ORDER OF COURT
IN THE COURT OF COMMON PLEAS
CUMBERLAiqD COUNTY, PENNSYLVANIA
AND NOW, this llth day of December, 2001,
the Defendant, Clarence J. Myers, Jr., now appearing in
court for a trial on a charge of indirect criminal contempt
arising out of an alleged violation of a Protection from
A]Duse Order issued by the Honorable Keith B. Quigley on
October 23, 2001, with the Public Defender, Linda S.
Hollinger, Esquire, and having tendered a plea of guilty as
charged with an agreement as to the sentence which is
acceptable to the victim, the Defendant's plea of guilty is
accepted.
Pursuant to an agreement of the Commonwealth
in the person of Michael W. Mervine, Esquire, and Defendant
and his counsel, and with the concurrence of the victim in
the case, the sentence of the Court is that the Defendant
pay the costs of prosecution, and any fees required under
the Protection from Abuse Act, and that he undergo a period
of imprisonment in the Cumberland County Prison of not less
than five days nor more than six months, with credit to be
given for five days previously served. It appearing that
the Defendant has served the minimum portion of this
sentence, he is paroled immediately, conditioned upon his
being and remaining on good behavior, complying with all
directions of his parole officer, having no contact, direct
or indirect, with the victim in this case, except through
counsel, and undergoing and complying with any recommended
course of treatment after a drug and alcohol evaluation.
The reason for this sentence is that it was
agreed upon the between the Commonwealth and the Defendant.
It is authorized that supervision of parole
in this case be transferred to Perry County if recommended
and if Perry
by the Curaberland County Probation Office
County is willing to accept supervision.
