COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff is: ONEWEST BANK FSB, whose address is c/o Mancini & Associates, 201
A Fairview Drive, Monaca, PA 15061.
2. Defendant is BROOKE R. RHODES, whose last known address is P.O. BOX 615,
NEW CUMBERLAND, PA 17070. BROOKE R. RHODES is the mortgagor and the
recorded owner of the mortgaged property hereinafter described.
3. On or about, APRIL 12, 2007, BROOKE R. RHODES borrowed $104,000.00 and in
the enforcement of said debt executed and delivered a mortgage upon the premises
hereinafter described to the lender MORTGAGE ELECTRONIC REGISTRATION
SYSTEMS, INC. AS NOMINEE FOR AMERICAN BROKERS CONDUIT, this
mortgage is recorded in the Office of the Recorder of Deeds of CUMBERLAND County
in Mortgage Record Book 1989, Page 3454. This mortgage is incorporated herein by
reference in accordance with Pa. R.C.P. 1019 (g). Your Plaintiff, ONEWEST BANK
FSB is now the current owner of said mortgage, and the assignment evidencing this
ownership will be sent for recording at a later date.
4. On FEBRUARY 17, 2009 the Defendant THE UNITED STATES INTERNAL
REVENUE SERVICE filed a lien, on record at Docket # C9-970 FTL, against the
premises hereinafter described in the sum of $6,353.65. This lien is subordinate to the
Mortgagee/Plaintiff by virtue of it being filed after your Plaintiff's Mortgage was
properly filed.
5. On AUGUST 14, 2009 the Defendant THE UNITED STATES INTERNAL
REVENUE SERVICE filed an additional lien, on record at Docket # 09-5650, against the
premises hereinafter described in the sum of $6,381.50. This lien is subordinate to the
Mortgagee/Plaintiff by virtue of it being filed after your Plaintiff's Mortgage was
properly filed.
6. The land subject to the Mortgage is 323 EUTAW AVENUE, NEW CUMBERLAND,
PA 17070 and is more particularly described in Exhibit "A", which is attached hereof and
part of this Complaint.
7. The Mortgage is in default because monthly payments of principal and interest upon
said mortgage due JANUARY 1, 2009, and each month thereafter are due and unpaid,
and by the terms of said Mortgage, upon default in such payments for a period of one
month, the entire principal balance and all interest due thereon are collectible forthwith.

** Together with interest at the per diem rate noted above after JANUARY 1, 2009 and
other charges and costs to date of Sheriff's Sale. The Attorney's Fees set forth above are
in conformity with the Mortgage documents and Pennsylvania law, and will be collected
in the event of a third party purchaser at Sheriff's Sale. If the Mortgage is reinstated prior
to the sale, reasonable attorney's fees will be charged in accordance with the reduction
provisions of Act 6, if applicable, or that are actually incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any jurisdiction.
9. The combined notice specified by the Pennsylvania Homeowner's Emergency
Mortgage Assistance Program, Act 91 of 1983 and Notice of Intention to Foreclose under
Act 6 of 1974 has been sent to each defendant on SEPTEMBER 16, 2009, via certified
and regular mail, in accordance with the requirements of those acts.
10. Defendant is not a member of the Armed Forces of the United States of America, nor
engaged in any way which would bring them within the Soldiers and Sailors Relief Act
of 1940, as amended.
11. The Defendant has either failed to meet the time limitations as set forth under the
Combined Act 6/91 Notice or have been determined by the Pennsylvania Housing
Finance Agency not to qualify for Mortgage Assistance.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure `IN REM'
for the aforementioned total amount due together with interest at the rate of 7.25%
($20.31 per diem), together with other charges and costs including escrow advances
incidental thereto to the date of Sheriff's Sale and for foreclosure and sale of the property
within described.

LEGAL DESCRIPTION
ALL THAT CERTAIN lot or tract of land situate in the Borough of New Cumberland, County of Cumberland and
Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the southeastern corner of Eutaw Avenue and Ruby Avenue, 140 feet to a point;
thence in a southerly direction along the western line of Apple Alley 24 feet to a point; thence in a westerly
direction 140 feet to Eutaw Avenue; and thence in a northerly direction along the eastern line of Eutaw Avenue 24
feet to the place of BEGINNING.
BEING part of Lot No. 18, Block I, of Buttorfrs Addition to the Borough of New Cumberland Plan of which is
recorded in the Cumberland County Recorder's Office in Deed Book 5-N, Page 498.
HAVING THEREON ERECTED the northern one-half of a two story frame dwelling house known as No. 323
Eutaw Avenue.
BEING the same premises which ROSE MARIE SALTER, A SINGLE WOMAN, by Deed dated May 1, 2003, and
recorded May 14, 2003, in the Office of the Recorder of Deeds in and for the County of Cumberland,
Pennsylvania, in Book 257, Page 153, granted and conveyed unto BROOKE R. RHODES, A MARRIED MAN,
Mortgagor herein.
