to plaintiff. A true and correct copy of the signed guaranty is incorporated above as Exhibit B. 11. As set forth in Count I, All Metal Structures LLC, failed to pay plaintiff the balance due in the sum of $6,146.41.
