AMBER ONUKIAVAGE, Defendant COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION - DIVORCE CASE NO. 0 9- 13 93 DIVORCE COMPLAINT NOW COMES Plaintiff Trevor Onukiavage, by and through his attorneys, Rhoads & Sinon LLP, and files the following Divorce Complaint and stating in support thereof as follows: 1. Plaintiff is Trevor Onukiavage an adult individual residing at 1162 Newville Road, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendant is Amber Onukiavage, an adult individual whose current residence is unknown. 3. Plaintiff and Defendant have been bona fide residents of the Commonwealth for at least six months immediately prior to the filing of this Complaint. 4. Plaintiff and Defendant were married on August 30, 2008. COUNT I: 3301(c) MUTUAL CONSENT 5. Plaintiff incorporates herein by reference Paragraphs 1 through 4 above. 6. In October, 2009, Plaintiff and Defendant separated, living separate and apart since that time, although Plaintiff and Defendant were previously separated during their military tour outside the United States. 7. There are no prior actions of divorce or annulment. 757495.1 8. The marriage is irretrievably broken. 9. Plaintiff has been advised that counseling is available and that Plaintiff may have the right to request that the Court require the parties to participate in counseling. 10. Plaintiff and Defendant do not have children. 11. Plaintiff and Defendant are both currently in the military. 12. Plaintiff reasonably believes that Defendant will consent to a divorce. 13. There are no outstanding issues between the parties regarding property division. 14. Ninety (90) days after service of the Complaint, Plaintiff will file an Affidavit of Consent and Waiver of Notice of Intention to Request Entry of Section 3301(c) Divorce Decree. Plaintiff reasonably believes that Defendant will execute an Affidavit of Consent and Waiver of Notice of Intention to Request Entry of Section 3301(c) Divorce Decree. 15. Plaintiff requests that, to the extent both parties execute these documents and file a Praecipe to Transmit the Record, the Court enter a decree of divorce based upon Section 3301(c) of the Divorce Code. WHEREFORE Plaintiff Trevor Onukiavage respectfully requests that this Honorable Court enter a Decree of Divorce pursuant to Section 3301(c) of the Pennsylvania Divorce Code, 23 Pa.C.S.A. §3301(c). COUNT II: 3301(d) IRRETRIEVABLE BREAKDOWN (Alternative Count) 16. Plaintiff incorporates herein by reference Paragraphs 1 through 15 above. 757495.1 17. Plaintiff reasonably believes that Defendant will consent to a divorce and execute the Affidavit and Waiver necessary to effectuate a final divorce 90 days after service of this Complaint. 18. To the extent Defendant refuses to do so, however, Plaintiff asserts Count II as an alternative basis for divorce pursuant to Section 3301(d) of the Divorce Code, 23 Pa.C.S. §3301(d), irretrievable breakdown. 19. The marriage between Plaintiff and Defendants is irretrievably broken. Plaintiff and Defendant separated in October, 2009, although Plaintiff and Defendant were previously separated during their military tour outside the United States. 20. In the event the parties are unable to execute the documents necessary to obtain a ' divorce by consent pursuant to Section 3301(c), Plaintiff will wait until Plaintiff and Defendant have lived separate and apart for a period of two years and file an Affidavit setting forth the facts necessary for a divorce pursuant to Section 3301(d) of the Code. WHEREFORE, Plaintiff Trevor Onukiavage respectfully requests that this Honorable Court enter a Decree of Divorce pursuant to Section 3301(d) of the Pennsylvania Divorce Code, 23 Pa.C.S.A. §3301(d).
